Act

Act Mr James Gillespie minister and Buchanan of Craigievairn for stipend

Concerning the petition given in to the lords of their majesties’ privy council be Mr James Gillespie, late minister at Drymen, and John Buchannan of Craigievairn for himself and in name and behalf of the remanent heritors within the said parish showing that both the petitioners did apply to their lordships lately for the half of stipend of the said parish for the crop and year of God 1690 where at their lordships’ disposal, their majesties being patron for pious uses within the said parish, the said church being declared vacant by the presbytery before Michaelmas 1690. Their lordships delayed then to dispose upon the same and the said church having been vacant the whole year 1691, so that there is a year and a half stipend to be disposed of, and the said Mr James Gillespie, the late incumbent, being a poor aged indigent person and the kirk and manse being ruinous and there being several bridges to be built within the said parish, and therefore craving to the effect underwritten as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above Mr James Gillespie and the heritors of the parish of Drymen, with a testificat or consent mentioned therein and produced therewith, they allow to the said Mr James Gillespie the equal half of the stipend of the above kirk of Drymen for the last half of the crop and year of God 1690 and whole crop and year of God 1691, and allow the other equal of the stipend of the said kirk to be employed for the terms and space above written for repairing of the said kirk and manse and other pious uses within the parish at the sight and by the advice of the heritors of the parish, and nominate and appoint John Buchannan of Craigievairn to be chamberlain for uplifting the above stipend of the said kirk for the said last half of the crop 1690, and whole crop 1691. And ordain the said factor or chamberlain to be readily answered, obeyed, and paid thereof by the heritors, feuers, and others liable in payment of the same. And ordain letters of horning at his instance against them for that effect, he producing a decreet of locality. And in case there be none, ordain those liable to make payment to him of their respective proportions of the said stipend for the spaces foresaid according as they shall be discerned by the judge ordinary, in respect the said factor has found sufficient caution acted in the books of privy council that he shall make payment to the said Mr James Gillespie of the one equal half of the above three half years’ stipend, and that he shall employ the other equal half thereof for repairing of the said kirk and manse and other pious uses within the said parish at the sight and by the advice foresaid.
