Act Heretors of Mortlick for stipend

Anent the petitione Given in to the Lords of there Majesties privie Counsell be the Hereters Elders and Remanent parochiners of the parochine of Mortlick within the synod of Aberdeen Shewing That whereas the Late Incumbent at the petitioners church of Mortlick wes Legallie prohibited the exercise of his ministerie on the sevent of November Jaj vjc and Eightie Nyne And Mr Robert Mitchell preacher of the gospell hath, at their desyre and with there Consent duely officiat thereat ever since the vaicancie forsaid And that your petitioners are most willing to pay the viccaradge and stipend to the said Maister Mitchell who Continowes in possession according to the act of parliament provydeing they have there Lordships warrand for the same they haveing engadged there publict faith humbly to petitione there Lordships there anent, as being no more then a competencie for his mantenance till the Church provyde them a settled minister As also the petitioners are necessitate thereunto In respect that the poisonous endeavours of the Emissaries from the adjacent highlands againest there religion and there Majestyes government are prevented by Mr Mitchells vigilance and Incumbencie amongst them whereby this being the most naturall and pious use of the vaicand stipends that occurrs at present within there pariochine And the patrons right of applyeing the vacand stipends (Formerly belonging to the Late Bishop of Aberdeen) now falling to there Majestyes And therefor Craveing that there Lordships may be pleased to Grant warrand to the petitioners for paying the viccarages and stipends to the said Mr Robert Mitchell due from the seventh of November Jaj vjc Eightie Nyne years to the date of thir presents and in tyme comeing ay and whill the Church have opportunitie of takeing further course in admitting and setleing ane minister among them As the said petitione bears The saids Lords of there Majestyes privie Counsell haveing Considered this petition Given in to them be the Heretors of Mortlick They allow to the above Mr Robert Mitchell the stipend of the said kirk of Mortlick and viccaradge thereof from the seventh day of November Jaj vjc and Eightie Nyne years for the rest of that year and for the haill years of Jaj vjc and Nyntie, and Jaj vjc Nyntie one years And ordaines him to be readily ansuered obeyed and payed of2 the said stipend and viccaradge Dureing the said space by the heretors wodsetters fewers and others Lyable in payment of the samen And ordaines Letters of horning at Mr Mitchells Instance againest them for that effect He produceing a decreet of Locality And in case there be non, ordaines these Lyable to make payment of there respective proportions of the said stipend for the forsaid space according as they shall be decerned be the Judge ordinarie

Act heritors of Mortlach for stipend

Concerning the petition given in to the lords of their majesties’ privy council by the heritors, elders, and remanent parishioners of the parish of Mortlach within the synod of Aberdeen, showing that whereas the late incumbent at the petitioners’ church of Mortlach was legally prohibited the exercise of his ministry on the seventh of November 1689 and Mr Robert Mitchell, preacher of the gospel, has, at their desire and with their consent, duly officiated thereat ever since the vacancy foresaid, And that your petitioners are most willing to pay the vicarage and stipend to the said Maister Mitchell who continues in possession according to the act of parliament, providing they have their lordships’ warrant for the same, they having engaged their public faith humbly to petition their lordships thereanent, as being no more than a competency for his maintenance till the Church provide them a settled minister. As also the petitioners are necessitated thereunto in respect that the poisonous endeavours of the emissaries from the adjacent Highlands against their religion and their majesties’ government are prevented by Mr Mitchell’s vigilance and incumbency amongst them, whereby this being the most natural and pious use of the vacant stipends that occur at present within their parish, and the patron’s right of applying the vacant stipends (formerly belonging to the late bishop of Aberdeen) now falling to their majesties, and therefore craving that their lordships may be pleased to Grant warrant to the petitioners for paying the vicarages and stipends to the said Mr Robert Mitchell due from the seventh of November 1689 to the date of these presents and in time coming as and while the Church have opportunity of taking further course in admitting and settling a minister among them, as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the heritors of Mortlach, they allow to the above Mr Robert Mitchell the stipend of the said kirk of Mortlach and vicarage thereof from the seventh day of November 1689 for the rest of that year and for the whole years of 1690, and 1691, and ordain him to be readily answered, obeyed and paid of the said stipend and vicarage during the said space by the heritors, wadsetters, feuers, and others liable in payment of the same. And ordain letters of horning at Mr Mitchell’s instance against them for that effect, he producing a decreet of locality. And in case there be none, ordain those liable to make payment of their respective proportions of the said stipend for the foresaid space according as they shall be decerned by the judge ordinary.
