Act The Tacksmen Against Dundas
Anent a Petition given in to the Lords of their majesties privy Councill be Sir Archibald Muri of Thornton […] Howstoune younger and John Shaw younger of Greenock tacksmen of their majesties Customes For themselves and in name of Robert Cuninghame Collector at New Port Glasgow and remanent persones conveened at the instance of Mr John Dundas before the saids Lords Shewing That quher ther being ane proces intented at the instance of Mr John Dundas against the Collector surveyer and Clerk appoynted by the petitioners at New Port Glasgow, And alse against thrie of the waitters appointed for the said port, And they haveing come in at the preceise dyet to quhich Import to the petitioners for the better ingathering of their majesties revenue, To have them returned back to the said Port Ther being in their absence few If any to attend therupon, And therfore the petitioners having meaned themselves to the Lords of thesaurie and represented that the port was Destitute of a Collector, Surveyor and Clerk and thrie waiters and that ther was nowayes to Prevent Imbazlement unles they ware allowed to returne, Which application did so farr previll with the saids Lords of the thesaurie, That the petitioner Concerned themselves warranted by them to dismiss the persones conveened at Mr Dundas instance In Respect the petitioners ware content to subject them selves to the hazard of the decision; and owned all that the saids defenders hade done, to have been in prosecution of their orders, Bot Mr Dundas knowing that the calling of his Sumonds, And therupon the certification of the letters was granted against the defenders as absents But it was hoped the saids Lords would be pleased to stop the extracting and effect of the Certificatione till Tuesday nixt betwixt and which tyme they should all be produced before the saids Lords at least the Collector and two of the waitters It being Impossible for them all to be from the port togither without extraordinary Loss to the petitioners, And these presents shall oun the facts Lybelled as farr as true, and subject themselves to what punishment if after debating of the Relevancy It ware found that any thing Should be inflicted And Therfore Humbly Craveing the Saids Lords would Discharge the extracting any certification against the said Robert Cuninghame and remnant Persones Conveened untill The said Robert Cuninghame Collector Robert Noble and […] Turner waitters should be Presented and the other persones at any det the saids Lord should think fitt to answer to the Complaint and underlye the Law as the said petition bears The Lords of their Majesties privy Councill Haveing Considered this petition given in to them be the above tacksmen, Collectors and others They heirby superceed the extracting of the certificatione pronunced be them at the instance of the above Mr John Dundas against the above Collector Surveyer Clerk, and waitters untill Tuesday nixt being the twelth of Jully instant inclusive And allowes2 John Kelso serveyar Robert Mcneill and Robert Noble waitter to Compeir before the Lords that day in name of the wholl and Dispenses with the non Compeirance of the rest of the defenders.
