Act Heretors of Insch and Leswalt for stipend

Anent the petitione Given in to the Lords of there Majestyes privie Counsel be William Mcdowall of Garthland and James Agnew of Lochnaw for themselves and in name and behalf of the other Heretors of the paroches of Insch and Lesswalt in the Shyre of Galloway Shewing That where the Kirks and Manses of the saids paroches being for some years waste are become ruinous As also the saids paroches are extreamly dispeopled by the Considerable Number of familyes which have transported themselves and there effects to Ireland Whereby the heretors have Lost and doe dayly sustain great prejudice which is notourly knoune through out that countrie And in particular to some of there Lordships Number And sieing there is a year and ane halfes vacant stipend at the saids Lords there disposeall there Majesties being patrones viz The half of the year Jaj vjc and Eightie nyne And the wholl year Jaj vjc and Nyntie Resting by the saids heretors And that the same will be bot sufficient for repairing the saids ruinous kirks and Manses And that they have sustained great damnadge by the desertion of there tennents as said as And craveing to the effect underwreitten As the said petitione bears The saids Lords of there Majestyes privie Counsell haveing Considered this petition Given in to them be the above William Mcdowall of Garthland and James Agnew of Lochnaw for themselves and in name and behalf of the other heretors of the saids paroches of Insch and Leswalt They allow the petitioners the stipends of both the saids Kirks of Insch and Leswalt for the Last half of the cropt and year Jaj vjc and Eightie Nyne and for the haill year Jaj vjc and Nyntie years for repairing of the Ruinous kirks and manses thereof And nominates and Appoints Alexander Boyd appearand of Pinkell to be factor for uplifting of the said stipends And ordaines him to be readiely ansuered obeyed and payed thereof be the heretors Lyfrenters fermers titulars tacksmen of teynds tennents possessors and others Lyable in payment of the said stipends And ordaines Letters of horning to be direct at the said factors instance againest them for that effect upon production of decreets of Locality And in case there be none ordaines these Lyable to make payment of there respective proportiones thereof According as the samen shall be decerned be the Judge ordinarie In respect the said facftor hath found sufficient Cautione acted in the books of privie Counsell That he shall Imploy the said year and half years stipend of each of the said kirks of Insch and Leswalt towards the reparation of the respective kirks and manses thereof

Act heritors of Insch and Leswalt for stipend

Concerning the petition given in to the lords of their majesties privy council by William MacDowall of Garthland and James Agnew of Lochnaw for themselves and in name and on behalf of the other heritors of the parishes of Insch and Leswalt in the shire of Galloway, showing that where the kirks and manses of the said parishes being for some years waste are become ruinous, as also the said parishes are extremely depopulated by the considerable number of families which have transported themselves and their effects to Ireland, whereby the heritors have lost and do daily sustain great prejudice which is notoriously known throughout that country, and in particular to some of their lordships’ number, and seeing there is a year and a half’s vacant stipend at the said lords their disposal, their majesties being patrons viz the half of the year 1689 And the whole year 1690 resting by the said heritors, and that the same will be but sufficient for repairing the said ruinous kirks and manses, and that they have sustained great damage by the desertion of their tenants as said as, and craving to the effect underwritten as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above William MacDowal of Garthland and James Agnew of Lochnaw for themselves and in name and [on] behalf of the other heritors of the said parishes of Insch and Leswalt, they allow the petitioners the stipends of both the said kirks of Insch and Leswalt for the last half of the crop and year 1689 and for the whole year 1690 for repairing of the ruinous kirks and manses thereof, and nominate and appoint Alexander Boyd, apparent of Pinkell to be factor for uplifting of the said stipends, and ordain him to be readily answered, obeyed, and paid thereof by the heritors, liferenters, fermers, titulars, tacksmen of teinds, tenants, possessors, and others liable in payment of the said stipends, and ordain letters of horning to be directed at the said factor’s instance against them for that effect upon production of decreets of locality. And in case there be none, ordain those liable to make payment of their respective proportions thereof according as the same shall be discerned be the judge ordinary, in respect the said factor has found sufficient caution acted in the books of privy council that he shall employ the said year and half year’s stipend of each of the said kirks of Insch and Leswalt towards the repair of the respective kirks and manses thereof.
