Act William Pattoun of Panholls for stipend

Anent the petitione Given in to the Lords of there Majestyes privie Counsell be William Pattoun of Panholls Shewing That where the stipend of the kirk of Tilliecultrie of the year Jaj vjc and nyntie one have vaicked by the dimission at michaelmess Jaj vjc nyntie of Mr Alexander Keith Late Incumbent there The petitioner as patron of the said parochine be vertue of ane disposition granted to him be Sir Thomas Nicolson of Tilliecultrie air served and returned to umquhile Sir John Nicholson of Tilliecultrie who hade right thereto under there Majestyes great seall As the saids wreitts produced with the said petitione bearres Hes allocat and destinat the said years stipend for building ane bridge over the water of Dovan over against the toun and village of Colsnaughtoun which is a comon high way and passadge from the toun of pearth and haill Countrie Lyeing be west the samen To the touns of Alloway and Clackmannan There being no bridge neare to that foord be four myles east And because the said water divydes the sad pariochines of Tillicultrie So as the on half of the parochiners duell on the south syde thereof And when the water is high There is no passing the same without great hazard of Lyves And therefore Craveing to the effect under wreatten as the said petition bears The saids Lords of there majesties privie Counsell having considered this petitione Given in to them be the above William Pattoun with the wreitts mentioned therein and produced therewith They Approve of the petitioners desinatione of the stipend of the said kirk of Tillicultrie for the Copt and year of God Jaj vjc Nyntie and one for the ends and uses abovementioned And Nominats and Appoints James Gibb Nottar publict at Dollar to be factor for uplifting thereof, And ordaines the said factor to be readiely ansuered obeyed and payed thereof be the heretors fewers wodsetters and others Lyable in payment of the samen for the said year Jaj vjc Nyntie one years and ordaines Letters of horning at his instance againest them for that effect He produceing a decreet of Locality and in case there be none ordaines these Lyable, To make payment of there respective proportiones of the said years stipend according as they shall be decerned be the Judge ordinarie The said factor alwayes befor extracting hereof finding sufficient Cautione acted in the books of privie Counsell That he shall Imploy the forsaid stipend hereby ordained to be uplifed by him, upon the building a bridge over the said water of Dovan

Act William Patton of Panholes for stipend

Concerning the petition given in to the lords of their majesties’ privy council by William Patton of Panholes, showing that where the stipend of the kirk of Tillicoultry of the year 1691 have vacated by the demission at Michaelmas 1690 of Mr Alexander Keith, late incumbent there, the petitioner as patron of the said parish by virtue of a disposition granted to him by Sir Thomas Nicolson of Tillicoultry heir served and returned to late Sir John Nicholson of Tillicoultry who had right thereto under their majesties’ great seal as the said writs produced with the said petition bear, has allocated and destinated the said year’s stipend for building a bridge over the water of Devon over against the town and village of Coalsnaughton which is a common highway and passage from the town of Perth and whole country lying be west the same to the towns of Alloa and Clackmannan, there being no bridge near to that ford by four miles east, and because the said water divides the said parish of Tillicoultry so as the one half of the parishioners dwell on the south side thereof and when the water is high there is no passing the same without great hazard of lives, and therefore craving to the effect underwritten as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above William Pattoun with the writs mentioned therein and produced therewith, they approve of the petitioner’s destination of the stipend of the said kirk of Tillicoultry for the crop and year of God 1691 for the ends and uses abovementioned, and nominate and appoint James Gibb, notary public at Dollar, to be factor for uplifting thereof, and ordain the said factor to be readily answered, obeyed, and paid thereof by the heritors, feuers, wadsetters, and others liable in payment of the same for the said year 1691. And ordain letters of horning at his instance against them for that effect, he producing a decreet of locality. And in case there be none, ordain those liable to make payment of their respective proportions of the said year’s stipend according as they shall be discerned by the judge ordinary, the said factor always before extracting hereof finding sufficient caution acted in the books of privy council that he shall employ the foresaid stipend hereby ordained to be uplifted by him, upon the building a bridge over the said water of Devon.
