Liberatione Captain Dobie and Captain Grahame

Anent the petitione Given in to the Lords of there Majestyes privie Counsell be Captain Robert Dobie and Captain Henrie Grahame prisoners at Dundie Shewing That where upon application made to there Lordships by Leivetennent Collonell Oliphant and Captain Leslie with others of the prisoners taken at the surrender of the Castle of Feddrett and Committed to prisone in the toun of Dundie There Lordships were pleased to set them at Libertie from there said Imprisonement at Dundie under such penaltyes for there Liveing peaceablie as they could find viz The said Leivetenent Oliphant under the pain of Fiftie pounds sterling and each one of the rest who hade borne Commission as Captaines under the pain of Fyve Hundreth merks And sieing the petitioners are in the same case being taken at Fedderett and prisoners att Dundie As ane Certificat under the Late Viscount of Frendraught his hand hes testified And that the saids petitioners are in a starveing conditione Not haveing receaved these six weeks one farthing of the small allowance allowed by the Thesarie for there subsistance And therefore Craveing That there Lordships would be pleased In consideration of the premisses and of the saids petitioners there long imprisonment for neare these tuo years bypast To Appoint the petitioners to be sett at Libertie upon there finding Cautione to Live peaceably under the Lyke penalty as Captain Leslie which is the outmost they will be able to find or otherwayes to Grant them passes to goe off the countrey with the first occasione As there Lordships hath done to others in the Lyke Cases And in the mean tyme to Appoint the small aliment allowed to the petitioners for there subsistance to be payed to them As the said petitione bears The saids Lords of there Majestyes privie Counsell haveing considered this petition Given in to them be the above Captain Dobie and Captain Graeme with the testificat produced therewith They hereby Give order and warrand to the Magistrats of Dundie and keeper of the tolbooth thereof To sett the petitioners at Liberty forth of the samen In respect they have found sufficient Cautione acted in the books of privie Counsell That they shall Live peaceablie and with all submissione to the present government under there majestyes King William and Queen Mary And that they shall not act insult or contryve any thing in prejudice thereof nor Converse or Corespond with rebells And that they shall appear befor the Lords of there Majestyes privie Counsell when called for, each of them under the penalty of Fyve Hundreth merks Scotts If they transgress in any part of the premisses And in case the forsaid petitioners be under guairds Ordaines the Commanding officers under whose guards they are to sett them at Libertie In maner forsaid

Liberation Captain Dobie and Captain Grahame

Concerning the petition given in to the lords of their majesties privy council by Captain Robert Dobie and Captain Henrie Grahame prisoners at Dundee, showing that where upon application made to their lordships by Lieutenant Colonel Oliphant and Captain Leslie with others of the prisoners taken at the surrender of the Castle of Fedderate and committed to prison in the town of Dundee their lordships were pleased to set them at liberty from their said imprisonment at Dundee under such penalties for their living peaceably as they could find viz the said Lieutenant Oliphant under the pain of fifty pounds Sterling and each one of the rest who had borne commission as captains under the pain of five hundred merks. And seeing the petitioners are in the same case being taken at Fedderate and prisoners at Dundee as a certificate under the late [Lewis Crichton] viscount of Frendraught his hand has testified and that the said petitioners are in a starving condition not having received these six weeks one farthing of the small allowance allowed by the treasury for their subsistence and therefore craving that their lordships would be pleased in consideration of the premises and of the said petitioners their long imprisonment for near these two years bypast to appoint the petitioners to be set at liberty upon their finding caution to live peaceably under the like penalty as Captain Leslie, which is the outmost they will be able to find, or otherwise to grant them passes to go off the country with the first occasion as their lordships have done to others in the like cases, and in the meantime to appoint the small aliment allowed to the petitioners for there subsistence to be paid to them as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them be the above Captain Dobie and Captain Graeme with the testificat produced therewith they hereby give order and warrant to the magistrates of Dundee and keeper of the tolbooth thereof to set the petitioners at liberty forth of the same in respect they have found sufficient caution acted in the books of privy council that they shall live peaceably and with all submission to the present government under their majesties King William and Queen Mary, and that they shall not act, insult or contrive anything in prejudice thereof, nor converse or correspond with rebels, and that they shall appear before the lords of their majesties’ privy council when called for, each of them under the penalty of five hundred merks Scots if they transgress in any part of the premises. And in case the foresaid petitioners be under guard, ordain the commanding officers under whose guards they are to set them at liberty in manner foresaid.
