Act Heretors of Dumblaine for stipend

Anent the petitione Given in to the Lords of there majestyes privie Counsell be Sir Coline Campbell of Aberuchill one of the Senators of the Colledge of Justice And of the saids Lords of privie Counsell there number And some others of the heretors Elders and pariochiners of Dumblane Shewing That where the said paroch being vacant since Junij Jaj vjc and Eightie Nyne years by the deprivation of Mr Gasper Kellie late dean of Dumblaine by the saids Lords of there Majestyes privie Counsell for his contempt and disobedience to the present government And no other minister as yet is placed there, off which church of Dumblane there Majesties are patrones And the one half of the stipend of the year Jaj vjc Eightie Nyne being uplifted by the said Mr Gasper Kellie, And the other half of the said year being given to Mr Alexander Douglas minister at Logie And the stipend of the year Jaj vjc and Nyntie with the stipend of the paroch of Scone being given to Mr Alexander Pitcairne proveis[t] of the soume of Ane Hundreth pound Sterling Conforme to there Majesties Letter all which are uplifted So that there is none resting but the Cropt and year Jaj vjc and Nyntie one And the said church haveing been ane Cathedrall and of ane Large fabrick and great Lights For upholding whereof the Late Bishops since the year Jaj vjc and Sixtie one years did not bestow ane six pense But the heretors were necessitat besydes many great and Long carriadges of materialls to stint themselves in Ane Hundreth poound sterling to repair the samen And that besydes alse much to repair the manse And yet Notwithstanding the said church is extreamly damnifyed both in the roof and walls but more especially in the glass windowes And sieing that the stipends of vacant churches are to be Imployed upon pious uses particularly by the fyfth act parliament first King Charles the Second And the Eighteint act parliament Jaj vjc and Eightie fyve where the reparatione of Churches and manses are exprest among the pious uses Likeas the said Church being ane Cathedrall as said is And that pairt thereof which is now made use of being the Quire wes alwayes upholden and repaired by the Bishops befor the year Jaj vjc threttie Eight And when Episcopacie wes then abolished There wes amongst other donetions of the Bishops rents Eightie pounds Scotts allocat yearly by the late King Charles the first for repairing the fabrick of the Church And there Majestyes now succeding in place of the Bishops There Can be nothing more reasonable and Just Then that the fabrick of the Church should be repaired out of the rents of the Bishoprick But in the mean tyme The petitioners should be willing to accept of the said vacant stipend for the years Jaj vjc Nyntie which is about Eleaven Hundreth merks with what superplus is Intromitted with by the said Mr Alexander Pitcairne more then payes the said Hundreth pound Sterling out of the stipend of Dumblane and Scoon And to Imploy the same so farr as it will goe towards the reparation of the said Church And therefore Craveing to the effect underwreitten As the said petitione bears The saids Lords of ther Majesties privie Counsell haveing Considered this petition Given in to them be the above Lord Aberuchill and others heretors elders and parochiners of Dumblaine They allow the petitioners the stypend of the said kirk of Dumblaine for the haill cropt and year Jaj vjc Nyntie one for repairing the said kirk of Dumblaine And Nominates and appoints James Campbell of Keirienoch To be factor for uplifting of the said years stipend And ordaines him to be readiely ansuered obeyed and payed thereof be the heretors Lyfrenters fermers titulars tacksmen of teynds tennents possessors and others Lyable in payment of the samen And ordaines Letters of horning to be direct at his instance againest them for that effect upon production of a decreet of Locality And in case there be non ordaines these Lyable to make payment of there respective proprotiones according as the samen shall be decerned be the Judge ordinarie In respect the said factor hes found sufficient Cautione acted in the books of privie Counsell That he shall Imploy the said stipend towards the reparation of the said church of Dumblaine

Act heritors of Dunblane for stipend

Concerning the petition given in to the lords of their majesties’ privy council by Sir Colin Campbell of Aberuchill, one of the senators of the college of justice and of the said lords of privy council their number, and some others of the heritors, elders, and parishioners of Dunblane, showing that where the said parish being vacant since June 1689 by the deprivation of Mr Gasper Kellie, late dean of Dunblane by the said lords of their majesties’ privy council for his contempt and disobedience to the present government, and no other minister as yet is placed there, of which church of Dunblane their majesties are patrons, and the one half of the stipend of the year 1689 being uplifted by the said Mr Gasper Kellie, and the other half of the said year being given to Mr Alexander Douglas, minister at Logie, and the stipend of the year 1690 with the stipend of the parish of Scone being given to Mr Alexander Pitcairne, provost, of the sum of one hundred pound Sterling, conform to their majesties’ letter, all which are uplifted so that there is none resting but the crop and 1691, and the said church having been a cathedral and of a large fabric and great lights, for upholding whereof the late bishops since the year 1661 did not bestow a sixpence, but the heritors were necessitated besides many great and long carriages of materials to stent themselves in a hundred pounds Sterling to repair the same, and that besides as much to repair the manse. And yet notwithstanding, the said church is extremely damnified both in the roof and walls, but more especially in the glass windows, and seeing that the stipends of vacant churches are to be employed upon pious uses, particularly by the fifth act parliament first King Charles II And the eighteenth act parliament 1685 where the repair of churches and manses are expressed among the pious uses, like as the said church being a cathedral as said is, and that part thereof which is now made use of being the choir was always upheld and repaired by the bishops before the year 1638, and when episcopacy was then abolished there was amongst other donations of the bishop’s rents eighty pounds Scots allocated yearly by the late King Charles I for repairing the fabric of the church, and their majesties now succeeding in place of the bishops there can be nothing more reasonable and just that that the fabric of the church should be repaired out of the rents of the bishopric, but in the meantime the petitioners should be willing to accept of the said vacant stipend for the years 1690 which is about eleven hundred merks with what surplus is intromitted with by the said Mr Alexander Pitcairne more than pays the said hundred pounds Sterling out of the stipend of Dunblane and Scone, and to employ the same so far as it will go towards the repair of the said church, and therefore craving to the effect underwritten as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them be the above Lord Aberuchill and others heritors, elders, and parishioners of Dunblane, they allow the petitioners the stipend of the said kirk of Dunblane for the whole crop and year 1691 for repairing the said kirk of Dunblane, and nominate and appoint James Campbell of Keirienoch to be factor for uplifting of the said year’s stipend, and ordain him to be readily answered, obeyed and paid thereof by the heritors, liferenters, fermers, titulars, tacksmen of teinds, tenants, possessors, and others liable in payment of the same. And ordain letters of horning to be directed at his instance against them for that effect upon production of a decreet of locality. And in case there be none, ordain those liable to make payment of their respective proportions according as the same shall be discerned by the judge ordinary, in respect the said factor has found sufficient caution acted in the books of privy council that he shall employ the said stipend towards the repair of the said church of Dunblane.
