Act Heretors of Mochrum for stipend

Anent the petitione Given in to the Lords of there Majestyes privie Counsell be James Dunbar of Mochrum for himself and in name of the others heretors of the parochine of Mochrum Sheweth That where the said Kirk and the Manse being for some years waiste The same are become Ruinous As also the paroch extreamly dispeopled by the Considerable number of familyes which heave transported themselves and there effects to the Kingdome of Ireland Whereby the heretors have Lost and dayly sustain great prejudices And sieing there is ane years vacant stipend viz for the year Jaj vjc and Nyntie one due by the saids heretors And that they have otherwayes verie great dammadge by the forsaid desertione of their tennents And that the said years stipend will not be sufficient to repair the said Ruinous manse and Church And therefor Craveing to the effect underwreitten As the said petition bears The saids Lords of there Majestyes privie Counsell having Considered this petition Given in to them be the above James Dunbar of Mochrum with ane other petition Given in to them be Mr Henry Walker minister at Mochrum They Refuse the desyre of Mr Walkers petition And allowes the said Laird of Mochrum and other heretors of the said paroch the stipend of the said kirk of Mochrum for the haill year Jaj vjc and Nyntie one for repairing the kirk and Manse thereof And Nominates and appoints the said James Dunbar of Mochrum to be factor for uplifting the said years stipend And ordaines to be readiely ansuered obeyed and payed thereof be the heretors Lyfrenters fewers titulars tacksmen of teynds tennents possessors and others Lyable in payment of the samen And ordaines Letters of horning to be direct at his instance againest them for that effect upon production of a decreeet of Locality And in case there be non ordaines these Lyable To make payment of there respective proportiones According as the samen shall be decerned be the Judge ordinarie In respect the said factor hes found sufficient Caution acted in the books of privie Counsell That he shall Imploy the said stipend for Repairing the kirk and manse of Mochrum

Act heritors of Mochrum for stipend

Concerning the petition given in to the lords of their majesties’ privy council by James Dunbar of Mochrum for himself and in name of the other heritors of the parish of Mochrum, showing that where the said kirk and the manse being for some years waste, the same have become ruinous, as also the parish extremely depopulated by the considerable number of families which have transported themselves and their effects to the kingdom of Ireland, whereby the heritors have lost and daily sustain great prejudices, and seeing there is a year’s vacant stipend viz for the year 1691 due by the said heritors and that they have otherwise very great damage by the foresaid desertion of their tenants and that the said year’s stipend will not be sufficient to repair the said ruinous manse and church and therefore craving to the effect underwritten as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above James Dunbar of Mochrum with another petition given in to them by Mr Henry Walker, minister at Mochrum, they refuse the desire of Mr Walker’s petition and allow the said laird of Mochrum and other heritors of the said parish the stipend of the said kirk of Mochrum for the whole year 1691 for repairing the kirk and manse thereof, and nominate and appoint the said James Dunbar of Mochrum to be factor for uplifting the said year’s stipend and ordain [him] to be readily answered, obeyed, and paid thereof by the heritors, liferenter, feuers, titulars, tacksmen of teinds, tenants, possessors, and others liable in payment of the same. And ordain letters of horning to be directed at his instance against them for that effect upon production of a decreet of locality. And in case there be none, ordain those liable to make payment of their respective proportions according as the same shall be discerned by the judge ordinary, in respect the said factor has found sufficient caution acted in the books of privy council that he shall employ the said stipend for repairing the kirk and manse of Mochrum.
