Act Heretors of Duning for stipend

Anent the petition Given in to the Lords of there Majestyes privie Counsell be the Heretors and Minister of the pariochine of Duning Shewing That whereas the stipend of Duning hes been now vacant throw the deprivation of Mr David Freebairne Late Incumbent for the Last half of the yeare and Cropt Jaj vjc and Eighty Nyne the wholl year Jaj vjc and Nyntie And the first half of the year Jaj vjc and Nyntie one And that the Lawes of this kingdome appoints vacant stipends to be Imployed upon pious uses within the paroch And there being many such uses uithin the said paroch, The roof of the Kirk to be repaired, The ministers manse, the schooll and severall bridges to be built and repaired for transporting of people to the Kirk And also that there Minister hes supplyed there said paroch with preaching for the most pairt since the moneth of July And would have been admitted before Michaellmess If it hade not been unjustly and Irregularly stopted by a tumultuarie rable As a Certificat signed by the Moderator and Clerk of the presbitrie of Pearth produced with the said petition bears whereby he would have hade undoubted Legall right to the Last half of the stipend for the cropt and year of God Jaj vjc and Nyntie one years And there for Craveing to the effect eftermentioned As the said petition bears The saids Lords of there Majestyes privie Counsell haveing Considered this petitione Given in to them be the above heretors and Minister of the paroch of Doning They hereby allow to the heretors the stipend of the Kirk of Doning for the Last half of the Cropt and year of God Jaj vjc and Eightie Nyne the haill cropt and year of God Jaj vjc and Nyntie yeirs and first half of the Cropt Jaj vjc and Nyntie one for repairing the kirk and Manse of the said paroch and for building and repairing of severall bridges within the samen and for repairing the schooll And Nominates and appoints Andrew Lord Rollo to be factor for uplifting of the said stipend And ordaines him to be readiely ansuered obeyed and payed thereof be the Heretors fewers wodsetters and others Lyable in payment of the samen And ordaines Letters of horning at the said factors Instance againest them for that effect upon production of a decrieet of Locality And in case there be none ordaines these Lyable To make paymenet of there respective proportiones of the said stipend according as they shall be decerned be the Judge ordinarie The said factor alwayes befor extracting hereof Finding sufficient Cautione acted in the books of privie Counsell That he shall Imploy the forsaid stipend upon the uses and ends above mentioned And the saids Lords allowes to Mr William Reid minister at Doning the stipend of the above kirk for the Last half of the cropt and year of Jaj vjc and Nyntie one And ordaines him to be readiely ansuered obeyed and payed thereof be the heretors fewers wodsetters and others Lyable in payment of the samen And ordaines Letters of horning at his instance for that effect He produceing a decreet of Locality And in case there be non ordaines these Lyable To make payment to the said Minister of there respective proportiones of the said half years stipend according as they shall be decerned be the Judge ordinarie And decernes the stipend of the said kirk to be payed to the said Mr William Reid yearly and termly in tyme comeing during his Incumbencie thereat be the persones and in the persones above wreitten

Act heritors of Dunning for stipend

Concerning the petition given in to the lords of their majesties’ privy council by the heritors and minister of the parish of Dunning, showing that whereas the stipend of Dunning has been now vacant through the deprivation of Mr David Freebairne, late incumbent, for the last half of the year and Crop 1689, the whole year 1690, and the first half of the year 1691, and that the laws of this kingdom appoint vacant stipends to be employed upon pious uses within the parish, and there being many such uses within the said parish, the roof of the kirk to be repaired, the minister’s manse, the school, and several bridges to be built and repaired for transporting of people to the kirk, and also that their minister has supplied their said parish with preaching for the most part since the month of July and would have been admitted before Michaelmas if it had not been unjustly and irregularly stopped by a tumultuary rabble as a certificate signed by the moderator and clerk of the presbytery of Perth produced with the said petition bears, whereby he would have hade undoubted legal right to the lst half of the stipend for the crop and year of God 1691, and therefore craving to the effect after mentioned as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above heritors and minister of the parish of Dunning, they hereby allow to the heritors the stipend of the kirk of Dunning for the last half of the crop and year of God 1689, the whole crop and year of God 1691, and first half of the crop 1691 for repairing the kirk and manse of the said parish and for building and repairing of several bridges within the same, and for repairing the school, and nominate and appoint Andrew, Lord Rollo to be factor for uplifting of the said stipend, and ordain him to be readily answered, obeyed, and paid thereof by the heritors, feuers, wadsetters, and others liable in payment of the same. And ordain letters of horning at the said factor’s instance against them for that effect upon production of a decreet of locality. And in case there be none, ordain those liable to make payment of their respective proportions of the said stipend according as they shall be decerned be the judge ordinary, the said factor always before extracting hereof finding sufficient caution acted in the books of privy council that he shall employ the foresaid stipend upon the uses and ends above mentioned. And the said lords allow to Mr William Reid, minister at Dunning the stipend of the above kirk for the last half of the crop and year of 1691, and ordain him to be readily answered, obeyed, and paid thereof by the heritors, feuers, wadsetters, and others liable in payment of the same. And ordain letters of horning at his instance for that effect, he producing a decreet of locality. And in case there be none, ordain those liable to make payment to the said minister of their respective proportions of the said half year’s stipend according as they shall be discerned be the judge ordinary. And discern the stipend of the said kirk to be paid to the said Mr William Reid yearly and termly in time coming during his incumbency thereat by the persons and in the persons above written.
