Act Mr Archibald Buchan for stipend

Anent the petition Given in to the Lords of there Majestyes privie Counsell be Mr Archibald Buchan Late minister of Spott Shewing That whereas the petitioner being presented to the Church of Spott in the year Jaj vjc and Eightie three And have served the Cure ever since that tyme untill the tuenty sixt of September Jaj vjc and Eightie Nyne years that he wes depryved by the saids Lords of ther Majestyes privie Counsell And tho he might have Claimed right to the stipends for the said year Jaj vjc and Eightie Nyne as others in Lyke Circumstances got allowed them by the saids Lords there favour yet the patrone haveing applyed to there Lordships for stopting a petition Given in be Mr James Clerk meetinghouse Minister at Dumbar for Getting the half of the stipend cropt Jaj vjc and Eightie Nyne and the wholl of stipend for cropt Jaj vjc and Nyntie2 The saids Lords were pleased to appoint the samen at sight of the patron and upon surety given by him to be applyed for certain pious uses within the paroch Conforme to the act of counsell produced with the said petition, Againest which the petitioner did not at all reclame But now the Stipend for the year Jaj vjc and Nyntie one being Lykewayes vacant And there being no presbeterian Minister placed in the Church who can pretend right thereto And both the patrone and remanent hertors being willing that the samen be given to the petitioner In regaird of his disappointment of the former year Jaj vjc and Nyntie And the straittened Conditione of his poor family As there consent produced within the said petitione hes testifyed And therefore Craveing to the effect under wreitten as the said petition bears The saids Lords of there Majesties privie Counsell haveing Considered this petition Given in to them be the above Mr Archibald Buchan with the act and Consent mentioned therein and produced therewith They hereby allow to the petitioner the stipend of the above kirk of Spott for the haill cropt and year of God Jaj vjc and Nyntie one And ordaines him to be readiely ansuered obeyed and payed thereof be the heretors fewers wodsetters Lyferenters fermorers titulars tacksmen of teynds tennents possessors and others Lyable in payment of the said stipend for the forsaid year Jaj vjc and Nyntie one And ordains Letters of horning to be direct hereon at the petitioners instance againest againest3 them for that effect He produceing a decreet of Locality and in case there be none ordaines the heretors and others forsaids Lyable in payment of the said stipend To make payment thereof to the petitioner for the said year according as they shall be decerned be the Judge ordinary

Act Mr Archibald Buchan for stipend

Concerning the petition given in to the lords of their majesties’ privy council by Mr Archibald Buchan, late minister of Spott, showing that whereas the petitioner being presented to the church of Spott in the year 1683, and have served the cure ever since that time until the twenty-sixth of September 1689 that he was deprived by the said lords of their majesties’ privy council, and though he might have claimed right to the stipends for the said year 1689 as others in like circumstances got allowed them by the said lords their favour, yet the patron having applied to their lordships for stopping a petition given in be Mr James Clerk, meeting house minister at Dunbar for getting the half of the stipend crop 1689 and the whole of stipend for crop 1690, the said lords were pleased to appoint the same at sight of the patron and upon surety given by him to be applied for certain pious uses within the parish conform to the act of council produced with the said petition, against which the petitioner did not at all reclaim, but now the stipend for the year 1691 being likewise vacant and there being no Presbyterian minister placed in the church who can pretend right thereto, and both the patron and remanent heritors being willing that the same be given to the petitioner in regard of his disappointment of the former year 1691 and the straitened condition of his poor family, as their consent produced within the said petition has testified, and therefore craving to the effect underwritten as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above Mr Archibald Buchan with the act and consent mentioned therein and produced therewith, they hereby allow to the petitioner the stipend of the above kirk of Spott for the whole crop and year of God 1691, and ordain him to be readily answered, obeyed, and paid thereof by the heritors, feuers, wadsetters, liferenters, fermerers, titulars, tacksmen of teinds, tenants, possessors, and others liable in payment of the said stipend for the foresaid year 1691. And ordain letters of horning to be directed hereon at the petitioner’s instance against them for that effect, he producing a decreet of locality. And in case there be none, ordain the heritors and others foresaid liable in payment of the said stipend to make payment thereof to the petitioner for the said year according as they shall be discerned be the judge ordinary.
