Act allowing Balbegno’s bond to be given up

Anent the petition given in to the Lords of there majestyes privie Counsell be Andrew Midletoun now of Balbegno Shewing That the petitioner being Cautioner enacted for the peaceable behaviour of Andrew Wood younger of Balbegno Is now there upon charged to appear befor the saids Lords To ansuer to what shall be Laid to his charge for the said Andrew Wood who now who now2 Lives peaceably at home And hes qualifyed himself in the termes of there majestyes Gracious Indemnity and accepted thereof by tymously takeing the oath of alleadgeance and assureance As the report made thereof with the principall depositiones for the shyre of Kincardine Lyeing in the Clerks hands hes Instructed whereupon the petitioner humbly Conceaves himself to be fully Liberate of his Cautionrie for the said Andrew Wood And therefor ought to have his bond delyvered up to him And therefore humbly craveing to the effect underwreitten as the said petitione bears The Saids Lords of there majestyes privie Councill haveing Considered this petition given in to them be the above Andrew Midletoun with the report of the Comittee anent persones under baill made to there Lordships in this matter That the Comittee scrouple to give order for delyvering up the above bond In respect that Andrew Wood the principall hes since the granting of the bond (As they are Informed) been in rebellion The saids Lords of Councill doe hereby give order and warrand to there Clerks to delyver up to the petitioner the above bond which is daitted the tuenty day of Februarij Jaj vjc nyntie one years albeit he hes been in rebellion since the granting thereof And that In reguaird the said principall who hes been in rebellione hes taken the benefite of there majestyes gracious act of Indemnity And hes sworne and signed the oath of alleadgeance in the termes thereof And that the said oath with the originall subscriptione is transmitted to the saids Clerks of privie Councill.

Act allowing Balbegno’s bond to be given up

Concerning the petition given in to the lords of their majesties’ privy council by Andrew Middleton now of Balbegno showing that the petitioner being cautioner enacted for the peaceable behaviour of Andrew Wood, younger of Balbegno, is now thereupon charged to appear before the said lords to answer to what shall be laid to his charge for the said Andrew Wood who now lives peaceably at home and has qualified himself in the terms of their majesties’ gracious indemnity and accepted thereof by timeously taking the oath of allegiance and assurance, as the report made thereof with the principal depositions for the shire of Kincardine lying in the clerk’s hands has instructed; whereupon the petitioner humbly conceives himself to be fully liberated of his cautionry for the said Andrew Wood And therefore ought to have his bond delivered up to him, and therefore humbly craving to the effect underwritten as the said petition bears. The said lords of their majesties’ privy council, having considered this petition given in to them by the above Andrew Middleton with the report of the committee concerning persons under bail made to their lordships in this matter that the committee scruple to give order for delivering up the above bond in respect that Andrew Wood the principal has, since the granting of the bond (as they are informed), been in rebellion. The said lords of council do hereby give order and warrant to their clerks to deliver up to the petitioner the above bond which is dated 20 February 1691 albeit he has been in rebellion since the granting thereof, and that in regard the said principal who has been in rebellion has taken the benefit of their majesties’ gracious act of indemnity and has sworn and signed the oath of allegiance in the terms thereof, and that the said oath with the original subscription is transmitted to the said clerks of privy council.
