Interloquitor Mr James Kirkwood Against The Magistrats of Linlithgow
The Lybell before the Lords of privy Councill at the instance of Mr James Kirkwood against the Magistrats of Linlithgow and others being this day Called And the pursuar Compeiring personally with Sir Patrick Home and Sir David Thores advocats and the haill defenders Compeiring all personally Except Walter Stewart of Pardivan James Johnstone Thomas Androw James Russell John Borbridge John Storie, James Meikle James Wauch John Currie heigine and Thomas Archibald)2 with James Stewart advocat The Lybell and answers being read in presence of the saids Lords and both parties and their advocats being fully heard The saids Lords of Privy Councill haveing Considered the Lybell and answers therto with a bill given in to to3 the Lords of Sessione by the toune of Linlithgow and deliverance theron upon the thretin day of January Jaj vjc nyntie Recommending to the Lord ordinary to hear the petitioners procurators upon the reasons of Suspensione of the toune of Linlithgowes sentance of Dismissione against the pursuar before reporting of the debate anent the same and the fornamed persones defenders who ware absent being oft tymes called and not compeiring The Saids Lords of Privy Councill Grant Certificatione against the absent defenders abovenamed, And Ordaines letters to be direct to messengers to pass to the marcat croce of […] and in their majesties names and Authoritie Denunce the Disobeyers their rebells and put ilk ane of the said absent persones to the horne And ordained their haill movable goods and geir to be escheat and inbrought to their majesties use for their contemption and disobedience, And the witneses who ware present haveing made faith at the barr The Lords ordaines the saids witnesses to be examined upon the points of the Lybell, And nominats and appoints The Lord Viscount of Tarbat The Lord Beilhaven, Lord Enstruther, The Lairds of Blackbarony and Stivenson, and Sir Patrick Murray to examine the saids witnesses, And Declaires any relevant alledgances of defences for excuseing the absent defenders and reponing them against the forsaid Certification to be pronunced and discust before the Comittie And Recomends to the Comittie to meet to morrow at nyne acloak in the forenoon.
