Decreet

Interloquitor Mr James Kirkwood Against The Magistrats of Linlithgow

The Lords of their majesties privy Councill haveing this day againe Considered the Lybell at the instance of Mr James Kirkwood Against the magistrates of Linlithgow and others with the Report of the Comittie and Depositiones of the witnesses adduced be the pursuar With a petition given in for him, And another for the magistrates toune Councill and toune of Linlithgow with the haill wrytes produced for aither partie The Lords excuses the absence of Thomas Androw John Storie John Heggine, John Ourine and Thomas Archibald In Respect they Compeired before the Comittie when the witnesses ware examined and excuses the absence of James Muckle In Respect of his Sicknes and inabilitie to travell, proven before the Comittie And of Consent of the persewers excuses the absence of James Russell and John Borbridge In Respect of the old age of the one and sicknes of the other And Repones the persones defenders forsaids against the Certificatione formerly pronunced against them in this actione And Discharges any executione to pass theron, And the saids Lords Finds the ejectione used against the pursuar after the sist Lybelled given be the Lords of Session to be a Ryot And Finds the same sufficiently verified and proven and adheres to the Certificatione formerly pronunced against Walter Stewart of Pardovan late provest James Waugh present baillie and James Johnstone late and principal Counsellor of Linlithgow thrie of the defenders and who ware absent from the begining, And are still not Compeiring And Ordaines letters of Denunciation to be direct against them Comanding messengers at armes to pass to the mercat cross of […] And in their Majesties name and authoritie duely Lawfullie and orderly Denunce the said Walter Stewart, James Wauch and James Johnstone their Majesties rebells and put them to the horne, And Ordaines all their moveabale goods and geir to be escheat and inbrought to their Majesties use for their contemptione and disobedience, And appoints the Clerks of Councill upon productione of the letters of Denunciatione and executiones therof duely registrat to give out letters of Captione against the saids thrie persones And in the mean tyme Grants Warrand to the Macers of Councill to pass seek take and apprehend the saids thrie persones and put them in sure firmance and Captivity ay and quhill they be brought before the saids Lords of Privy Councill.
