Edinburgh The Twentie one day of June Jaj vjc nyntie two years

Decreet

Interloquitor Ker of Moristoune Against Home of Coldinghame

The Lybell at the instance of Ker of Moristoune and his tutors against Home of Coldinghame etc being Called and the pursuar Compeiring be the Lord Mersingtoune Sir John Cochran of Ochaltrie and Walter Cochran of Wattersyde In Respect he himself is a Chyld with James Stewart senior and Mr Thomas Skeen advocats and the haill defenders except Elizabeth Home who is alledged to be sick Compeiring perseonally with Mr Hew Dalrymple Mr James Daes and Mr George Dickson advocats, The Lords of their majesties privy Councill Haveing Considered the said Lybell with the answers made therto for the defenders and both parties advocats being heard they admitt the Lybell to the pursuars probatione and the haill witnesses Compeiring and haveing made faith at the barr, They Ordaine them to be received, And nominats and appoints the Lairds of Blackbarrony and Leyes and Sir Patrick Murray to examine the saids witnesses, and Declares any two of them to be a quorum and appoints them to meet to morrow at ten acloak in the forenoon And Reserves all objectiones to be made against the witnesses to be proponed and Discussed before the said Comittie, And allowes the defenders to raise letters of reconventione before the Councill at their instance against the pursuars upon the grounds represented in the answers given in to this Lybell or any other relevant grounds of reconventione.
