Decreet

Interloquitor The Sollicitor and John Adair against Crightoun and Yeoman

The Lybell at the instance of there Majesties Sollicitor againest John Crightoun late prisoner in the Canongate and Alexander Yeoman of Pittencreiff his Cautioner being this day called In presence of the saids Lords of there Majesties privie Councill And Sir William Lockhart there Majesties sollicitor Compearing personally for there Majestyes interest as persewer And the said John Crightoun and Alexander Yeoman defenders being oft tymes called and not Compearing The saids Lords doe hereby declare the penaltie Ane Hundreth pound Sterling Contained in the bond Lybelled on to be forfaulted and Incurred And Grants Certificatione Againest the said John Crightoun And ordaines Letters of denunceatione to be direct againest him Comanding messengers at armes to pass to the mercat cross of […] And there in there majestyes name and authority To duely Lawfully and orderly denunce the said John Crightoun there majesties rebell and putt him to there Highness horne And ordaine all his moveable goods and gear to be escheit and Inbrought to there majestyes use for his Contemptione and dissobedience and thereafter to use the haill remanent order prescryved by act of parliament And decerns and ordaines the said John Crightoun and Alexander Yeoman principal and Cautioner forsaid Conjunctly and severally To make payment and satisfactione to John Adair Geographer of the said soume of Ane Hundreth pound sterling as the penalty contained in the forsaid bond To be Imployed be him for expeding the Hydrographicall and Geographicall mapps as appointed be the act of parliament made in his favours He alwayes being comptable to the Lords of privie Councill Conforme to the said act. And declares thir presents to be ane sufficient right and full assignatione In favours of the said John Adair To the said soume of Ane Hundreth pound Sterling of penaltie incurred as said is And his discharge to be a sufficient exousatione2 of the samen to all concerned And ordaines Letters of horning on six dayes and all other executione neadfull to pass at his instance hereupon In forme as effeirs.

The libel at the instance of their majesties’ solicitor against John Crichton, late prisoner in the Canongate, and Alexander Yeoman of Pittencreiff, his cautioner, being this day called in presence of the said lords of their majesties’ privy council and Sir William Lockhart, their majesties’ solicitor, compearing personally for their majesties’ interest as pursuer, and the said John Crichton and Alexander Yeoman, defenders, being often called and not compearing, the said lords do hereby declare the penalty [of] one hundred pound Sterling contained in the bond libelled on to be forfeited and incurred, and grant certification against the said John Crichton. And ordain letters of denunciation to be directed against him, commanding messengers at arms to pass to the mercat cross of […] and there in their majesties’ name and authority to duly, lawfully, and orderly denounce the said John Crichton their majesties’ rebel, and putt him to their highnesses’ horn. And ordain all his moveable goods and gear to be escheat and inbrought to their majesties’ use for his contempt and disobedience, and thereafter to use the whole remnant order prescribed by act of parliament. And discern and ordain the said John Crichton and Alexander Yeoman, principal and cautioner foresaid, conjunctly and severally, to make payment and satisfaction to John Adair, geographer, of the said sum of one hundred pounds Sterling as the penalty contained in the foresaid bond, to be employed by him for expediting the hydrographical and geographical maps as appointed be the act of parliament made in his favour, he always being accountable to the lords of privy council conform to the said act. And declare these presents to be a sufficient right and full assignation in favour of the said John Adair of the said sum of one hundred pounds Sterling of penalty incurred as said is, and his discharge to be a sufficient excuse of the same to all concerned. And ordain letters of horning on six days and all other execution necessary to pass at his instance hereupon in form as appropriate.
