Decreet

Interloquitor and warrand for Imprisoneing some heretors in Midlothian

The Lords of there majestyes privie Councill haveing Called befor them the persones following heretors within the shyre of Midlouthian for the reasones Contained in the Letters raised at there majestyes sollicitors instance againest them viz Sir James Fleming of Rathobyres […] Scott of Bavilaw James Watson of Saughtoun […] Buntein of Selmes […] Borthwick of Falahill James Oswald of Spittell and Mr James Lowis of Merchistoun and haveing offered to them the oath of alleadgeance and assureance And requyred them to Swear and signe the same They refused so to doe And therefore The saids Lords ordaines the said Sir James Fleming and […] Scott of Bavilaw to enter themselves prisoners within the tolbooth of Mussleburgh And the said Mr James Lowis of Merchistoun to enter himself prisoner within the tolbooth of Dalkeith each of them within the space of Twenty four houres and ordaines the saids James Watsone of Sauchtoun Borthwick of Falahill […] Buntein of Selmes and James Oswald of Spittell to enter themselves prisoners within the tolbooth of the Canongate once this night And gives order and warrand to the magistrats of the respective burghes and tounes forsaids and keepers of there tolboothes to receave and detain the forsaids persones prisoners therein till further order And Sir William Bining of Waleyfoord haveing also Compeared and sworne and signed the oath of alleadgeance to there majestyes But refused to signe the assureance And it haveing gone to a vote whether he should be presently Imprisoned or delayed It wes Carryed delayed And that who ever being requyred to take the oath of alleadgeance and signe the assureance should swear and signe the oath of alleadgeance albeit he refuse the assureance Yet he shall be delayed and not Comitted to prisone presently And Sir William wes accordingly dismissed at this tyme

The lords of their majesties’ privy council having called before them the persons following heritors within the shire of Midlothian for the reasons contained in the letters raised at their majesties’ solicitors instance against them, namely Sir James Fleming of Rathobyres […], Scott of Bavelaw, James Watson of Saughton, […] Buntein of Selmes, […] Borthwick of Falahill, James Oswald of Spittal, and Mr James Lewis of Merchiston and having offered to them the oath of allegiance and assurance and required them to swear and sign the same they refused so to do and therefore the said lords ordain the said Sir James Fleming and […] Scott of Bavelaw to enter themselves prisoners within the tolbooth of Musselburgh, and the said Mr James Lewis of Merchiston to enter himself prisoner within the tolbooth of Dalkeith, each of them within the space of twenty four hours, and ordains the said James Watson of Sauchton, Borthwick of Falahill, […] Buntein of Selmes and James Oswald of Spittal to enter themselves prisoners within the tolbooth of the Canongate at once this night, and gives order and warrant to the magistrates of the respective burghs and towns forsaid and keepers of their tolbooths to receive and detain the forsaid persons prisoners therein till further order, and Sir William Binning of Wallyford having also compeared and sworn and signed the oath of allegiance to their majesties but refused to sign the assurance and it having gone to a vote whether he should be presently imprisoned or delayed, it was carried delayed, and that whoever being required to take the oath of allegiance and sign the assurance should swear and sign the oath of allegiance albeit he refuse the assurance, yet he shall be delayed and not committed to prison presently, and Sir William was accordingly dismissed at this time.
