Remitt Hay against Cuninghame and others

The Lybell at the instance of James Hay factor to the estate of Robertland Against David Cuninghame Donald Monro and others being this day called in presence of the saids Lords of their majesties privy Councill And the pursuar Compeiring personally with Mr Heugh Dalrymple and Mr David Cunninghame his advocats And David Cuninghame of Robertland James Pinkertoune and Robert Howstoune thrie of the defenders Compeiring also personally, And the rest of the defenders viz Donald Monro George Todd Adam Baird, William Gowdie and George Shaw being cited oft tymes called and not Compeiring The saids Lords of privy Councill Grants Certificatione against the saids absent defenders And Ordaines letters of Denunciation to be direct against them In Respect of their absence and not comparance Commanding messengers at armes To pass to the marcat cross of […] and Other places needfull, And their in their majesties name and authoritie Lawfully duely and orderly denunce the saids five defenders their majesties rebells and put them to their highnes horne escheat and inbring all their moveable goods and geir for their contemption and Disobedience, And James Calderwood in Causlap, Androw Neilsone in Foulshaw William Surgeon Gardner at Robertland Heugh Hunter appothecary in Killmarnock and David Mcclaine of Holmes five of the witnesses cited haveing Compeired and made faith at the barr And John Dukie nottar in Kilmarnock George Baird nottar in Riccartoune and William Haries their thrie of the witnesses cited haveing faillied To Compeir the saids Lords Ordaines letters of Caption to be direct against the saids witnesses cited and not Compeiring And nominats and Appoints the Lairds of Grant Blackbarrony and Stivensone or any two of them to be a Comittie for examining the witnesses Compeiring and makeing faith as said is, And Reserves any objectiones which may be made against saids witnesses to be proponed and discussed before the Committie to meett the morow at ten in the forenoon.
