Sist execution Smart against Simervell and Mrs Hay
The Lords of his majesties Privy Councill haveing Considered a Petitione given in to them be Mr William Smart minister at Ecclesmachan Craveing the saids Lords to recall any acts that hade post by misinformatione to the prejudice of his Just right)2 In favors of Mr William Simervall and Jean Brown and to grant warrand to the petitioner to uplift the stipend of the year Jaj vjc Eightie nyne, and nyntie, seing he hade served intirely for the one and his patrones consent for both which was Requyred by law for the other, And in order to the reversing of the acts in their favors to reveiw the narative of Jean Browns first petitione and Mr Simervells answeres and to Compeir them with this Petition and if any dificulty remained to hear the parties in their oun presence, and that in the mean tyme suspensione might be granted at the instance of the heritors and others Lyable in payment The Saids Lords heirby sist all executione upon the above acts in favors of Mr William Hay for the above stipend untill the first Councill day of June nixt inclusive And in the mean tyme allowed Mr Simervell and Mrs Hay to see and ansuer the said Petition.
