Order anent a danish ship seized in the road of Leith by ane English man of warr

The Lords of there Majestyes privie Councill being Informed that Captain Anthony Roope Captain of the Sheirness one of there Majestyes men of warr hath seized upon a ship belonging to Hans Jesperze, subject to the King of Denmark Called the Emanuell of Flenbergh Loaden with wyne brandie, wreitting paper and prunes the tyme she wes in the road of Leith And the saids Lords Considering that it is againest the rights and priviledges of this Kingdome for the subjects of any other Kingdome or Commanders of ships belonging thereto to seiz, upon any ships within the Loches or rivers of this kingdome and carry the same away as pryze without Legall tryall and adjudgeing the same as such befor the high court of admirality thereoff Therfore the saids Lords requyre and Comand the said Captain Roope to delyver back the said danish ship to the said Hans Jasperze and putt him and his Company in the peaceable pessesione of the same and Loadneing thereof to be by him brought to the harbor of Leith and delyvered to the water bailzie there who is to defame the said ship and Loadneing as and whill sufficient Cautione be found in the books off privie Councill for ansuering and obeying any process and sentence to be Intented and pronunced in the said matter befor the high Court of admirality of this Kingdome For all which this shall be a sufficient warrand

Order concerning a Danish ship seized in the road of Leith by an English man of war

The lords of their majesties’ privy council being informed that Captain Anthony Roope, captain of the Sheerness one of their majesties’ men of war has seized upon a ship belonging to Hans Jesperze, subject to the king of Denmark, called the Emanuell of Flensburg, laden with wine, brandy, writing paper and prunes the time she was in the road of Leith, and the said lords considering that it is against the rights and privileges of this kingdom for the subjects of any other kingdom or commanders of ships belonging thereto to seize upon any ships within the lochs or rivers of this kingdom and carry the same away as prize without legal trial and adjudging the same as such before the high court of admiralty thereof, therefore the said lords require and command the said Captain Roope to deliver back the said Danish ship to the said Hans Jasperze and putt him and his company in the peaceable possession of the same and loading thereof to be by him brought to the harbour of Leith and delivered to the water baillie there who is to defame the said ship and loading as and while sufficient caution be found in the books of privy council for answering and obeying any process and sentence to be intended and pronounced in the said matter before the high court of admiralty of this kingdom for all which this shall be a sufficient warrant.
