Procedure

Particular reference to the Comittee anent Baills

The Lords of there Majestyes privie Councill doe hereby authorize and Impower the Comittee appointed for persons under baill who and there Cautioners are charged to appear being bound only for there peaceable behaviour and appearance when Called for To Give order for delyvering up to such persones as shall swear and signe the alleadgeance and signe the assureance appointed by act of parliament the bonds granted be them and there Cautioners And to cause such persones as appear And whose cautioners are Content to continow bound for them to subscrybe a declaration upon the bonds granted be them Bearing that the principalls and Cautioners continow bound by the saids bonds as if the principall hade never Compeared nor been Charged to that effect And to cause such principalls whose Cautioners are not willing to Continue bound for them, But are content to find new Cautione to give new bonds in the termes of the former subscryved by them and such Cautioners as the Comittee shall be satisfyed with And to give orders to the Clerks of Councill upon finding the said New Cautione to give up the former bonds of Cautione And to cause Imprisone such principalls as nether doe with there former Cautioners adhere to there old bonds nor offer new Cautione to the satisfaction of the Comittee.

Procedure

Particular reference to the committee for bails

The lords of their majesties’ privy council hereby authorise and empower the committee appointed for persons under bail who with their cautioners are charged to appear, being bound only for their peaceful behaviour and appearance when called for, to give order for delivering up to such persons as shall swear and sign the allegiance and sign the assurance appointed by act of parliament the bonds granted by them and their cautioners, and to make such persons as appear and whose cautioners are content to continue bound for them to subscribe a declaration upon the bonds granted by them, bearing that the principals and cautioners continue bound by the said bonds as if the principal had never appeared or been charged to that effect, and to cause such principals whose cautioners are not willing to continue bound for them, but are content to find new caution, to give new bonds in the terms of the former subscribed by them and such cautioners as the committee shall be satisfied with, and to give orders to the clerks of council upon finding the said new caution to give up the former bonds of caution and to imprison such principals as neither, with there former cautioners, adhere to their old bonds nor offer new caution to the satisfaction of the committee.
