Comittee The Sollicitour against Heretors of Midlothian

In presence of the Lords of privie Councill The Lybell or Letters at the Instance of there majestyes sollicitor againest the heretors in2 the shyre of Midlothian for not attending the Kings host and signeing the Engadgement appointed by proclamatione of Councill being this day called The saids Lords Excuses the absence of Captain James Law of Hillhousefield, William Fairlie of Burntsfield, Mr James Lowis of Merchistoun Charles Scott of Boningtoun […] Skene of Halyeards […] Hamiltoun of Falahill and Sir James Roeheid of Innerleith In respect of the severall relevant excuses proponed and sustained for those defenders And Sir James Dick of Priestfield and Sir Patrick Nisbet of Dean haveing compeared Did suear and signe the oath of alleadgeance in presence of the Councill and Patrick Porterfield of Camistoun haveing compeared and refused to take the oath of alleadgeance and assureance The saids Lords of privie Councill ordaines the Macers of Councill to carry him prisoner from the barr to the tolbooth of Edinburgh there to remaine till further order of Councill and John Scott of Malenie compearing And being requyred to take the oath of alleadgeance and assureance and haveing craved some tyme to advyse The saids Lords allows him to advyse thereon till the morrows morning And the saids Lords doe hereby nominate and appoint the Earles of Linlithgow Louthian and Leven The Lord Viscount Stair, The Lord Montgomerie Sir Thomas Burnet of Leyes and Sir William Lockhart there majestyes sollicitor to administrat the oath of alleadgeance to such of the defenders in the saids Letters as shall offer to swear and signe the said oath and appoints them to receave the same off there hands without further3 at this tyme And the saids Lords doe hereby authorize and Impower the forsaid Comittee to Comitt to prisone such of the saids defenders as being requyred to swear and signe the said oath of alleadgeance shall refuse to doe the same And4 declares any three of the above named persones to be a sufficient quorum and recomends to them to meet the morrow at ten a cloak in the forenoon

In presence of the Lords of privy council, the libel or letters at the instance of their majesties’ solicitor against the heritors in the shire of Midlothian for not attending the king’s host and signing the engagement appointed by proclamation of council being this day called, the said lords excuse the absence of Captain James Law of Hillhousefield, William Fairlie of Burntsfield, Mr James Lowis of Merchiston, Charles Scott of Bonington [John] Skene of Hallyards, [Thomas] Hamilton of Falahill and Sir James Roehead of Inverleith, in respect of the several relevant excuses proponed and sustained for those defenders, and Sir James Dick of Priestfield and Sir Patrick Nisbet of Dean having appeared, did swear and sign the oath of allegiance in presence of the council and Patrick Porterfield of Comistoun having appeared and refused to take the oath of allegiance and assurance, the said lords of privy council ordain the macers of council to carry him prisoner from the bar to the tolbooth of Edinburgh there to remain till further order of council, and John Scott of Malenie appearing and being required to take the oath of allegiance and assurance and having craved some time to advise, the said lords allow him to advise thereon till tomorrow morning, and the said lords hereby nominate and appoint the earls of Linlithgow, Lothian and Leven, the Lord Viscount Stair, the Lord Montgomerie, Sir Thomas Burnet of Leys and Sir William Lockhart their majesties’ solicitor to administer the oath of allegiance to such of the defenders in the said letters as shall offer to swear and sign the said oath, and they appoint them to receive the same off there hands without further2 at this time, and the said lords hereby authorise and empower the foresaid committee to committ to prison such of the said defenders as, being required to swear and sign the said oath of allegiance shall refuse to do the same, and they declare any three of the above-named persons to be a sufficient quorum and they recommend to them to meet tomorrow at 10 o’cloak in the forenoon.
