Proclamatione for secureing the peace in the northern shyres

A proclamation nominateing particular persones to take care of the peace in the northerne shyres and to have Comand of the heretors and Fencible men in these shyres If the Councill shall see them in such hazard aither by ane Invasione or Insurrection or that it will be neadfull to Call them out, And appointing Comissioners of Supplie to be Justices of peace in the respective shyres read votted and approven and ordered to be recorded whereof the tenor followes
William and Mary be the Grace of God King and Queen of great Brittain France and Ireland defenders of the faith To our […] macers of our privie Councill messengers at armes our shirreffs in that pairt Conjunctly and severally specially Constitute Greeting Forasmuch as wee by our proclamation of the daitt the nynth day of Maij Current with advyce of the Lords of our privie Councill Have thought fitt to requyre the heretors and Fenciblemen in the severall shyres therein mentioned under the Comand of the officers therein named or to be named In maner therein specifyed To Randezvouse upon the dayes and at the places therin sett doun for being in readines when Called for to make all vigorous defence and resistance against ane Invasione of barbarous and bloodie french and Irish papists from the Kingdome of France upon this our ancient Kingdome and Cheifly upon the South and westerne pairts thereof And it being Lykewayes our desyre and Intention to take care of the peace and tranquility of the other pairts of this kingdome altho not apprehended to be so near the danger that the same may be secure from all forraigne attempts or Intestine Commotiones And for that end It being fitt and necessar that particular persones be Nominated and appointed principallie to take care of the peace of the severall shyres underwreitten and doe everie thing requsite for suppressing and resisting any attempts from abroad or Insurrectione at home within the same And to prosecute such orders and directiones as shall be sent to them from tyme to tyme from us or our privie Councill And it being also necessar that Justices of peace be Appointed and authorized to put in executione the Lawes and acts of parliament made anent that trust and office Conforme to and in the particulars specifyed in the severall Instructiones therein contained Therefor wee with advyce of the Lords of our privie Councill Hereby nominate and appoint David Boyll of Kelburne for the shyre of Bute Andrew Lord Rollo and David Lord Ruthven for the Shyre of Pearth The viscount of Abruthness for the shyre of Kincairden The Earle of Kintoir for that divisione of the shyre of Aberdeen Contained in Comission formerly granted to him by our privie Councill And the Maister of Saltoun for the other divisione of the said shyre Ludovick Grant of Freuchie for the shyre of Innernes David Brodie of Lethen for the shyre of Nairne The viscount of Tarbat for the shyre of Cromartie The Earle of Strathmore for the shyre of Forfar The Earle of Findlater and in his absence Sir James Ogilvie of Churchhill his sone for the shyre of Banff, The Lord Strathnaver and in his absence Sir2 Robert Gordon of Emb and Adam Gordon of Dalfollie for the shyre of Sutherland, Sir George Sinclair of Clyth for the Shyre of Caithness, James Brodie of that ilk for the shyre of Elgin Robert Elphinstoun of Lapnes for the shyre and stewartry of Orknay and Zetland, And David Ross of Balnagowan for the shyre of Ross, To have the principall Command care and oversight of the peace and security of the saids respective shyres and stewartry And for doeing and performing every thing necessar and requisite for makeing ane vigerous defence againest all sudden attempts from abroad and Insurrectiones at home within the same And for that effect to Convocate Conveen and assemble what number of our well affected subjects from tyme to tyme they think fitt for the tymous and readie suppressing of any unwarrantable Convocatione assemblyes or meetings of our Leedges or others And requyre and Command the particular persones abovenamed and everie on of them within there respective bounds to secure and seize upon Conforme to the Lawes and acts of parliament made thereanent any seditious or turbulent persones there horses and armes And such as they find stirring up or fomenting any Insurrectione amongst our subjects or unwarrantable Commotion againest us and our government for disturbance of the peace thereof and any who may be accessorie thereto or Concerned therein and detain them in custodie untill they advertise our privie Councill Which they are to doe with all possible diligence and have there orders thereanent which persones particularly above named within there bounds respective abovenamed are to have the cheiff Command of the heretors and Fenciblemen within the saids respective Shyres when Called furth by us or our privie Councill to attend our host for the better defence of our ancient Kingdome Conforme to the orders to be sent by us or our privie Councill with the names of the Inferior officers to be appointed by our saids Lords for the better discharge of the said service And we considering the want of Justices of peace in the severall shyres to be a great prejudice to our subjects within the same and to the establishing and preserving the peace and tranquillity thereof in the tyme of so great danger And that it may Contribute much to our service at this tyme That Justices of peace be Named in the severall shyres above mentioned alswell as the rest of the shyres of this Kingdome Therefore we with advyce forsaid Conforme to the act of parliament3 made thereanent declare appoint and authorize the Commissioners of Supplie of the respective shyres and stewartrie forsaids who have or shall qualifie themselves according to Law to be Justices of peace in the saids severall shyres and stewartrie And with power to them to doe and performe everie thing which to the said office trust is Competent and knowen to belong by the severall Lawes and acts of parliament made thereanent and Instructiones therin set doun And Further wee with advyce forsaid requyre and Comand the saids Justices of peace within the shyres and stewartry respective abovementioned to meet and Conveen at the head burgh of the respective shyres upon advertisement from the particular persone or persones abovenamed for the particular shyres and stewartry above exprest And to concurr with and give all assistance to all and each of them within there respective bounds for secureing the peace of the saids shyres and stewartrie and resisting and suppressing all attempts that may be made againest the same or any Insurrectione or Commotion that may be excited or stirred up therein And for secureing and detaining in maner abovementioned the fomenters thereof or persones accesorie thereto And sicklyke wee requyre and Command the sherriffs of the respective shyres abovementioned stewarts of stewartryes bailzies of regalityes and4 Bailzies of bailzieries magistrates of burghes and wholl other ministers of the Law within the same to Concurr with and give all aid and assistance to the persones specially abovenamed for the shyres and stewartry particularly above sett doun in there observing the premisses and doeing and performing every thing necessar for executeing and dischargeing the trust conferred upon them hereby Our Will is Herefore And wee Charge yow Straitly and Command that Incontinent these our Letters seen, ye pass to the mercat cross of Edinburgh and to the remanent mercat crosses of the wholl heid burghes of the severall shyres and stewartrie abovenamed And there in our name and authority be open proclamatione make publicatione of the premisses that none may pretend Ignorance and ordaines these presents to be printed Given under our signet att Edinburgh Proclamation for securing the peace in the northern shires

A proclamation nominating particular persons to take care of the peace in the northern shires and to have command of the heritors and fencible men in these shires if the council shall see them in such hazard either by an invasion or insurrection or that it will be necessary to call them out, and appointing commissioners of supply to be justices of peace in the respective shires, was read, voted and approved and ordered to be recorded, whereof the tenor follows:
William and Mary by the grace of God, king and queen of great Britain, France and Ireland, defenders of the faith to our […] macers of our privy council, messengers at arms, our sheriffs in that part, jointly and severally specially constituted, greeting. Forasmuch as we by our proclamation of 9 May current with advice of the lords of our privy council have thought fit to require the heritors and fencible men in the various shires therein mentioned under the command of the officers therein named or to be named in the manner therein specified to rendezvous upon the days and at the places therein set down for being in readiness when called for to make all vigorous defence and resistance against an invasion of barbarous and bloody French and Irish Catholics from the kingdom of France upon this our ancient kingdom, and chiefly upon the south and western parts thereof, and it being likewise our desire and intention to take care of the peace and tranquillity of the other parts of this kingdom, although not apprehended to be so near the danger, that the same may be secure from all foreign attempts or internal commotions, and for that end, it being fit and necessary that particular persons are nominated and appointed principally to take care of the peace of the various shires underwritten and do everything requisite for suppressing and resisting any attempts from abroad or insurrection at home within the same and to prosecute such orders and directions as shall be sent to them from time to time from us or our privy council, and it being also necessary that justices of peace be appointed and authorised to execute the laws and acts of parliament made regarding that trust and office according to and in the particulars specified in the various instructions therein contained. Therefore we with advice of the lords of our privy council hereby nominate and appoint David Boyle of Kelburn for the shire of Bute; Andrew Lord Rollo and David Lord Ruthven for the shire of Perth; [Robert Arbuthnott], viscount of Abruthnott for the shire of Kincardine; [John Keith], earl of Kintore for that division of the shire of Aberdeen contained in commission formerly granted to him by our privy council and the [William Fraser], master of Saltoun for the other division of the said shire; Ludovic Grant of Freuchie for the shire of Inverness; David Brodie of Lethen for the shire of Nairn; [George MacKenzie], viscount Tarbat for the shire of Cromarty; [Patrick Lyon], earl of Strathmore for the shire of Forfar; [James Ogilvy], earl of Findlater and in his absence Sir James Ogilvie of Churchhill his son, for the shire of Banff; [John Gordon], Lord Strathnaver and in his absence Sir Robert Gordon of Embo and Adam Gordon of Dalfolly for the shire of Sutherland; Sir George Sinclair of Clyth for the shire of Caithness; James Brodie of that ilk for the shire of Elgin; Robert Elphinstone of Lapness for the shire and stewartry of Orkney and Shetland; and David Ross of Balnagown for the shire of Ross, to have the principal command, care and oversight of the peace and security of the said respective shires and stewartry and for doing and performing everything necessary and requisite for making a vigorous defence against all sudden attempts from abroad and insurrections at home within the same, and for that effect to call, convene and assemble what number of our well affected subjects from time to time they think fit for the timeous and ready suppressing of any unwarrantable convocations, assemblies or meetings of our lieges or others and require and command the particular persons abovenamed and every one of them within their respective bounds to secure and seize, according to the laws and acts of parliament made thereupon, any seditious or turbulent persons, their horses and arms and such as they find stirring up or fomenting any insurrection amongst our subjects or unwarrantable commotion against us and our government for disturbance of the peace thereof and any who may be accessory thereto or concerned therein and detain them in custody until they advertise our privy council, which they are to do with all possible diligence and have their relevant orders, which persons particularly above named within their respective bounds abovenamed are to have the chief command of the heritors and fencible men within the said respective shires when called out by us or our privy council to attend our host for the better defence of our ancient kingdom, according to the orders to be sent by us or our privy council with the names of the inferior officers to be appointed by our said lords for the better discharge of the said service, and we considering the want of justices of peace in the various shires to be a great prejudice to our subjects within the same and to establishing and preserving the peace and tranquillity thereof in the time of so great danger and that it may contribute much to our service at this time that justices of peace be named in the various shires above mentioned as well as the rest of the shires of this kingdom. Therefore we with advice foresaid, according to the act of parliament made regarding that, declare, appoint and authorise the commissioners of supply of the respective shires and stewartry foresaid who have or shall qualify themselves according to law to be justices of peace in the said shires and stewartry, and with power to them to do and perform everything which to the said office of trust is competent and known to belong by the various relevant laws and acts of parliament and instructions therein set down. And further, we with advice foresaid, require and command the said justices of peace within the shires and stewartry respective abovementioned to meet and convene at the head burgh of the respective shires upon advertisement from the particular person or persons abovenamed for the particular shires and stewartry above expressed and to concur with and give all assistance to all and each of them within their respective bounds for securing the peace of the said shires and stewartry and resisting and suppressing all attempts that may be made against the same or any insurrection or commotion that may be excited or stirred up therein and for securing and detaining in manner abovementioned the fomenters thereof or persons accessory thereto, and similarly we require and command the sheriffs of the respective shires abovementioned, stewarts of stewartries, bailies of regalities and bailies of bailiaries, magistrates of burghs and all other ministers of the law within the same to concur with and give all aid and assistance to the persons specially abovenamed for the shires and stewartry particularly above set down in their observing the premises and doing and performing everything necessary for executing and discharging the trust conferred upon them hereby. Our will is herefore and we charge you strictly and command that immediately you see these our letters, you pass to the mercat cross of Edinburgh and to the other mercat crosses of all the head burghs of the various shires and stewartry abovenamed, and there in our name and authority by open proclamation make publication of the premises that none may pretend ignorance, and we ordaine these presents to be printed.
