Warrand to the Clerks for delyvering up to the President of Session two bonds granted to her Majesties Gen: receivers be Sir William Bining and his Cautioners and Sir Thomas Kenedy and his Cautioners, with ther presidents oun recept therfore on the said therof

The Lords of her Majesties privy Councill Doe hereby Give order and warrand to their Clerks to delyver up two bonds Viz one granted by Sir William Binning of Walifoord as principall and Charles Scot of Babilaw and James Marishall wryter in Edinburgh as Cautioners for him to George Baillie of Jerviswood his Majesties receiver and to his Successors in office for the time for the Soume of Thrie hundred pounds Sterling contained in the said bond dated at Edinburgh the Sixteinth day of March Jaj vic Nyntie Seven years; And the other bond granted by Sir Thomas Kennedy of Kirkhill principall and Robert Enstruther of Wrae as Cautioner to the said George Baillie and to his said Successors in office for the Soume of Eight Hundred pounds Sterling Contained in the said bond dated at Edinburgh the Sixteinth day of March Jaj vic nyntie Seven years To Sir Heugh Dalrymple Lord President of Session As haveing right therto by assignation granted to him by Sir Alexander Ogilvie of Forglen and Sir James Elphingstoun of Logie her Majesties new Cash keepers with Consent of the Lords of her Majesties Thesaury dated the Seventeinth day of July Jaj viic and two years And Ordaines the Clerk of Councill to gett ane recept of the Saids two bonds under any of the said Sir Heu Dalrymple his Servants their hands which is hereby Declared to be their Warrant and exoneration.

A Letter from the Queens Majestie to the Lords of her Majesties privy Councill Anent the New Levies being this day read in their presence was ordered to be Recorded and in obedience therinto The Saids Lords Doe hereby Allow the Collonells and officers of the New Levies for makeing up their Severall Complements to beat Drums and to And to take any other Method that may be effectuall (the Same being consistant with Law) And Recommends to the Lords of her Majesties thesaury to provid them when Levied with armes out of her Majesties Magazins And Recommends to and appoints Major Generall Ramsay Commander in Cheif of her Majesties forces within this kingdome to give the Necessar orders for Modelling two troops of the Viscount of Teviots Dragoons that were left into one troop to be designed in time comeing. Her Majesties Troop of Granadeer Gaurds, As also gives order and Warrant to the Said Commander in Cheif of her Majesties forces for Causeing take one Man out of each Company of Brigadeer Maitlands regiment; and to delyver them with the Armes to the Governour of the Castle of Edinburgh Her Majestie haveing thought fitt for her Service to Augment the Number of that Garison And the Councill ordaines ails to be extracted for that effect

Proclamation appointing the Oath of alledgance and assurance to be taken.

Followes the proclamation
Anne by the Grace of God Queen of Great Brittain France and Ireland defender of the faith To […] our Lovits Heraulds Macers of our privy Councill pursevants messengers at armes our Shirrifs in that part Conjunctllie and Severallie Specially Constitute Greeting Forasmuchas by act of parliament of date the twelth day of June last by past It is ordained that the oath of alledgance Specified in the said act, 2 and hereto Subjoyned be Sworne; and the Same with the assurance likewise hereafter sett doune be Subscrybed by all persones in publict trust Civill Ecclesiastick and Military who have not yet Sworne and Subscrybed the Samen to us Acording to the tenor of the Sixth act of the fourth Session of this present parliament Entituled act for takeing the Oath of alledgance and assurance, And it is Recommended to the Lords of our privy Councill to cause the said oath of alledgance and assurance be furder taken in maner forsaid at Such times and in Such maner as they shall apoint Therfore Wee with advice of the Lords of our privy Councill In prosecution of and conforme to the forsaid act of parliament, Requyre and Command the haill persones aftermentioned; Excepting electors of Members of parliament and members of the Commissiones abovementioned and these giveing voice in calling of Ministers and Such as have voice in electing of Deacones of Trades Who are hereby appointed to take the said oath and Subscrybe the Same with the assurance As followes Viz the electors of members of parliament toties quoties before they elect, members of Commissiones before they exerce Commissiones, and Such as have a voice of Calling of Ministers or electing of Deacons of trade toties quoties before they give voice in Calling of Ministers or electing of Deacons of Trades and also excepting the Conservator and the factors of the Staple ports who are to Swear the said oath and Subscrybe the Same and assurance betwixt and the first day of November nixt; and the said oath and assurance Sworne and Subscrybed as above Are to be recorded in the Registers of the respective Courts and meettings and the extracts therof under the Clerks hands to be reported to our privy Councill under the paine of deprivation of the Clerk for Such as are appointed to Swear and Subscrybe betwixt and the said first day of January nixt; and for the rest the extracts therof to be reported within twentie dayes after their Swearing And Subscribing as above; And farder wee with advice forsaid appoint all persones who shall obtaine any free gift or donation from the Lords of our privy Councill Thesaury or exchequer; or Shall present any Signatur of pension or Remission or Containeing ade novo damus or of any other Casualitie (Except gifts of Escheet) To take the said oath and assurance before obtaineing the saids gifts or passing the Said Signatur; And wee with advice forsaid Doe hereby Certifie Such of the forsaid persones as are in any publict office trust or Imployment or who Shall own or exerce the Same without takeing the said oath and assurance in maner forsaid; That they shall be deprived ipso facto of their Saids officers trusts and Imployments and all the forsaids tacksmen Shall be punished as our privy Councill Shall think fitt; And farder that they and all other persones above ranked who shall not Swear the said oath and Subscrib the Same and the assurance Shall not be allowed to keep any horses above ane hundred merks price, or any Sort of armes more then ane walking Sword; Certifieing Such as Shall be found to have horses and armes contrair to this provision either in their oun or in the keeping of others; That both the ouner and keeper Shall incurr the penaltie of One thousand merks the one half to the informer, and the other to Us; And It is also hereby Declared, That the Said oath of alledgance and assurance are in no caise to be Imposer Or Or taken Severally but Joyntly; Declareing heartily That these who refuse the one Shall be holden as refuseing both; And that conforme to the forsaid act of parliament; Our Will is Herefore and wee Charge yow Strictly and Command That incontinent these our Letters Seen yee pass to the Marcat cross of Edinburgh and to the Marcat crosses of the remanent head burghs of the severall Shyrs and Stewartries within this our ancient kingdome And their in our name and authority make intimation hereof And ordaines these presents to be printed that non may pretend Ignorance Sic Subscribitur.

I A:B: Doe in the Sincerity of my heart assert acknowledge and Declare; That her Majestie Queen Anne Is the only Lawfull and undoubted Soveraign of this realme Alse weell dejure That is of right Queen as de facto; That is in the possession and exercise of the Government; And Therfore I doe Sincerely and faithfully promise and ingadge That I will with heart and hand life and goods Mantaine and defend her Majesties title and Government against the pretended prince of Wales (now takeing upon him the title of King of this realme) and his adherents And all other enemies who either by open or Secret attempts Shall disturb or disqueit her Majestie in the possession and exercise therof.

Excepting electors of Members of parliament and members of the Commissiones abovementioned and these giveing voice in calling of Ministers and Such as have voice in electing of Deacones of Trades Who are hereby appointed to take the said oath and Subscrybe the Same with the assurance As followes Viz the electors of members of parliament toties quoties before they elect, members of Commissiones before they exerce Commissiones, and Such as have a voice of Calling of Ministers or electing of Deacons of trade toties quoties before they give voice in Calling of Ministers or electing of Deacons of Trades and also excepting the Conservator and the factors of the Staple ports who are to Swear the said oath and Subscrybe the Same and assurance betwixt and the first day of November nixt; and the said oath and assurance Sworne and Subscrybed as above Are to be recorded in the Registers of the respective Courts and meettings and the extracts therof under the Clerks hands to be reported to our privy Councill under the paine of deprivation of the Clerk for Such as are appointed to Swear and Subscrybe betwixt and the said first day of January nixt; and for the rest the extracts therof to be reported within twentie dayes after their Swearing And Subscribing as above; And farder wee with advice forsaid appoint all persones who shall obtaine any free gift or donation from the Lords of our privy Councill Thesaury or exchequer; or Shall present any Signatur of pension or Remission or Containeing ade novo damus or of any other Casualitie (Except gifts of Escheet) To take the said oath and assurance before obtaineing the saids gifts or passing the Said Signatur; And wee with advice forsaid Doe hereby Certifie Such of the forsaid persones as are in any publict office trust or Imployment or who Shall own or exerce the Same without takeing the said oath and assurance in maner forsaid; That they shall be deprived ipso facto of their Saids officers trusts and Imployments and all the forsaids tacksmen Shall be punished as our privy Councill Shall think fitt; And farder that they and all other persones above ranked who shall not Swear the said oath and Subscrib the Same and the assurance Shall not be allowed to keep any horses above ane hundred merks price, or any Sort of armes more then ane walking Sword; Certifieing Such as Shall be found to have horses and armes contrair to this provision either in their oun or in the keeping of others; That both the ouner and keeper Shall incurr the penaltie of One thousand merks the one half to the informer, and the other to Us; And It is also hereby Declared, That the Said oath of alledgance and assurance are in no caise to be Imposer Or Or taken Severally but Joyntly; Declareing heartily That these who refuse the one Shall be holden as refuseing both; And that conforme to the forsaid act of parliament; Our Will is Herefore and wee Charge yow Strictly and Command That incontinent these our Letters Seen yee pass to the Marcat cross of Edinburgh and to the Marcat crosses of the remanent head burghs of the severall Shyrs and Stewartries within this our ancient kingdome And their in our name and authority make intimation hereof And ordaines these presents to be printed that non may pretend Ignorance Sic Subscribitur.

I A:B: Doe Sinceirly promise and Swear that I will be faithfull and bear true alledgance to her Majestie Queen Anne So help me God
Followes the Assurance
I A:B: Doe in the Sincerity of my heart assert acknowledge and Declare; That her Majestie Queen Anne Is the only Lawfull and undoubted Soveraign of this realme Alse weell dejure That is of right Queen as de facto; That is in the possession and exercise of the Government; And Therfore I doe Sincerely and faithfully promise and ingadge That I will with heart and hand life and goods Mantaine and defend her Majesties title and Government against the pretended prince of Wales (now takeing upon him the title of King of this realme) and his adherents And all other enemies who either by open or Secret attempts Shall disturb or disqueit her Majestie in the possession and exercise therof.

Proclamation requyreing the oath of alledgance and assurance Contained in ane act of the last Session of parliament to be Sworne and Signed to her Majestie Queen Anne Read and a clause being added to the assurance viz (now takeing upon him the title of King of this realme) It was urged that the Said Clause not being insert in the assurance contained in the said act of parliament It could not be added therto; and after some argueing theron, Whither the Councill could add a clause to the assurance; yea; or not; It went to the vote add the said Clause to the Assurance Subjoyned to the act of parliament; Or not; It was caried add, and the said proclamation being again read; The Samen was voted approven and Signed and ordered to be published and Recorded And therafter a motion being made that all the Councillors and ther Clerks Should Swear the said oath of alledgance and Subscrybe the Samen and the assurance with the addition; The Samen was accordingly done by all the Councillors then present and by their Clerks
