Proclamation
Proclamation appointing the Oath of alledgance and assurance to be taken.
Followes the proclamation
Anne by the Grace of God Queen of Great Brittain France and Ireland defender of the faith To […] our Lovits Heraulds Macers of our privy Councill pursevants messengers at armes our Shirrifs in that part Conjunctllie and Severallie Specially Constitute Greeting Forasmuchas by act of parliament of date the twelth day of June last by past It is ordained that the oath of alledgance Specified in the said act, 2 and hereto Subjoyned be Sworne; and the Same with the assurance likewise hereafter sett doune be Subscrybed by all persones in publict trust Civill Ecclesiastick and Military who have not yet Sworne and Subscrybed the Samen to us Acording to the tenor of the Sixth act of the fourth Session of this present parliament Entituled act for takeing the Oath of alledgance and assurance, And it is Recommended to the Lords of our privy Councill to cause the said oath of alledgance and assurance be furder taken in maner forsaid at Such times and in Such maner as they shall apoint Therfore Wee with advice of the Lords of our privy Councill In prosecution of and conforme to the forsaid act of parliament, Requyre and Command the haill persones aftermentioned; Who have not already Sworne the Oath of alledgance and Subscriped the Same with the assurance to us conforme to the forsaid act of the fourth Session of this Current parliament and our former proclamation emitted by the Lords of our privy Councill theranent Swear the oath of alledgance and Subscrybe the Same with the assurance both hereto Subjoyned at the times and in maner afterspecified viz The officers of State and of the Crown and Councillor before the Secret Councill; all Noble men and ther eldest Sones past twenty one years of age and the Cheif Commanders of our forces before the Secret Councill or our advocat Thesaurer deput or Justice Clerk or any other of our privy Councill And the Clerk therof all Lords of Session all Members of the Colledge of Justice and others depending upon them before the Session or any of the privy Councill or the Lord Ordinary on the bills for the time; The Lords of Justiciary and others depending on that Court in the Justice Court; The Lords and other members of Exchequer befor the Exchequer; The Lord high admirall and the Judge and others officers and members of the admirality before the Commission or Court of Admiralitie all Judges haveing Commissiones of Justiciary at the first meetting before they exerce by vertue of these Commissiones, The officers and members of the Chancelory; wryters to and under keepers of the privy Seall or the above named persones hereto appointed as above Commissioners to the Convention of Burrowes ther Clerk and the Servant who officiat under him; and the agent for the burrowed before the Convention of Burrowes or any of the Lords of privy Councill, The Conservator before the Convention of Burrowes or any of the Saids persones appointed by the privy Councill; and the factors at Steple-ports before the Conservator and his Court or any of the privy Councill members of the Commissioners for the valuation of teynds and plantation of kirks or of other Commissione before their respective Commissiones, Shirreffs Stewarts, Baillies of Royalties and Regalities; Commissars and their deputs Clerks and Fiscalls before these respective Courts, Justices of peace Commissioners for the Supply and excyse before their conveener he first qualifieing himself in their meetting; The Generall of the Mint before the Secret Councill; or any member therof Specially above appointed and all other officers of the Mint before the Generall therof; all advocats and procurators before their respective Courts to which they belong all Nottars and other persones Imployed in writeing and agenting before the Lords of Session or the Saids persones Specially appointed by the privy Councill, or the Shirriff of the Shyre or his deputs or any of the Magistrats of the burgh within whose Jurisdiction they Live; The Lyon King at armes before the Secret Councill; The Lyon deput, Heraulds pursevants, and messengers at armes with the Clerk before the Lyon in his Court or any of her Majesties privy Councill or the respective Magistrates abovenamed within whatsomever Jurisdictiones they hapen to Live The Macers before their respective Courts wherin they Serve or before the saids persones Specially appointed by the privy Councill Chamberlands Collectors farmorers Tacksmen and Subcollectors of the Crown rents Customes excyse and Bishops rent Surveyers Waiters and their Clerks before the Lords of Thesaurie or our Thesaurer depute or any of the Commissioners of our thesaury or any of the saids Magistrates above mentioned within whose Jurisdiction they happen to Live and reside; Collectors of the Supply, and excyse before the Commissioners of Supply and excise; Magistrats Dean of Gilds with their Councill, Thesaurer, Councillors and Clerks of burghs Royall and Regallity Deacons of trade, and these who have a voice in electing deacons of trades and Clerks of Trades before the Councill of the burgh; or any of the baillies therof officers of the Army befor the Commander in Cheif or whom he shall appoint, and officers of Forts before the Secret Councill or the saids persones Specially appointed by them; Masters of Shipps and their Mates before the Court of Admirality or any admirall depute or any of the saids other Magistrats abovementioned within whose Jurisdiction they Live And all other persones Specified in the Said act of parliament without any Speciall appointment before the saids persones Specially appointed by the Lords of privy Councill or any of the saids Magistrates abovenamed within whose Jurisdiction they Live and wee with advise forsaid appoint and ordaine That the whole persones mentioned in the said act Shall Swear the said Oath and Subscrybe the Same with the assurance in maner forsaid betwixt and the Twentie Second day of September nixt, for which end all the inferior Courts are dispensed with by the act of parliament to Sitt to the effect forsaid; Excepting electors of Members of parliament and members of the Commissiones abovementioned and these giveing voice in calling of Ministers and Such as have voice in electing of Deacones of Trades Who are hereby appointed to take the said oath and Subscrybe the Same with the assurance As followes Viz the electors of members of parliament toties quoties before they elect, members of Commissiones before they exerce Commissiones, and Such as have a voice of Calling of Ministers or electing of Deacons of trade toties quoties before they give voice in Calling of Ministers or electing of Deacons of Trades and also excepting the Conservator and the factors of the Staple ports who are to Swear the said oath and Subscrybe the Same and assurance betwixt and the first day of November nixt; and the said oath and assurance Sworne and Subscrybed as above Are to be recorded in the Registers of the respective Courts and meettings and the extracts therof under the Clerks hands to be reported to our privy Councill under the paine of deprivation of the Clerk for Such as are appointed to Swear and Subscrybe betwixt and the said first day of January nixt; and for the rest the extracts therof to be reported within twentie dayes after their Swearing And Subscribing as above; And farder wee with advice forsaid appoint all persones who shall obtaine any free gift or donation from the Lords of our privy Councill Thesaury or exchequer; or Shall present any Signatur of pension or Remission or Containeing ade novo damus or of any other Casualitie (Except gifts of Escheet) To take the said oath and assurance before obtaineing the saids gifts or passing the Said Signatur; And wee with advice forsaid Doe hereby Certifie Such of the forsaid persones as are in any publict office trust or Imployment or who Shall own or exerce the Same without takeing the said oath and assurance in maner forsaid; That they shall be deprived ipso facto of their Saids officers trusts and Imployments and all the forsaids tacksmen Shall be punished as our privy Councill Shall think fitt; And farder that they and all other persones above ranked who shall not Swear the said oath and Subscrib the Same and the assurance Shall not be allowed to keep any horses above ane hundred merks price, or any Sort of armes more then ane walking Sword; Certifieing Such as Shall be found to have horses and armes contrair to this provision either in their oun or in the keeping of others; That both the ouner and keeper Shall incurr the penaltie of One thousand merks the one half to the informer, and the other to Us; And It is also hereby Declared, That the Said oath of alledgance and assurance are in no caise to be Imposer Or Or taken Severally but Joyntly; Declareing heartily That these who refuse the one Shall be holden as refuseing both; And that conforme to the forsaid act of parliament; Our Will is Herefore and wee Charge yow Strictly and Command That incontinent these our Letters Seen yee pass to the Marcat cross of Edinburgh and to the Marcat crosses of the remanent head burghs of the severall Shyrs and Stewartries within this our ancient kingdome And their in our name and authority make intimation hereof And ordaines these presents to be printed that non may pretend Ignorance Sic Subscribitur.

I A:B: Doe Sinceirly promise and Swear that I will be faithfull and bear true alledgance to her Majestie Queen Anne So help me God
Followes the Assurance
I A:B: Doe in the Sincerity of my heart assert acknowledge and Declare; That her Majestie Queen Anne Is the only Lawfull and undoubted Soveraign of this realme Alse weell dejure That is of right Queen as de facto; That is in the possession and exercise of the Government; And Therfore I doe Sincerely and faithfully promise and ingadge That I will with heart and hand life and goods Mantaine and defend her Majesties title and Government against the pretended prince of Wales (now takeing upon him the title of King of this realme) and his adherents And all other enemies who either by open or Secret attempts Shall disturb or disqueit her Majestie in the possession and exercise therof.
