Act

Act for delyvering up the Laird of Rothimay to Grant Cockstoune and Mr Archibald Ogilvie

Anent the petition given in and presented to the Lords of his majesties privie Counsell by the Laird of Grant Sir Alexander Innes of Cockstoun and Mr Archibald Ogilvie advocat, Showeing that where the deceast John Gordon of Rothemay, haveing appoynted Wiliam Grant of Crichie to be tutor to his Sone the present Rothemay and they the saids Lairds of Grant Cockstoun2 being appoynted two of the overseers of the said tutor and he the said Mr Archbald Ogilvie being one of the nearest of Kinn to the pupill they thought themselves obleidged In duty to represent to his Grace and the saids Lords the Great Concern they had that the said pupill be educat and brought wp in the true protestain Religion, as is Established by law which Cannot be als long as he is in the Custody and keeping of this tutor a profest papist and Seing by the late act of parliament non such Can be tutors to pupills because of the eminent dangers the pupill is thereby exposed to, and that it is most reasonable the said pupill should be putt in the petitioners Custody, who are two of his overseers and one of his nearest of kin and who will make it ther Concern to see to his good education,3 It was Therefore Craved his Grace and the saids Lords would be pleased to Consider the premises and to ordain the said Wiliam Grant, of Crichie to deliver wp, the person of the said Laird of Rothemay, to them or any of them, that So the great danger off his being educat a pupell may be prevented and that they may be enabled to take dilligent Care that he be brought wp in the true protestain Religion, As the Said petition bears His Grace her majesties high Commissioner and the Lords of his majesties privie Counsell haveing Considered the petition Given in to them by the Lairds of Grant and Cockstoun, and Mr Archibald Ogilvie advocat, they hereby ordain Wiliam Grant of Crichie to deliver wp the person of the Laird of Rothemay to the petitioners or any ane of them wpon a recept to be granted by the receiver of the said Rothemay wpon delivery of his person
