Att Edinburgh the Twenty fourth September Jaj viic and two years

Warrant

Warrant for Choiseing a Member of parliament in the burgh of Kirkaldy

The Earle of Leven as provost of the Royall burgh of Kirkaldie haveing represented to the Lords of her Majesties privy Councill, That in pursuance of her Majesties proclamation for calling a parliament to meett at Edinburgh the Twelth day of November nixt His Lordship as provest of the said burgh Did appoint a dyet for the Magistrates Councill and Deacons of the said burgh To meett and Choise Some fitt persone for representing the said burgh in the said ensueing parliament, And the Saids Magistrats Councill and Deacons haveing Conveened accordingly, a great number of them contrary to ther duty and good order did rise up goe furth and desert the said meetting and therby a Sufficient quorum not being left the Said Earle and Such as remained with him were disabled to proceed in the Service of the Said burgh They not being a Sufficient quorum for proceeding in the said election of a member of parliament for the said burgh; The Saids Lords of her Majesties privy Councill Haveing Considered the above representation and how much it concernes her Majesties Service and the intrest of the said burgh that the said abuse be remeeded They Recommend to the Earle of Leven provest of the said burgh That he appoint a new dyet for the Meeting of the Saids Magistrats Town Councill and Deacons of Crafts of the said burgh and that he cause requyre such of them as absented themselves or did withdraw formerly To Conveen and be present at the said meetting at the dyet so to be appointed for makeing the said election and doeing the other Service of the said burgh; with Certification to them and each of them who Shall be absent or haveing once attended Shall remove and goe away before the ordinary ryseing of the said Councill that their places Shall be ipso facto vaccant And that the said Earle as provest of the said burgh, with Such of the Magistrats Toun Councell and Deacons of Crafts who Shall remaine and abyde with his Lordship shall proceed as he is Hereby Impowered to proceed to Supply and fill up the vaccant places of those who Shall not attend or doe remove with such able and Sufficient burgesses as they shall think fitt to Nominat which persones are hereby Impowered and authorized to proceed in the said election of a member of parliament for the said burgh and in all the other service therof Competent to them or any of them, sicklyke and in the same in maner as if they hade been orderly Chosen and elected to their respective offices at the ordinary time and in the due maner.
