Recomendation Grahame of Gramshall and others in Orkney

Anent a Petition given in to the Lords of his Majesties privy Councill be James Grahame of Gramshall for himself and in name and behalf of the haill gentlmen and inhabitants within the Countrey of Orkney Shewing That quher the said Countrey of Orkney Is not only by its Citatione the most exposed of any place within the kingdome to the Landing and waisting of the French privateers But alsoe dureing all the years of this present Warr, He sustained the greatest Losses and plundering by the frequent Landing of the pirrots and particularly the petitioner haveing his house situat within the entry of Holmesound being the pass throw that Countrey to Carstoune and the wastward Is of all others the most infested, and in the moneth of June Last ther having two French privateers come into that harbour one of fourtie four and the other of twentie Guns and made Capture of thrie ships Lying ther, They afterwards Landed and pillaged the Ferryhouse and hade Certainly gone throw the wholl main Island of Orkney and might have pillaged the toune of Kirkwall it self hade it not been by the petitioners means who with the Concourse of his friends Togither with his oun tennents and servants to the number of six2 hundred men waited ther designes and frustrat all ther attempts of ther Landing which Continued for four dayes togither dureing all which Continued for four dayes togither dureing all which time the petitiones was necessitate not only to mantaine the forsaid number of men and furnish amunitione But alsoe sustained the Loss of Two Thousand merks and upwards, By haveing ane Island belonging to him Called Lambholme one the other syde of the Bey totally waisted and destroyed In Respect of which and upon Consideratione that ensieuing year may produce the like if not greater Losses to the petitioner and the other inhabitants within the Countrey And Therfore Humbly Craveing the saids Lords in the first place to order the repairatione of the petitioners Losses either by retentione of so much of his few dutie which he payes to his majestie furth of the said Island of Lambholme and his uther Lands upon the mayn Island of Orkney3 or in any other maner the saids Lords should think more fitting and to recomend the petitioner to the Lords of his majesties thesaury for that effect And in the most place to prevent the dangers of that Countrey by ordering some armes and amonitione to be sent ther to be keept at Kirkwall and to be made use of as occasion shall serve or it the saids Lords think more fitting to order som4 Company’s out of any regiments that Stayes, within the kingdome to be sent ther for incouragment and assistance of the inhabitants within the Countrey as the petition bears The Lords of his majesties privy Councill Having Considered a petition given in to them be James Grame of Gramshall for himself and in name and behalf of the haill Gentlmen and inhabitants within the Countrey of Orkney They hereby Recomend to the Lords Commissioners of his majesties thesaury to take tryall anent the petitioners oun Losses and to order such repairationes therof to be made to the petitioner as they shall find Just And that in such way and maner and out of such fonds as they shall find most proper And Recomend to the saids Lords Commissioners to Cause transmitt such quantities of armes and amunitione to Orkney as they shall find necessary for preventing of Dangers and secureing that Countrey from enemies and to take care that the same be Lodged in the hands of suficient and fitt persones weell effected to his majestie and the present government.

Letter from the Councill to the King anent the Laird of Mcintoches losses

Proclamatione Dischargeing salt beeff from Ireland

The following proclamatione being also read was lykewayes voted approven and signed and ordered also to be recorded whereof the tenor followeth Proclamatione dischargeing the importeing of saltbeef from Ireland to Scotland William by the grace of God King of great Brittain France and Ireland defender of the faith To […] macers of our privy Councill messingers at armes our shiriffs in that part conjunctlly and severally speciallie constitute greeting Forasmuch as by divers Lawes and acts of parliament made by our Royall predicessors The importing and Bringing into this Kingdom of any Cattell from the Kingdome of Ireland is discharged and that by former proclamations emitted therupon, the importing of salt beeff from the said Kingdome of Ireland to this our ancient Kingdome by any of our subjects is also prohibited and discharged under the Certificationes therein mentioned and we being resolved That the said Laws and acts of parliament and proclamations shall be duelie execute and obeyed in tyme comeing Therfore we with advyce of the Lords of our privy Councille strictly prohibite and discharge the importing and inbringing into this Kingdome any salt beeff by whatsomever persone or persons after the first day of March next to come: unless by merchants who buys the same in Ireland to be exported and does accordinglie export the same to any forraigne Countrey out of this Kingdome but noe wayes be sold disposed or made use of within the Kingdome of Scotland after the day foresaid and the said merchants who shall buy any Irish beeff to be exported in maner above mentioned, shall noe wayes liver or put the samine on shoar at any port within this Kingdome but shall keep the same on board of their ship or vessell water born untill the samine be exported by them in maner foresaid Certifieing all such who shall contravert the premisses or reset conceal or make use of any of the salt beiff so imported from the Kingdome of Ireland, The samine shall not only be confiscat but the importers, resetters, users and concealers therof shall be otherwayes punished as the Lords of our privy Councill shall judge their transgressione to deserve And we with advyce foresaid requyre and Command all magistrats of burghs Collectors and waiters of the severall seaports within this Kingdome to see the premisses duely observed and exactlie put to executione as they will be answerable our will is herefore and we charge you strictlie and Command That incontinent these our letters seen ye pass to the marcat Cross of Edinburgh and to the remanent marcat Crosses of the head burghs of the severall shyres within this Kingdome and there in our name and authority by open proclamation make intimatione hereof Given under our signet at Edinburgh the tuentie two day of Januarie and of our Reigne the sexth year Jaj vjc nyntie and fyve years sic subscribitur Annandal P J Morton Cassillis Leven Forfar Breadalbane J Murray Raith Carmichael Lodovick Gran ST Burnet.

The following proclamatione being read was voted approven and signed and ordered also to be recorded quherof the tenor followeth A proclamatione prorogateing the dyet for inbringing and prescribing the method of setling of the accompts of arrears due by the forces to the Countrey William by the grace of God King of great Brittain France and Ireland defender of the faith To […] macers of our privy Councill messingers at armes our shirriffs in that part conjunctly and severally specially constitut greeting forasmuch as by sundrie former proclamations emitted by us with advyse of our privy Councill certaine dayes were prefixed to our subjects for bringing in the severall accompts due by our forces within this Kingdome to them saled and verified in maner mentioned in the said proclamations and we being resolved That none of our good subjects should be cut short and disappoynted of the payment of what is justlie resting to them by any of our forces by their not haveing given in their accompts to the Clerks of our privy Councill before the dayes prefixed in the former proclamations Therfore we with advyce of the Lords of our privy Councill have thought fitt to prorogat the tyme for verifieing and giveing in the said accompts to the Clerks of our privy Councill untill the fyfteen day of March next to come to the effect That whenever the foresaid accompts upon the scots establishment hereby ordered to be brought in, shall be revised and approven by the Lords of our privy Councill to whom we earnestlie recomend to dispatch the same with all dilligence possible (The above sex lynes wrong-) next to come; And doe yet, allow and ordaine the Landlords and others to whom there are any accompts resting by our forces before the first day of Februarie Jaj vjc nynty and one years To repaire to the Commissioners of assesment or any two of them within the respective shyres where the said accompts are resting and there state and verifie by wryte oath or witnesses how many souldiers were quartered on the said Landlords or other persons Creditors what they advanced of meat or drink to the souldiers themselves or forrage to their horses or what they advanced of meat drink meal or malt to our garisons or what sums of money either to our forces or Garisons or their subsistance preceidding the said first day of Februarie Jaj vjc nyntie and one years And we with advyce foresaid ordaine the said Landlords or other persons Creditors to give their oaths That noe part of what they claime as due by our forces is payed to them, and requyre them to instruct their accompts fully and clearly before the said Commissioners by condescending particularly upon the tyme when the accompts were furnished and also upon the Company or at least the Regiment or troop to whom the Souldiers or troopers did belong and to insert all the articles by every Regiment in a paragraph or separate accompt by it self though the same was upon the English Establisment whose arrears and debts to the Countrey are to be stated in accompts differently from these upon the scots establisment And we with advyce foresaid requyre and Command all and sundrie our good subjects to whom any debts are due by our forces and Garrisons for the Causes abovewryten preceeding the day abovementioned To transmitt the same with the verificationes thereof and report of the Commissioners of Supply thereupon, clearly and distinctly instructed and verified in maner abovexprest to the Clerks of our privy Councill betwixt and the said fyfteen day of march next to come to the effect That whenever the foresaid accompts upon the scots establishment hereby offered to be brought in shall be revised and approved by the Lords of our privy Councill to whom we earnestlie recomend to dispatch the same with all dilligence possible Then the Lords of our thesaurie are with all due Conveniencie To give precepts to the Shyres and brughs and other Creditors in the said accompts upon the Receiver of our Crown Rents for payment to them of the respective sums that shall be found due by the Lords of our privy Councill in maner foresaid out of the Tack duety of the polemoney appoynted to be payed to him at Candemass and Whitsunday next and our said receiver is to make puctuall payment of the said precepts after the foresaid tearms as he shall be ordered by the said Lords of Thesaurie and that the debts of these upon the English establisment being so stated and distinctly cleared may be transmitted to us That we in our Royall wisdome may order such Course to be taken for satisfieing the same as we shall think just our will is Herefore and we Charge you strictly and Command That incontinent these our Letters seen ye pass to the marcat cross of Edinburgh and remanent marcat Crosses of the head burghs of the severall shyres within this Kingdome and there in our name and Authoritie by open proclamatione make intimatione Hereof and ordaines these presents to be printed Given under our Signet at Edinburgh the tuentie second day of Januarie and of our Reigne the sexth year Jaj vjc nynty and fyve years sic subscribitur Annandale P Morton Leven Forfar Breadalbane Murray Raith Carmichaell Lodovick Grant ST Burnet

[Lord Melfort’s oath in France]

Letter from the King to the Councill approving the nominating the Earle of Annandale to be their president

The following letter being read in Councill was ordered to be recorded whereof the tenor followeth sic suprascribitur William Rex Right trustie and right weill beloved Cousin and councillor Right trusty and intirely beloved Cousin and Councillor Right trusty and right wel beloved Cousins and Councillors and trusty and welbeloved Councillors We greet you well whereas upon your nominateing our right trusty and welbeloved William Earle of Annandale to preside in our Councill we did apprehend That their might be a poynt of pretensione of right in the Case and did therfore delay to approve of the said nominatione till we should be further informed and that we have now had the said informatione and are satisfied that you have proceeded according to your Commissione and the usuall methods of Councill in the lyke Caises we doe therfore approve of your said nomination and appoynt the said William Earle of Annandale to continue to preside dureing the Chancellors absence or Till our further pleasure and so we bid you heartily farewell Given at our Court at Kensingtone the 12th day of Januarie 1695 and of our Reigne the 6th year By his majesties Command sic subscribitur J Johnstoune
