Act Dowglas of Strahendrie

Anent the petitione given in to the Lords of his majesties privie Councell be Robert Douglas of Strahenrie collector of the cess pole money in the Shyre of Fiffe Shewing That wher the petitioner haveing lately secured ane act in his favours from the said Lords of privie Councell appointing James Crafurd of Mowntwhammy Late collector and John Arrock late clerks for the said Shyre to give up to the petitioner all Lists of poleable persones and all polemoney which they had uplifted Togither with all books and papers which were in ther custodie concerning the present polemoney And finds that the foirsaid act of Cowncell did not contane any warrand for the Deliverance up of the cess books of the said Shyre albeit it be absolutely necessar that the cess books (which now are in the custodie of the said John Arrock and James Crafurd) Are the only exact and true rule to Discover the truth and veritie of the valwatione conforme to the Lists given in theranent And the petitioner requyred up the said cess books or extracts therof from them they altogither refwsed without The saids Lords of privie Councells warrand for that effect as the Said petitione bears Which being this day red and considered be the saids Lords of privie Councell They heirby Decerne and ordaine the saids James Crafurd and John Arrock to allow to the petitioner a full sight of the principall Cess books of the Shyre of Fife And for that effect to make the same open and patent to him or to give to him awthentick Extracts therof upon his own charges and expensses And ordaines Letters of horning on thrie dayes warning and wthers needfull wnder the Signet of Councell to be direct heiron in forme as effeirs

Warrand for transporting Thomas Leister

The Lords of his majesties privie Councell haveing heard a verball representatione made to them by Alexander Braid merchand in Edinburgh and present Stewart and Justiciary of Orknay and Zetland That one Thomas Leyster of Gratham in the Bishuprig of Durham a vessell about Sixtie twns to the road and Harbour of Carstowne in Orknay And did with ane number of armed men Search Severall Scotts Shipps for Counterband goods by vertue of ane Letter of Mart Commissioned from the Lords of the admiralitie of England wherin his own name was not insert But ane Edward Slaneyes And when he was asked how he came to Doe these things within our ports And alsoe make use of ane other mans comissione he told he had ane deputatione from the said Edward Slaney which when produced it seemed to be forged by compareing the Same with Edward Slaneyes Subscriptione to a venditione of ane fourth pairt of the Ship to him Self for all which The said Thomas Leister was putt wnder arreast but not his Ship by the Stewart And the Saids Lords haveing Considered the above representatione made by the Stewart And Likewise from the writes which were produced at the board Doe heirby approve of what the said Alexander Brand Stewart and Justiciary forsaid his Doue in this matter And appoints the said Thomas Leister now wnder a gwaird of two centinells att Kirkwall to be imediatly Delyvered to the Shirreff of Caithnes And from thence wnder a Sufficient gwaird to the next Shirreff And so from ane Shirreff to ane other untill he be delyvered to the magistrats of Edinburgh And appoints them to comitt him prisoner in ther tollbwith untill he answer for what Shall be Laird to his charge in the said mater in maner above represented

Act Duke of Gordons Liberatione

The Lords of his Majesties Privy Councill Have continowed and Hereby Continows the Duke of Gordone his Confynement within the Toune of Edinburgh and four myles about the same from the first day of January Jaj vjc nynty and sex To the first day of Februarie the said year In respect the said Duke hes given bond and found the Earle of Forfar and Adam Gordon of Dalfolly, who were Cautioners in his former bond to be Cautioners in the new bond That the Duke shall remaine confyned within the Toune of Edinburgh and four myles about the same and shall not goe without the bounds of his confynement and that he shall reenter his persone prisoner within the Castle of Edinburgh upon the said first day of February Jaj vjc nynty and sex and in the mean tyme That He shall live peaceablie under and with all submissione to the present Government of his majestie King William And that He shall not act Consult or Contryve anything in prejudice thereof nor shall not converse nor Correspond with any Rebells And that He shall appear before the said Lords of privie Councill when so ever he shall be called for under the penalty of Two thousand pound sterline in case He shall transgress in any part of the premisses

Letter frae ye King ordering the draught of Coll Mcgils regiment to be given to Collonell Mckay

The following Letter from the King read and ordered to be recorded and the Same was intimat to Sir Thomas Livingstoune Commander in Cheiff of his majesties forces within this Kingdome by the Lord Chancellor at the board and a Coppie whereof was delyvered to Him followes the Tenor of the Letter sic suprascribitur William Rex Right trusty and right welbeloved Cousin and Councillor Right trusty and intirely beloved Cousin and Councellor Right trusty and and2 right well beloved Cousins and Councillors Right trusty and welbeloved Cousins and Councillors Right trusty and welbeloved Councillors and trusty and welbeloved Councillors we greet you well Whereas by our Letter to you bearing date the thrid instant We did requyre you to give orders to the Commander in Cheiff of our Forces to cause make a Draught of our Regiments of foot in that our Kingdome for recruiting of our Scots regiments in Flanders We being resolved That the draught to be taken out of the Regiment now commanded by Collonell Mcgill be given to Collonell Robert McCay for recruiting that our Regiment in Flanders lately belonging to D’Offerrell which we have now bestowed upon the said Collonell Robert McKay Doe therfore authorize and requyre you to give orders to the Commander in Cheiff of our forces there That the draught taken out of the said Regiment belonging now to Collonell Mcgill be delyvered to the said Collonell Robert McCay or to such officers from Flanders as belong to the said Regiment now Commanded by him so far as his proportione of the said draughts does extent to which is the number of ane Hundred and sexty sex men, He or his officers payeing for each man according to the ordors given by us to you in our former Letter which is to continue your rule in all other things relateing to the Recruits for doeing whereof this shall be your warrand so we bid you heartily farewell Given at our Court at Kensingtoune the sexteenth day of December Jaj vjc nynty and fyve years and of our Reigne the seventh year By his Majesties Command sic subscribitur J Johnstoune
