Act Robert Cunnnghame And Lowerance Oliphant.

Anent a Petition given in to the Lords of their majesties Privy Councill be Robert Cunninghame toune Clerk of Kirkaldie and Laurance Oliphant Clerk of the regalitie of Dumferling his depute Shewing That quher by ane act of Parliament dated the fourtein day of June Jaj vjc Eightie six years It is Declared that the office of Clerkship to the Justice of peace is ane part of the secretaries office and any act formerly Impowering the Justice of peace to Choose their oun Clerk is therby expressly refunded And true It is that the said Robert Cunninghame haveing obtained ane gift from the secretar of state for the tyme of of2 the said Clerkship within the shyre of Fyfe and Kinross dated in Apprill Jaj vjc Eightie seven bearing power to him and his substituts dureing his lifetyme to exerce the same who formerly did so accordingly Lykeas the said Robert be his letters of Deputation in September last Jaj vjc nyntie two, substitute the said Lawrance his depute in the said office with power to him to officiat conforme to his gift therof Nevertheless the Justice of peace not haveing acted nor keeped any meetting since the revolution till of late, And the said Robert Cunninghame haveing granted a deputation to the said Laurance Oliphant he did attend the Justice of peace at their first meetting and desyred to be received And have the oathes administrat to him, And seing the petitioner are both allready qualified by takeing the oathes in other Capacities and ware attending to be admitted at the first meeting of the Justice of peace, And that they hade undoubted right to the office preferrable to any pretended Commissione frae the Justice of peace And Therfor Humbly Craveing the saids Lords to ordaine the Justice of peace to Continue the petitioner the said Robert Cuninghame his Lawfull possession be himself and his deputs and to administrat to the petitioners the oathes and to Discharge any persone pretending any right from the saids Justices of peace to trouble or molest them as the petition bears. The Lords of their majesties privy Councill haveing Considered the petition given in to them be the above Robert Cunningham and Laurance Oliphant with the gift and Commision mentioned therin and produced therwith Togither with a Counter petition be way of answer therto given in be the Justices of peace in the shyre of Fyfe and a testificat of the death of Fergus Neilsone late Baillie at St Monance alledged to have had a Commission from King Charles the second to be Clerk to the above Justices of peace whom the saids Lords allowed to have seen and answered this petitione The saids Lords have Continued and heirby Continues and ordaines the Justice of peace within the saids3 shyres of Fyfe and Kinross to Continue the said Robert Cuninghame in his Lawfull possession of the said office be himself and his deputes And appoints the saids Justices of peace to administrat the usuall and necessary oathes to the said Robert Cunninghame and Laurance Oliphant and Discharges any others to trouble or molest the petitioners in the said office And if need bees Ordaines letters to be direct heiron.

Act Mr Hew Nisbett minister

Anent a Petition given in to the Lords of their majesties privy Councill be Mr Hew Nisbett late incumbent of the parishin of Kirkgunzeon within the presbytrie of Dumfrees Shewing That the petitioner haveing exerced the function of the Ministrie within the said parish these twentie years bygone to the satisfaction of the wholl parishioners and did yet reside therin with his familly as the testificat granted be them in his favors therwith produced would testifie quherin they shew unto the said2 Petitioner and his familly ther indigent and distressed condition Recomending the3 Consideratione therof to the saids Lords, Declaireing their willingness to pay to the petitioner what it should4 please the saids Lords to authorize them of the bypast vaccand stypend, And Declares that the petitioner hade no predessessor liveing nor any Successor nor meeting house within the parishin And seing the petitioner was most willing to give all obedience to the present government under their majesties king William and Queen Mary as also haveing the concurrance of the petitioners noble patron the Earle of Nitsdale with the Consent of the Countes his mother Declareing their willinges to pay their by past vaccand stipend of the said parish unto the petitioner And the stipend of the said parish being very small and inconsiderable not exceiding six hundred merks yearly And ther being resting in the heritors and possessors hands the stipend for the year Jaj vjc nyntie5 one and nyntie two And therfore Humbly Craveing the saids Lords would allow and give warrand for payment of the said two years vaccant stipend to the petitioner and to order the heritors and others Lyable to make payment therof according to use and wont as the Petition bears, The Lords of their majesties privy Councill haveing Considered this petition given in to them be the above Mr Heugh Nisbet with the Certificat of the parishioners and Consent of the Patron and his mother mentioned therin and produced therwith They heirby Allow to the petitioner the stipend of the above kirk of Kirkgunzean for the haill cropts and years of god Jaj vjc nyntie one and Jaj vjc nyntie two, And Ordaines him to be readiely answered obeyed and payed therof be the heritors fewars Wodsetters and others Lyable in payment of the same And ordaines letters of horning under the Signet of Councill against them for that effect upon productione of a Decreet of Locality And in caise their be non ordaines these Lyable to make payment to the petitioner of their respective proportiones of the saids two years Stipend according as they shall be Decerned be the Judge ordinary The said Mr Heugh Nisbet allwayes giveing bond and finding Suficient Cautione acted in the books of privy Councill That he shall deduce and allow of the first and readiest of the money therof (if need bees) to be Supper-added to the vaccant stipend Jaj vjc Eightie nyne Which is allowed for pious uses To Witt for repaireing of the Church, quire, mass and gleib wherwith the patrones consent is burdeined, And also swearing and signeing the oath of alledgance and signeing the assurance prescribed by act of parliament to their majesties King William and Queen Mary, And that before any one of the Lords of Privy Councill.

Act John Howname younger.

Anent a Petition given in to the Lords of their Majesties privy Councill be John Howname younger merchant in Langholme Shewing That quher the saids Lords in the name of James Irving and John Wauch who alledged they hade deforced them in their seizure of ane barrell of Indigo belonging to the petitioner, Albeit the samen was duely entered, dutie payed and transyrie obtained and upon probatione led be the pursuars and advysed by the saids Lords they were found Innocent And seing the said waitters did seaz upon and carie away the said barrell of Indigo to the custome office at Alisone Bank in may last and still detaines the samen and has keept the petitioners in plea and process this six moneths bygone to their great damnadge and expenses per lichum cessans et damnum dinergens they being merchants, And that the said pursuars and the tacksmen of their majesties customes (who made use of the waitters names to oppress and ruine the petitioners Did necessitate them to Consigne in the saids Clerks hands the soume of Threttie Eight punds to have been given up to the pursuars incaice they hade succumbed in the forsaid actione Wheras the pursuars have Succumed and they are assoylzied as said is, And Therfore Humbly Craveing the saids Lords In Consideration of the premisses To ordaine the said pursuars and the tacksmen and the Collector at Alisone Bank to restore the said barrall of Indigo haill and intire as they tooke it from the petitioner or make payment of the soume of six pounds starling as ther worth and pryce therof, And Likewayes condemne them in large expenses for the great damnadge and expence Sustained by the petitioner and his uncle by the said Malitious and vexatious plea these Six moneths bygone, And in like maner to ordaine the Clerk to deliver up to the petitioner the forsaid thretie eight punds Consigned by the petitioner as said is The condition of Consignation therof never existed they haveing bein most Justly assoylzied by the saids Lords from the forsaid invidious and unjust complaint as the said petition bears. The Lords of their Majesties privy Councill Haveing Considered this petition given in to them be the above John Howname with a Counter petition given in be way of answer therto be the above John Wauch and James Irving They heirby give order and warrand to the Clerks of Privy Councill in whose hands the above soume of Threttie Eight punds Scots was Consigned to give up and deliver the same to the said John Wauch and James Irvine upon their suficient discharge therof And Remitts the point of the petitione anent the barrell of Indigo to the Lords Commissioners of their majesties thesaurie to be decyded and Determined by their Lordships, as they shall think fitt.

Act Mr John Auchterlony

Anent a Petition given in to the Lords of their Majesties privy Councill be Mr John Auchterlony eldest Lawfull sone to the deceast Mr David Auchterlony minister at Forden Shewing That quher ever since the decrease of his said father which was in the end of February Jaj vjc nyntie one years he hade at the earnest and unanimous desyre of the haill members of the sessione of Fordon and out of special love2 to that cure faithfully served the samen by preaching praying visiting the sick and administrating the sacrament both of Baptisme and the Lords Super, wherfore upon the petitioners applicatione to the saids Lords in January last by past, The saids Lords ware pleased to conferr upon the petitioner the half years stipend then due and authorize and Impower the petitioner to uplift the samen by their act dated at Edinburgh the fourtein day of January Jaj vjc nyntie two years And seing alse weell since as before that tyme he hade served the said cure and suplied the vaccancy with gods assistance to the contentment and satisfaction of the haill parishoners And conform to his dutie have obeyed the lawes in praying expresly for their majesties King William and Queen Mary and reading all acts and proclamationes of Councill alse weell relative to thanksgiveing as to fasts that came to his hands which would appear to the saids Lords by a3 testificate subscribed by the heritors and elders of the said parishin written by their session Clerk and sent allong with the petitioner for that effect Morover it hade pleased the almightie god to to4 bless him with the Love and favor of his hearers that he hade gotten a Call from to be their ministers subscribed be the haill elders and heritors of the paroch And seing he hade served the Cure and supplied the vaccancy these twelue moneths by gone alse weell as before and have a Call to be their minister and was content conforme to the saids Lords act to take the Oath of alledgance presently if desyred Lykewayes Seing ther is no presbytrie yet established in that shyre And Therfore Humbly Craveing the saids Lords to allow the petitioner the bygone years stipend and would authorize and Impower him to uplift the samen for that year and5 in tyme comeing (6seing he has a Call aiy and whill he be orderly and legally admitted minister of the said kirk, Conforme to the present government of the Church in this kingdome as the petitione bears, The Lords of their Majesties privy Councill Haveing Considered this petitione given in to them be the above Mr John Auchterlony with the former act of Councill, And the testificat of the heritors and elders of the above kirk mentioned in and produced with the said petition, They heirby Remitt this petition to the Lords of their majesties thesaurer in caise the above kirk of Forgane be of ther majesties patronage And Recomends to their Lordships to grant the desyre therof for the year Jaj vjc nyntie two And incaise the same be not of their Majesties patronage They heirby allow the petitioner the Stipend of the said Kirk of Forgane for the haill cropt and year of god Jaj vjc nyntie two, He first produceing the Patrones consent to the Clerks of privy Councill, And also swearing and signeing the oath of alledgance and signeing the assurance appointed by act of Parliament before extracting heirof And Ordaines him to be readily answered obeyed and payed therof be the heritors fewars wodsetters and others Lyable in payment of the same, And ordaines letters of horning under the signet of Councill against them for that effect, The petitioner allwayes produceing a Decreet of Localitie, And in caise ther be non Ordaines these Lyable to make payment to him of their respective proportiones of the said years stipend according as they shall be Decerned by the Judge ordinary.

Anent a Petition given in to the Lords of ther Majesties privy Councill be Mr Samuell Spalding minister at Partain Shewing That the kirk of Partain hade been vaccand thir four years by past since the decease of William Cunninghame of Enterkine last minister their, And that albeit the petitioner was not ordained minister of the said parosh of Partoune till of late yet by the Call of the said parish and appointment of the presbytrie he preached and used all the other parts of his ministeriall functions within the said parish since May Jaj vjc nyntie one years as appeared by ane call from the parish and ane act of the presbytrie therwith to show to the saids Lords Lykeas Robert Glendining of Partoun patron of the vaccand stipend therof Considering that he hade used all the parts of his ministeriall function within the said parish since may Jaj vjc nyntie one hath by his gift of the date the sixteinth day of January Jaj vjc nyntie thrie years gifted to the petitioner the stipend of the said parish and benefite of the gleib and manss of the cropt and year of god Jaj vjc nyntyie two years as appeared by the gift therwith produced, Be vertue of all which the petitioner hath good and undoubted right to the forsaid years Stipend and benefite of the mans and gleib, And Therfore Humbly Craveing the saids Lords to grant warrand for raiseing of letters of horning and poynding against those Lyable for payment of the forsaid years Stipend of the said paroch and years benefite of the manss and gleib upon production of the Decreet of Locallity of the said parish as the petition bears The Lords of their majesties privy Councill haveing this petition given in to them be the above Mr Samuell Spaldin with the call testificat of the Presbytrie and consent of the patron mentioned therin and produced therwith, They heirby allow to the petitioner the steypend of the above kirk of Partan with the benefit of the manss and gleib for the haill cropt and year of god Jaj vjc nyntie two, And Ordaines him to be readiely answered obeyed and payed therof be the heritors fewars wodsetters and others Lyable in payment of the same And Ordaines letters of horning under the signet of Councill against them for that effect He produceing a Decreet of Locallitie, And in caice ther be non Ordaines these Lyable to make payment to the petitioner of their respective proportiones of the said years stipend and rent of the manss and Gleib According The petitioner all wayes before extracting heirof swearing and signeing the oath of alledgance and signeing the assurance prescribed be act of Parliament to their majesties King William and Queen Mary And that in presence of any one of the Lords of Privy Councill.

Order anent Francis Allan Gardner Deserter.

The Lords of their majesties privy Councill being informed that Allan Gardner is a disserter from Collonoll Lauders regiement of foot in Flanders and that since his deserting he is become a Packman and has been resett lodged and intertained at the house of John Grame in the parish of Damakellie within the shirefdome of Pearth And haveing been seazed by David Grame one of the Livts in their Majesties Royall regiment of foot guards in Flanders and the Livt did sett two men to be watch upon him at the house of the said John Grame from whom the said Allan Gardner by the assistance or Connivance of the said John did make his escape, And seing the said Allan has left his pack in the house of Thomas Grame in Auchterairden the saids Lords of their Majesties privy Councill Doe heirby Grant warrand to maccers or messengers at armes to cite the said John Grame to Compeir befor them the sixth day of February nixt to answer for his escape of the said Allan And alse for citeing of witnesses, And Ordaines the sheriff depute of Pearth to seaze upon and secure the forsaid pack and Cause transmitt the same safe and inteir to Edinburgh and deliver it to any one of the baillies to be by them made furth comeing as accords of the Law.
