Act Anent the Toune of Elgins accompts

The Lords of his Majesties privy Councill haveing Considered the report of a Comittie of ther oun number to whom it was appointed for reviseing the accompts resting be his Majesties forces to the Countrey Bearing That the Committie having Considered the accompts given in to them as resting be their majesties forces upon scots pay to the inhabitants of the burgh of Elgine with the instructiones and verifications therof They Find the haill articles of the saids accompts so farr as concernes the forces upon scots pay sufficiently verified and proven partly by wryt under the hands of the Souldiers of their officers and partly by the oathes and depositiones of the saids inhabitants taken before the Commissioners of supply within the shyre of Elgine and Forress Conforme to the Commissioners their report and partly both by wryt under the hand of ther souldiers and officers, and by the Oathes and depositiones of the saids inhabitants taken before the saids Commissioners Conforme to the forsaids reports and likewayes be most ample and distinct reports subscribed be the saids Commissioners returned with the accompts and instructiones bearing that the persones in the accompts gave ther oathes before them That the soumes of money Contained in the accompts and in the subscribed tickets accompts and others produced before the saids Commissioners and seen and revised by them is truely resting unpayed, and that the same was for meat and drink furnished be the saids persones to the saids forces dureing the time they were quartured amongst the saids inhabitants, and that the same as it was dayly furnished be them to the saids forces does not exceid two parts of ther dayly pay and that they are not yet payed therof Which accompts instructiones therof and reports of the saids Commissioners were all produced to and Considered be the said Committie, And the Committie Finds that ther is resting to the saids inhabitants of the said burgh of Elgine be their majesties forces upon scots pay as they are stated in Regiments and troops in maner underwritten The soumes following viz by the Laird of Grant his regiment of foot, The soume of Eight hundreth and fourtie punds twelues of Bighouse his independent Company the soume of Twentie seven punds four shilling scots Item by the Lord Cardross his regiment of Dragoons the soume of Two hundreth and nyntie pund two shilling scots Item by Captaine Burnet of Balfour his troop of horss four hundreth and fourtie five punds eight penies scots Item by the Lord Yesters troop or horss he soume of ane Hundreth up were all furnished preceiding the first day of February Jaj vjc nyntie one years and that they are all in the termes of the nynth act Fourth sessione of this Current parliament Intitulled act for polemoney and of the proclamatione of Councill relative therto dated the last day of Jully Jaj vjc nyntie four years, And Therfore It is the opinion of the Comittie That the said Tottall soume of seven Thousand Two hundreth and nyntie punds eleven shilling scots money forsaid is to be payed to the saids inhabitants of the burgh of Elgine out of the saids inhabitants of the burgh of Elgine out of the said polemoney and that the saids Inhabitants are to be Recomended to the Lords Commissioners of ther majesties thesaury for payment of the same accordingly as the said report bears The Saids Lords of his majesties privy Councill Doe heirby approve of the said Report And Recommends to the Lords Commissioners of his majesties thesaury To Cause payment be made out of the present polemoney to the Inhabitants of the burgh of Elgine of the above Soume of seven Thousand two hundreth and nyntie punds Eleven shilling scots money.

The Lords of his Majesties privy Councill having Considered the report of a Comittie of ther oun number to whom it wes appoynted for reviseing the accompts resting be his Majesties forces to the Countrey Bearing That the Committie haveing Considered Bearing That the Committie haveing Considered the accompts given in to them as resting be the deceast Lord Cardross his Dragoons, and the Gentlmen of the Lord Beilhaven his troope of horss which were both upon scots pay To the inhabitants within the burgh of Banff with the instructiones and verifications therof They Find the haill articles of the saids accompts suficiently verified and proven be the tickets recepts or subscryved accompts and be the Report of the Commissioners of supply within the shire of Banff Bearing that they have seen the principall tickets Contained in the accompt now given in to the Committie which instructs the same to be truely resting owing and that they have taken the oathes and depositiones of the saids inhabitants That the saids troops were quartered upon them the moneths weeks and dayes mentioned in the accompts and that the accompts and tickets were granted for true and Just Soumes and that the same were truely furnished be the saids inhabitants to the souldiers and as yet resting unpayed, Which accompt tickets recepts and report were produced to and Considered be the said Committie, And Finds that the haill articles of the saids accompts furnished to the said deceast Lord Cardross his regiment of Dragoons are all preceiding the first day of February Jaj vjc nyntie one years. But Finds that ther are severall articles of the accompt furnished to the said Lord Beilhaven his troop which are after the said day, And Therfore they have rejected these articles and Caused dilate them out of the accompt And Finds that after dilatine of these articles ther is still resting to the inhabitants within the said burgh of Banff the soumes following viz be the said deceast Lord Cardross his regiment of Dragoons The soume of Two hundred punds Eightein shilling and two pences scots, and be the Gentlmen of the said Lord Beilhaven his troop of horss, The soume of Two hundreth nyntie seven punds five shilling ten penies scots money forsaid Extending both the soumes togither to the soume of Four hundreth nyntie Eight pund four shilling two penies scots And the Committie Finds that the articles of the said accompt wherof this accompt is made up are all in the termes of the nynth act fourth sessione of this Current parliament Intituled act for pole money dated the twentie nynth day of May Jaj vjc nyntie thrie years and of the proclamatione of Councill relative therto dated the last day of Jully Jaj vjc nyntie four years And Therfore It is the Commities opinion that the said soume of Four hundreth nyntie Eight punds four shilling two penies scots Is to be payed to the inhabitants of the said burgh of Banff out of the polemoney appointed be the said act And that the inhabitants forsaids are to be Recomended to the Lords Commissioners of ther Majesties thesaury for payment of the same accordingly as the said report bears The Saids Lords of his majesties privy Councill Doe heirby approve of the said report and Recomends to the Lords Commissioners of their Majesties thesaury to Cause payment be made out of the present pole money to the saids inhabitants of Banff of the said soume of Four hundreth and nyntie Eight punds four shilling and two penies scots.

The Lords of his majesties privy Councill haveing Considered the report of a Committie of ther oun number appointed for revising the accompts resting by his Majesties forces to the Countrey Bearing That the Committie haveing Considered the accompts given in to them as resting be his majesties forces upon Scots pay to the tennents and Inhabitants within the shyre of Clackmanan and severall tounes and parochins therin mentioned in the saids accompts. They Find that ther were severall articles in the saids accompts which were not in the termes of the acts and proclamationes of his majesties privy Councill And Therfore They have refused and rejected all these articles, and Finds that ther are some of the articles of the said accompt stated above the rates allowed be the privy Councill, And Therfore they have Restricted these articles to and stated them at the Councills dates, And the Comittie Finds the haill articles of the saids accompts restricted as said is, sufficiently verified and proven partly be recepts or subscryved accompts under the hands of the officers or souldiers to whom the soume were furnished, And all of them be the oathes and depositiones of the saids tenants and inhabitants and some of them both by recepts or subscryved accompts and the oathes of the saids inhabitants Conforme to reports under the hands of the Commissioners of Supply within the said shyre Bearing the haill persones in ther accompts to have given ther oathes before them that the accompts were truely furnished and are yet resting and no part of them payed. Act Alexander Southerland

Anent a Petition given in to the Lords of their majesties privy Councill be Alexander Southerland of Scairnslate Shewing That quher the petitioner being advertised by the saids Lords proclamatione to furnish a proportion of the late Levies In obedience to which act and proclamatione the petitioner brought allong with him thrie sufficient men whom he presented to the officer appoynted to receive the Levies in Caithnes and desired the officers to make Choise of any of the thrie men presented as being the proportion to which the petitioner was Lyable, But the officer either slighted or at least neglected to receve the man after the petitioner hade presented him for that effect, and the petitioner fearing that he might be given up as a deficient and therby made Lyable to the penalty contained in the proclamatione The petitioner adressed himself to Livd Murray and his serjant and presented to them a suficient man able to Cary armes in their Majesties Service and protested that he might be no furder Lyable as appears by ane protestatione and ane instrument therwith produced, notwithstanding quherof that the petitioner hade performed all that by your Lordships act and proclamationes he was oblidged to and that the men presented2 by the petitioner was severall hours in the Custody and keeping of the officer yet the petitioner Contrair to all Justice Is given up as deficient and fearing that some advantage may be taken of the petitioner Is necessitate trouble ther Lordships with this representatione Wherby Its evident and Clearly proven by the two protestationes and instruments produced that the petitioner was nowayes deficient and it was likewayes nottour to the Earle of Broadalbine how that the prison in which the Levies were secured was brock open and the Earles baillie beat in defending the prisone and the man suffered to escape And Therfore Humbly Craveing the saids Lords Discharge all officers messengers and others from troubling or molesting the petitioner upon the accompt of deficiencie and from puting any letters of horning poynding or other dilligence in executione against the petitioner on the forsaid accompt Especially seing the petitioner gave obedience to the saids Lords acts and performed all that any man Could doe as appears by the two protestationes and instruments therwith produced as the said petitione bears The Lords of their Majesties privy Councill having Considered this petitione with the Report of the Earle of Broadalbine to whom it was Remitted, They heirby Remitt to the Commissioners of Supply within the Shyre wher the petitioner Lives to doe in the matter as they shall find Just according to Law.

Anent a Petitione given in to the Lords of his majesties privy Councill be Arthur Stratton sone and appearand air to umquhill Arthur Stratton of Whytlaw Shewing That quher the deceast Daniall Nicolsone wryter in Edinburgh pretended Creditor to the petitioners said deceast father and who upon that accompt hade apprysed and adjudged his wholl lands and estate Did by his letter of Concessione written ands subscryved with his hand of the date the thrid of november Jaj vjc nyntie thrie years For the Causses and Considerationes therin exprest Gave and granted his free and express Consent that Marion Straitton the petitioners mother should uplift and receive yearly from James and Robert Coutts and Jannet Drumond spouse to James Caldwalls present tennents in Drumdryden the soume of seventie punds twelue shilling scots money payable be them and to uplift the same from their successors tenents incase of removeall, And that for the petitioners mantinance and educatione at schoolls and otherwayes dureing the petitioners minority as the said concession and Consent of the date forsaid therwith produced in it self more fully bears, And seing that the same bears ane speciall provisione viz That the said aliement so granted should be allowed to the said Daniall in any proces of Compt and reckoning that should hapen to be raised against him Reserving his Objectiones against any Compt and reckoning allwayes as accords And that ther should be ane act of the saids Lords procured for his Warrand that the said aliement should be allowed as said is, Therfore and to the effect the2 forsaid mantinance and Grant therof might be made effectuall to the petitioner by purging the forsaid provisione And Therfore Humbly Craving the saids Lords would be graciously pleased by ther act to Ratifie the forsaid deed of Consent granted In favors of the petitioner In the termes of the said provisione for the warrand of the said umquhill Daniall his representatives and the poor petitioners aliement as the petition bears. Act Collonell Fergusone anent Recruits

Memorandum from Collonell Fergusone To the Right honourable the Earle of Annandale Lord President of the privy Councill Being informed That there is a second letter from his Majestie to the Councill concerneing the Recruits for Flanders whereof it is fitt I should have a double I beg your Lordship will move it in Councill That the Clerk of Councill be authorized. to fournish me with a Coppie of said Letter and of any other Instructiones relative to the Recruits upon demand The Lords of his majesties privy Councill haveing Considered this memorandum given in to them by the above Collonell Fergusone They hereby allow their Clerks To give to the said Collonell a Coppie of his Majesties said letter and any other odors of Councill relating to the said Recruits which the Collonell shall requyre and condescend upon in the usuall maner
