Act

Act Lord William Douglass for the Stipend of Maner

Anent a petition given in to the Lords of his majesties privy Councill be Lord William Douglass Shewing That wher the petitioner being undoubted patron of the Church and paroch of Maner, and which has been vaccant these severall years bygone; And the petitioner being resolved to apply the vaccand Stipend therof for building ane Bridg over the watter of Maner at the foot therof, Wher formerly ther was one built and is now fallen, and Which watter is oft times so great that it cannot be past, And Which is not only upon the Comon marcat road for a great part of that parish, And the greatest part of the Shire of Peebles, But likewayes the petent road to and from England for the greatest part of the western Shires of this kingdome, and the building wherof is a most necessar pious use, And it is also necessar That the saids Lords approve of the forsaid application So as the work may be presently gone about And Therfore humbly Supplicating the saids Lords to the effect aftermentioned As the petition bears The Lords of his majesties privy Councill haveing Considered the above petition given in to them be the above Lord William Douglass They hereby approve of the petitioners Resolution to apply the vaccand Stipend of the Kirk of Maner for building a bridge over the Watter of Maner at the place mentioned in the petition, And Nominats and Appoints Alexander Horssburgh younger of that ilk to whom the petitioner has given a factory To be factor for uplifting and Imploying of the vaccand Stipend of the said kirk for the years bygone And Decernes and Ordaines the heritors lifrenters titullars Tacksmen Tennants and others Lyable in payment of the said vaccant stipend To make payment of the same to the said factor for the years bygone He allwayes produceing a Decreet of Locallity And incaice ther be non ordaines the heritors and other forsaids Lyable in payment of the said Stipend To make payment of their respective proportiones therof According as they shall be Decerned by the Judge ordinary In Respect the said factor has Granted bond and found suficient Cautione acted in the books of privy Councill That he shall doe Dilligence for recovering of the said Stipend, And being recovered shall Imploy the same for building of the forsaid bridge at the place mentioned in the petition, And ordaines letters of horning on fiftein dayes to be direct at the said factors instance to the effect forsaid.

Commissione for additionall Comissioners within the shyre of Fyfe

Act appoynting William Williamsone to be Collector of the pole money etc

The Lords of his majesties privy Councill being informed by Sir Archbald Murray of Blackbarrony one of the Commissioners of Supply within the Shyre of Pebles That William Williamsone Collector of Supply within the foresaid shyre had made up lists and Rolls of the poleable persones in that Shyre and lykewayes in the particular paroches within the same and that the same have been seen and approven of by the Commissioners of Supply and that it will be most convenient That the said William Williamsone be appoynted Collector for the pole money of that shyre and the particular Parishes within the same The Lords of his majesties privy Councill doe hereby nominat and appoynt the said William Williamsone Collector of Supply To be collector of the pole money within the said shyre of Pebles and that both for the shyre and every particular paroch within the same and for makeing up exact Lists of the poleable persones therein conforme to and in maner specified in the act of parliament and proclamationes of Councill For which the said Lords allow and appoynt to be retained by the said Collector fyve per cent of the pole money of the said shyre collected by him in full satisfactione of his Collectiones and pains in makeing up Lists and collecting the said pole money both for the shyre and the particular parishes thereof And requyres the Commissioners of the said Shyre to take sufficient Cautione of the saids Collector for his exact dilligence and faithfull performance of the premisses And Ordains the said William Williamsone Collector to give bond and find sufficient Cautione to the said Comissioners of supply for his faithfull discharge of the premises before his entrie upon the said Collectione and the said Lords ordains the said bond to be transmitted to the Clerks of Thesaurie betwixt and the fyfteen day of December next to come.

Act declaring Bradeisholme younger a Commissioner for Lanerk Shyre

The Lords of his majesties privy Councill Considering that the Laird of Bredisholme is amongst the principall Commissioners of Supply nominat in the act of parliament Jaj vjc and nynty years for the shyre of Lanerk and also that the said Laird is amongst the Commissioners added in the act of the Last sessione of this currant parliament and understanding that Bredeisholme younger was designed by the parliament in the said last act albeit the word younger be omitted out of the printed acts Therfore they Hereby declare the Laird of Bredeisholme younger to be one of the Commissioners of Supply within the said shyre of Lanark as well as his father With power to him to sitt, meet and act with and as one or the Commissioners of Supply within the said shyre sicklyke and in the same maner as any other of the said Commissioners hes done or may doe, he qualifieing himself according to law.

The following letter being read was ordained to be recorded And in the mean tyme appoynted a proclamatione to be prepared in the tearmes therof follows the tenor of the Letter sic suprascribitur William Rex Right trusty and right wellbeloved Cousin and Councillor Right trusty and intirely beloved Cousin and Councillor Right trusty and right welbeloved Cousins and Councillors Right trusty and wellbeloved Cousins and Councilllors Right trusty and well beloved Councillors and trusty and wellbeloved Councillors we greet you well whereas we had appoynted the generall assemblie of the Church in that our ancient Kingdome of Scotland to meet the tuenty day of November next But not haveing tyme at present to prepare what were necessary for the said assemblie we have thought fitt to delay the meetting thereof for some tyme and that the members may not be put to unnecessary trouble We doe requyre and authorize you to emitt a proclamatione for adjourning the said Generall assemblie from the said tuenty day of november next to the seventeen day of December next And you are to order the members thereof to attend on the said day for doeing whereof this shall be your warrant so we bid you heartily farewell Given at our court at Althorp the tuenty sexth day of October Jaj vjc nynty and fyve years and of our Reigne the seventh year By his Majesties Command sic subscribitur J Johnstoune.

Proclamatione adjourning the parliament etc

The following proclamatione being read approven and signed was ordered to be recorded whereof the tenor followeth A proclamatione for adjourneing the parliament to the tuenty day of March Jaj vjc nynty and sex years William by the Grace of God King of great Brittanie France and Ireland defender of the faith To our Lyone King at Armes and his brethren heraulds macers of our privy Councill Pursevants messengers at armes our shirrifs in that part conjunctlly and severally specially constitut greeting Forasmuch as by the Last act of the fyfth sessione of this our Currant Parliament the same is adjourned to the seventh day of November then next to come now instant and our affaires not requyreing a meeting thereof at that tyme, we have thought fitt that the adjournement thereof should be continowed from the said day to the tuenty day of march next to come Therfore we with advyce of the Lords of our privy Councill doe Hereby adjourn our said Currant Parliament untill the said tuenty day of March next ensueing the date hereof Requyring all the members of our said parliament to attend that day in the usuall way and under the certificationes contained in the severall acts of parliament made theranent our will is Herefore and we charge you strictly and Command That incontinent these our Letters seen ye pass to the marcat Cross of Edinburgh and to the marcat Crosses of the remanent head burgs of the severall shyres of this our ancient Kingdome and there by open proclamatione make intimatione That our said parliament of this Kingdome is adjourned to the tuenty day of march next to come and ordain’s these presents to be printed Given under our Signet at Edinburgh the fyfth day of November and of our Reigne the seventh year sic subscribitur Tweddale Southerland Forfar Yester James Stueart Adam Cockburne John Lauder W Anstruther Archibald Murray Robert Cheisley
