Decreit and Remitt Lady Glenbucket against her sone

Petitione The Lady Glenbwcket Read and haveing considered the Same with ther deliverance upon a former petitione at her instance The Counsell doe heirby add ane other Hundereth punds Scotts to the Hundereth punds formerlie modified be the Counsell to the petitioner upon the threttein day of October Last bypast makeing both togither ther Soume of Two Hundereth punds And decernes and ordaines […] Gordon of Glenbucket to make payment to the said petitioners of the said two Hundereth punds for her present aliment and Subsistance And ordaines Letters of horning on fiftein dayes to be direct heiron Against Glenbucket her son and others needfull under the Signet of Counsell And remitts to the Lords of Sessione to discuss the point of right in contraversie betuixt the petitioner and Mr Robert Burnet of Glenbervie and Mr Robert Irvine parson of Towie anent the dispositione made by her to them of her liferent And betuixt her said sone in whose persone the right of the said dispositione stands now transgerred and in the mean tyme Superceeds to give Sentence upon the point of ruot untill the point anent the dispositione remitted to the Lords of Sessione be discussed and determined

Warrand for George Mosman for printing a book called a cordiall for christeans

The Lords of his majesties privie Counsell Doe heirby allow and grant Libertie to George Mossman bookseller in Edinburgh to print and vend a book intituled a cordiall for christeans travelling heavenward being the substance of some sermons upon the eight Chapter of Pauls epistle to the romans preached in the citie of Edinburgh by a minister of the gospell ther And discharges any other persones to print reprint vend or import the said book for the Space of threttein yeirs efter the day and date heirof without Licence first had and obtained from the said George Mossman for that effect under the paine of confiscatione of the saids books so printed reprinted imported or vended to the wse of the said George Mossman besydes what furder pwnishment the Lords of privie councell shall please to inflict on the contraveeners

Warrand to imprison James Mcphersone

Anent the petitione given in to the Lords of his majesties privie Councell be James Mcphersone of Inverinheven Shewing That wheras the petitioner being conveined before the Commissioners of Justiciary at Invernes for his alleadged being gwiltie actor airt and pairt of robbing Spoilling and intrometting with and away takeing certaine cattell goods and wthers pertaining to John Grant of Comegrass in May Jwne or Jullie Jaj vic eightie nyn when the Late Viscount of Dwndie was in the hills In the which proces the saids comissioners proceeded So Sumarly that without ane legall probatione Led against the petitione they did imprisone him in the tollbwith of Invernes wher he was detained for a considerable Space without putting the mater to a full Legall tryall Wherupon the petitioner did apply into the saids Lords of privie Councell and upon most Just grounds The saids Lords by ane act of the date the tenth day of December Jaj vic nyntie five yeirs was pleased to ordaine the petitioner to be sett at Libertie furth of the said tollbuith of Invernes and ordained him to repaire to Edinburgh against the first day of January Jaj vic nyntie six And then enter himself prisoner within the tollbwith therof as will appear by the act herewith produced And for Doeing wherof the petitioner Did then find cautione As also in obedience to the saids Lords comands and order and for releiveing of his cautioners The petitioner hath now come to Edinburgh And knowing himself to be altogither innocent of the pretended crymes alleadged against him And that ther is no persewar to insist nor no wittnesses to prove any swch Delinqwence As the said petitione bears Which being this day red and considered be the saids Lords of privie Councell They heirby ordaine the petitioner to enter himself prisoner in the tollbwith of Edinburgh betuixt and the first day of January next to come Conforme to the former act of councell and allowes the said John Grant of Cwmegass to sie and ansuer this petitione against the nynth day of January Jaj vic nyntie six yeirs

William by the grace of God King of Great Brittaine France and Ireland Defender of the faith To […] macers of our privie Councell messengers at armes our Shirreffs in that pairt conjunctlly and severally Speciallie constitut greeing Forasmuchas Anent the lybell or complaint raised and persued befor the Lords of our privie Councell at the instance of Andrew Agnew of Sewchen heretable proprietar of the Lands wnderwritten with concurse of Sir James Stewart our Advocat for our interest in the mater wnderwritten Mentioning That wher by the Laues and constitutiones of this and all other well governed nationes all persones are to be Secured in the qwiet and peaceable possessione of ther own Lands and in the improvement of the Same against all hostilitie or maisterfull invasione intrusione or oppressione And particularly that the police of the parking and incloseing of ground is incouradged by many Lawes and acts of parliament of this natione And the complainer being of designe to inclose and impark a pairt of his Lands called the mwir of the park which is neer to the march of the Larg And haveing begun the work and bwilded the park Dyke Trwe it is that upon one or other of the dayes of ane other of the moneths of the yeir of God Jaj vic nyntie four while the workmen were at work about the incloseing and imparking of the said peice of grownd wherof the complainer and his predecessors have bein in the peaceable possessione for much more then the Space of Fourtie yeirs bygone without any interuptione Patrick Kennedie Proveist Strawrawer Andrew Harvie and Robert Gordone baillies ther Patrick Patersone Late proveist ther Alexander3 Patersone towneclerk ther Hewgh Somervaill merchand ther James Mcmaister Walker ther Alexander and Andrew Mcreidies they would be gwiltie of a ryot in Stopping of the complainers said work men And rendering the said mwir and park altogither unprofitable as indeed it is Since ther violent interrupting the inclosure of the Same as ane instrument taken by the complainer against them Showen to our Saids Lords hes testified By all which it may appear to our Saids Lords that the persones above complained upon are gwiltie of a manifest ryot injurie and oppressioen And Therfor they owght to be Decerned to make payment to the complainer of the Soume of Ane Thowsand punds Scotts of Damnadges and expensses Sustained by him in this mater And furder owght to be pwnished in ther persones and goods to the terror of others to comitt the Lyke in tyme comeing And anent the charge given to the haill forenamed Act Dowglas of Strahendrie

Anent the petitione given in to the Lords of his majesties privie Councell be Robert Douglas of Strahenrie collector of the cess pole money in the Shyre of Fiffe Shewing That wher the petitioner haveing lately secured ane act in his favours from the said Lords of privie Councell appointing James Crafurd of Mowntwhammy Late collector and John Arrock late clerks for the said Shyre to give up to the petitioner all Lists of poleable persones and all polemoney which they had uplifted Togither with all books and papers which were in ther custodie concerning the present polemoney And finds that the foirsaid act of Cowncell did not contane any warrand for the Deliverance up of the cess books of the said Shyre albeit it be absolutely necessar that the cess books (which now are in the custodie of the said John Arrock and James Crafurd) Are the only exact and true rule to Discover the truth and veritie of the valwatione conforme to the Lists given in theranent And the petitioner requyred up the said cess books or extracts therof from them they altogither refwsed without The saids Lords of privie Councells warrand for that effect as the Said petitione bears Which being this day red and considered be the saids Lords of privie Councell They heirby Decerne and ordaine the saids James Crafurd and John Arrock to allow to the petitioner a full sight of the principall Cess books of the Shyre of Fife And for that effect to make the same open and patent to him or to give to him awthentick Extracts therof upon his own charges and expensses And ordaines Letters of horning on thrie dayes warning and wthers needfull wnder the Signet of Councell to be direct heiron in forme as effeirs

The Lords of his majesties privie Councell Doe heirby give order and warrand to ther clerks to raise and give out a lybell or Letters of complaint at the instance of Sir James Ogilvie his majesties factor Against Archibald Beth messinger in Bute Shyre to ansuer befor the Councill for his faults and molestatione in executeing of ane other lybell or complaint at the instance of his majesties advocat against Some persones as importers of Irish or other forraigne victuall And that conforme to ane note to be given in to them be the said Sir James

Warrand to raise Letters Against James Beth messengers

The Lords of his majesties privie Councell Doe heirby give order and warrand to ther clerks to raise and give out a lybell or Letters of complaint at the instance of Sir James Ogilvie his majesties factor Against Archibald Beth messinger in Bute Shyre to ansuer befor the Councill for his faults and molestatione in executeing of ane other lybell or complaint at the instance of his majesties advocat against Some persones as importers of Irish or other forraigne victuall And that conforme to ane note to be given in to them be the said Sir James

Warrand for transporting Thomas Leister

The Lords of his majesties privie Councell haveing heard a verball representatione made to them by Alexander Braid merchand in Edinburgh and present Stewart and Justiciary of Orknay and Zetland That one Thomas Leyster of Gratham in the Bishuprig of Durham a vessell about Sixtie twns to the road and Harbour of Carstowne in Orknay And did with ane number of armed men Search Severall Scotts Shipps for Counterband goods by vertue of ane Letter of Mart Commissioned from the Lords of the admiralitie of England wherin his own name was not insert But ane Edward Slaneyes And when he was asked how he came to Doe these things within our ports And alsoe make use of ane other mans comissione he told he had ane deputatione from the said Edward Slaney which when produced it seemed to be forged by compareing the Same with Edward Slaneyes Subscriptione to a venditione of ane fourth pairt of the Ship to him Self for all which The said Thomas Leister was putt wnder arreast but not his Ship by the Stewart And the Saids Lords haveing Considered the above representatione made by the Stewart And Likewise from the writes which were produced at the board Doe heirby approve of what the said Alexander Brand Stewart and Justiciary forsaid his Doue in this matter And appoints the said Thomas Leister now wnder a gwaird of two centinells att Kirkwall to be imediatly Delyvered to the Shirreff of Caithnes And from thence wnder a Sufficient gwaird to the next Shirreff And so from ane Shirreff to ane other untill he be delyvered to the magistrats of Edinburgh And appoints them to comitt him prisoner in ther tollbwith untill he answer for what Shall be Laird to his charge in the said mater in maner above represented
