Act and Recomendation The Lord Kinards tenents of Inchmicheall anent accompts

The Lords of his majesties privy Councill haveing Considered a report of a Committie of their oun number appointed for reviseing the accompts resting by his majesties forces to the Councill Bearing that the said Comittie haveing Considered ane account given in to them as resting be his majesties forces to the tennents of Inchmicheall in the paroch of Erroll belonging to my Lord Kinaird with the instructions and verificationes therof They Find the haill articles of the said accompt suficiently verified and proven Be the oathes and depositiones of James Wallace George Blair James Huttone, John Foord and Patrick Hutton tennents to the said Lord Kinaird within the barronie of Inchmicheall taken before two of the Commissioners of Supply for the shyre of Pearth Conforme to the said Commissioners their report produced to and Considered be the Comittie bearing that the saids tenents being sworne in presence of the saids Commissioners deponed Ilk one of them that the said accompt was truely furnished to his majesties forces and no part of the samen payed, And Finds that ther are severall articles of the said accompt instructed not only be the tenents depositiones as a forsaid But also by recepts under the hand, of the souldiers to whom these articles were furnished and finds that Conforme to the said accompt and instructiones therof Ther is resting be his majesties forces underwritten upon scots pay to the tennents of Inchmicheall The soumes Following furnished frae the seventh day of september Jaj vjc Eighty nyne to the first of november Jaj vjc nyntie years Viz Imprimis by the Lord Beilhaven’s troop of horss ane hundreth and two punds five shilling four penies scots Item by the Lord Newbotles troop of horse Thriescore punds nyne shilling scots Item by the Lord Rollos troop of horss Threttie six punds five shilling Eight penies scots Item by the Earle of argyll his regiment of foott Twentie Eight punds sixtein shilling scots Item by the Lord Cardross his regiment of Dragoons six punds scots Item by the Lord Ross his troop of horss four punds scots Item by the Earle of Eglingtoune his troop of horss Thrie pund Eight penies Scots Item by the Laird of Pollocks troope of horss four pund two shilling ten penies scots Extending the saids haill soumes due by the forces forsaids upon scots pay to the saids tennents to the soume of Two hundreth fourty four punds nyntein shilling six penies scotts And the Committie Finds that the haill articles quherof this soume is made up are in the termes of the nynth act fourth sessione of this Current parliament and of the proclamation of Councill relative therto of the date the last day of Jully Jaj vjc nyntie four years And Therfore it is ther opinion that the said soume of Two hundreth fourtie four punds nyntein shilling six penies scots is to be payed to the saids tenents of Inchmicheall belonging to the Lord Kinaird out of the present polemoney and that the saids tenents are to be recommended to the Lords Commissioners of his majesties thesaury accordingly as the said report bears The Lords of his majesties privy Councill Approves of the said report and Recomends to the Lords Commissioners of his majesties thesaury to Cause payment be made Out of the present polemoney to the saids tenents of Inchmicheall of the above soume of Two hundreth fourty four pund nyntein shilling six penies scots.

The Lords of his Majesties privy Councill having Considered a report of a Committie of their oun number appointed for reviseing the accompts resting be his majesties forces to the Countrey Bearing that the said Comittie haveing Considered the accompt given in to them as resting be the Earle of Glencairne his regiment of foot to the inhabitants of the above toune of Paisley with the instructiones and verificationes therof They Find the haill articles of the said accompt sufficiently verified and proven both be recepts and be the parties oathes except the last article being for half a Croun which is be oath without recept And also be the report of the Commissioners of Supply within the Shyre of Ranfrew Bearing that the inhabitants Creditors in the accompt instructed the haill articles therof (except the Last) before them by wryt and verified the last be the parties oath before them, And that they deponed that the articles in the accompt was furnished be them to the officers and souldiers in the Earle of Glencairne his regiment as they are Stated in the accompt dureing the space therin mentioned as weell these for which ther is wryte produced as that article for which ther is no wryt, and that the same are all truely resting and no part therof payed which account wryt recepts and report were produced to and Considered be the said Committie And Finds that the haill articles of the said accompt are all preceiding the first day of February Jaj vjc and nyntie one years, and are all in the termes of the nynth act fourth sessione of this Current parliament Entituled act for pole money dated the twentie nynth day of May Jaj vjc nyntie thrie years and of the proclamation of Councill dated the Last of Jully Jaj vjc nyntie four years relative therto And Finds that by the said accompt verified and instructed as said is, Ther is resting be the said Earle of Glencairne his said regiment to the Inhabitants within the said toune of Paisley the said soume of five hundreth fiftie two punds Eleven shilling Eight penies scots And it is the opinion of the Comittie that the said soume is to be payed to the saids inhabitants out of the said polemoney And that the saids inhabitants are to be recomended to the Lords Commissioners of ther Majesties thesaury for payment of the same accordingly as the said report in itself more fully bears. The Lords of his Majesties privy Councill having Considered a report of a Committie of ther oun number appointed for reviseing the accompts resting by his majesties forces to the Countrey Bearing that the said Committie haveing Considered the accompt given in to them as resting be his majesties forces to Adam Drumond of Meginsh and his tennents with the instructions and verificationes therof They Find that there are some articles of the said accompt stated as resting be the souldiers or troopers without Condescending upon the regiment or troop to which they belong And Therfore they have rejected these articles And Finds the haill other articles of the said accompt suficiently verified and proven either be recepts under the hands of the Souldiers or troopers or be the depositiones of the tennents taken before the Commissions of Supply within the shyre of […] Conforme to the report of the Commissioners wryten upon the end of the account and subscryved be the Commissioners Which recepts accompt and report theron2 were all produced and Considered be the Committee, And Finds that ther is resting be his majesties forces upon scots pay according as they are stated in Regiments or troopes by the said Adam Drumond Conforme to a Note written with his oun hand3 The soumes following Viz By my Lord Newbotles troop of horss the soume of fiftie five punds one shilling ten pennies scots Item by my Lord Rollo his troope of hors the soume of threttie punds fiftein shilling scots Item by the Earle of Eglingtoune his troop of horse nyntein shilling scots Item by my Lord Beilhaven his troop of horss the soume of two pund nyne shilling four pences scots Item by the Earle of Argyll his regiment of foot the soume of Eleven pund twelue shilling scots Item by the deceast Lord Cardross his regiment of dragoons one pund Eleven shilling scots, Item by the said Lord Beilhaven his said troop the soume of two pund nyntein shilling scots Item by the Lord Rollo his said troop thrie pund Eleven shilling scots Extending the saids haill soumes resting be the saids forces upon scots pay to the soume of ane Hundreth and five pund, Eightein shilling4 two penies scots, And the Committie Finds the haill articles quherof this soume is made up were all furnished preceiding the friday of February Jaj vjc nyntie one years And that they are all in the termes of the nynth act fourth session of this Current parliament entituled act for pole money and of the proclamation of Councill of the date the Last day of Jully Jaj vjc nyntie four years relative therto And Therfore Its the Committies oppinion that the said soume of ane hundred and five punds Eightein shilling two penies scots Is to be payed to the said Adam Drumond of Meginsch and his tennents out of the forsaid polemoney and that they are to be Recomended to the Lords Commissioners of his majesties thesaury for payment of the same accordingly as the said Report bears The saids Lords of his majesties privy Councill approves of the said report and Recomends to the Lords Commissioners of his majesties thesaury to cause payment be made out of the present pole money to the said5 Adam Drumond of Meginsh and his tennants of the above soume of ane hundreth five punds Eightein shilling two penies scots money.

Anent a petition given in to the Lords of their Majesties privy Councill be John Gullespie merchant in Glasgow Shewing That quher the petitioner being apprehended and incarcerat be the magistrats of Ranfrew in ther Tolbooth upon the nynteinth day of October Last by past for alledged killing of the deceast James Meinzies major to the Lord Lindsayes regiment and therupon the saids Lords haveing Recomended to the shiref of Ranfrew or his deputs to transport the petitioner prisoner from thence to the Tolbooth of Edinburgh to the intent that the petitioner might byde his tryall theranent The saids Lords were pleased to ordaine the petitioner to find suficient Cautione under the penalty of Twentie thousand merks that the petitioner should be a secure prisoner to the said shireff in his way to Edinburgh, and true it is that the petitioner did give the forsaid bond and Cautione in the termes of the forsaid act Which is now suficiently full filled haveing undergone his tryall anent the forsaid alledged Cryme being remitted to the knowledge of ane inquest and accordingly assoylzied by the Lords of Justiciary In respect of the petitioners Innocence, yet the Clerks of Councill refusses to give up the said bond without the saids Lords warrands In Respect of his having given recept therfore to the said shirreff who reported the same to him Conforme to the saids Lords act And Therfore Humbly suplimenting the saids Lords to the effect aftermentioned in The Lords of his majesties privy Councill haveing Considered this petition given in to them be the above John Gullespie They heirby Give order and warrand to their Clerks of privy Councill to delyver up the petitioner the above2 bond.

Act Jean 2 Durhame3 Against John Foubster her husband

Anent a petition given in to the Lords of his Majesties privy Councill be Jean Durhame spouse to John Foubster indwaller in Edinburgh Shewing That quher the petitioner being maried to the said John Foubster about a twelue moneth agoe or therby The said John Laying aside all fear of God and Conjugall affectione he did most barbarously and unnaturally maletreat and abuse the petitioner by beating of the petitioner in a Cruell maner, so that he4 was necessitate at length to flee to her fathers house quher the petitioner Continued untill he being touched with some sense of his unnaturall barbarity did come and acknowledge the same and promised and protested to behave himself most dutifully in time comeing notwithstanding quherof within a few dayes therafter he did returne to his former Course of lyfe and within some few weeks after he was brought to bed he did in the petitioners fathers house beat the petitioner most Cruelly and undoubtedly would have murdered the petitioner if she hade not been rescued by the petitioners brother and others in the house which being represented and Clearly proven before the shiref of Linlithgow he was Imprisoned by the said shireff in the Tolbooth of5 Linlithgow, and ther after set at Libertie upon his finding Cautione for his good behavior and albeit the petitioner was desyred by her freinds never to Cohabit with him againe, yet upon his acknowledgment of the injury done to the petitioner and his seeingly sincesyre promise, yea and often that he should behave himself dutiefully with that Love and affection due to a wife the petitioner was againe induced to Cohabit with him, notwithstanding of all which within a few dayes therafter he did againe about the midle of October Last beat the petitioner most barbarously telling the petitioner that the petitioner hade not her freinds by her to assist her, and if the petitioner hade not Cryed out for help he would have Certainly murdered the petitioner with ane sword which he hade hid in the bedd for that purpose, and which being represented to the magistrats of Edinburgh they after tryall and probatione taken in the affair did Comitt him to prisone in Edinburgh wher he is yet present And seing the petitioner and her Child Cannot Cohabit with any security of her lyfe with the said John Foubster In respect of this Cruell and inhumane barbarities practised upon the petitioner and it being nottour that the said John Foubster did severall times attempt to take away the life of his father as could be proven by a bill given in to the baillies of Edinburgh therwith produced And that the petitioner and her Child hath nothing to Subsist upon and that the said John is squandering dilapidating and puting away his Means And Therfore humbly Craveing the saids Lords would take the premisses to ther Consideratione and In Regaird of the said Circumstances of the petitioner to sequestrat so much of his means and fortune which is about seven thousand merks in money (besides his heritage in Leithweynd) for ane fond of subsistance and aliement to the petitioner and her Child as the saids Lords in their Justice shall think fitt and ordaine the same to be payed by the persones debitors to him and to order the same to be secured for ane stock to the petitioner and her Chyld seing the petitioner dare not without manifast hazard of his life and Child againe adventur to Cohabit with him as the petition bears Which being read in presence of the saids Lords They allowed the said John Foubster to see and answer the same against thursday then nixt and in the mean time allowed the Clerks of Councill to give out letters of areistment for arreisting all debts soumes of money and rents belonging to the said John ay and quhill suficient Caution be found acted in the books of privy Councill that the same shall be made furth comeing to the petitioner who haveing according Got a Copie of the said petition Gave in answers therto And the said bill and answers being read in presence of the saids Lords They Remitted the same to a Comitty of ther oun number and appoynted the petitioner to addue probatione anent the deeds of violence done to her and alsoe anent the value of his estate who accordingly haveing adduced severall famous witnesses before the Comitty They deponed according to ther depositiones extant in proces And the said John Foubster Anent a Petition given in to the Lords of his Majesties privy Councill be William Strachan of Edendiash Chamberland to the Duke of Gordon Shewing That the petitioner haveing given in the accounts of the arreirs due by the forces to the Duke of Gordons tennants with the instructions therof to Sir James Grant the dukes advocat to the effect that he might have gott the saids accompts and instructions revised and approven of by ther Lordships and payment ordered therfore and now Sir James Grant being dead his Lady refuses to give up the saids accompts and instructiones of the same being unwilling to medle with any of her husbands papers without ane order for her warrand And Therfore Humbly Craveing the saids Lords to order all the forsaids accompts and instructiones to be delivered to the petitioner who most be Comptable to the Duke therfore and Lykewayes that ther Lordships would apoint some of ther oun number to revise the said Accompts and instructions and order payment therfore according to the act of parliament theranent as the petition bears The Lords of his majesties privy Councill having Considered the above petition given in to them be the above William Strachan They heirby appoint Sir James Grants Lady to give up to the petitioner the above accompts and instructions upon inventar and recept of the same.
