Act and Recomendation The Lord Kinairds tenents of Inchsture Longforgan and Rossie etc anent accompts

The Lords of his Majesties privy Councill Haveing Considered the report of a Comittie of their oun number appointed for reviseing the accompts resting be his majesties forces to the Countrey Wherof the tenor followes The Committie haveing Considered the accompt given in to them as resting be hi majesties forces to the Lord Kinaird and his tenents in the paroches of Inchsture Longforgane and Rossie etc with the instructiones and verifications therof They Find that ther are some of the articles of the said accompt wrong in the Calcull And Therfore they have Caused amend these articles and stated the same in this report according as they are now rightly Calculate, And the Committie Finds the haill articles of the said accompt according as they are now Calculat and stated in this report suficiently verified and proven partly by the oathes and depositiones of William Alexander James Jacksones elder and younger, Androw Galloway James Grahame James Gardner and William Fyfe taken before the Commissioners of Supply within the shyre of Pearth Conforme to the saids Commissioners ther report signed be them bearing that the persones forsaids Compeired before them And Deponed that the said accompt was truely furnished be them to his Majesties forces and that ther weas no payment made of any part therof and partly both be recepts under the hands of the Souldiers and be the saids depositiones and report of the Commissioners Both which recepts and report were produced to and Considered be the said Comittie And Finds that Conforme to the saids recepts and report the are resting be his majesties forces upon scots pay to the said Lord Kinard and his tennents forsaid the soumes following viz be the Earle of Argyll his regiment of foot the soume of ane hundreth and six punds Eleven shilling four pennies scots money Item by the Lord Beilhaven his troop of horss the soume of Fourtie two punds scots money for said Item by the Earle of Eglingtoune his troop of horss the soume of nyne pund two shilling scots money forsaid Extending the haill soumes forsaid due by his Majesties forces upon scots pay to the soume of ane hundreth fiftie seven punds thretein shilling four penies scots money forsaid And the Committie Finds that all the articles quherof the last soume is made up were furnished preceiding the first day of February Jaj vjc nyntie one years and that they are all in the termes of the nynth act fourth session of this Current parliament Entituled act for polemoney and of the proclamation of Councill relative therto of the date the last day of Jully Jaj vjc nyntie four years, and Therfore It is the Committies oppinion that the above soume of ane hundreth fiftie seven punds threttein shilling four penies scots money forsaid is to be payed to the Lord Kinaird and his tennants in the paroches forsaids out of the present pole money and that his Lordship and the saids tenents are to be recomended to the Lords Commissioners of his majesties thesaury for payment of the same accordingly and the Committie Finds it suficiently instructed in maner forsaid That ther is resting be Coll Lauders regiment which was not under scots pay the soume of thretie thrie punds Twelue shilling scots money to the said Lord Kinaird and his said tennants And it is their oppinion That this should be transmitted to the kings majestie That they may Order such Courss to be taken therwith as in his Royall Wisdome he shall think fitt as the said Report in it self bears The saids Lords of his majesties privy Councill Doe heirby approve of the forsaid report And Recomends to the Lords Commissioners of his Majesties thesaury To Cause payment be made out of the present polemoney to the said Lord Kinaird and his tennents in the parochins forsaid of the above soume of ane hundreth and Fiftie seven punds thretein shilling four pennies scots resting be the scots forces and appoints the soume resting be the English forces to be transmitted to his majestie to the effect mentioned in the above report

The Lords of his majesties privy Councill haveing Considered a report of a Committie of their oun number appointed for reviseing the accompts resting by his majesties forces to the Councill Bearing that the said Comittie haveing Considered ane account given in to them as resting be his majesties forces to the tennents of Inchmicheall in the paroch of Erroll belonging to my Lord Kinaird with the instructions and verificationes therof They Find the haill articles of the said accompt suficiently verified and proven Be the oathes and depositiones of James Wallace George Blair James Huttone, John Foord and Patrick Hutton tennents to the said Lord Kinaird within the barronie of Inchmicheall taken before two of the Commissioners of Supply for the shyre of Pearth Conforme to the said Commissioners their report produced to and Considered be the Comittie bearing that the saids tenents being sworne in presence of the saids Commissioners deponed Ilk one of them that the said accompt was truely furnished to his majesties forces and no part of the samen payed, And Finds that ther are severall articles of the said accompt instructed not only be the tenents depositiones as a forsaid But also by recepts under the hand, of the souldiers to whom these articles were furnished and finds that Conforme to the said accompt and instructiones therof Ther is resting be his majesties forces underwritten upon scots pay to the tennents of Inchmicheall The soumes Following furnished frae the seventh day of september Jaj vjc Eighty nyne to the first of november Jaj vjc nyntie years Viz Imprimis by the Lord Beilhaven’s troop of horss ane hundreth and two punds five shilling four penies scots Item by the Lord Newbotles troop of horse Thriescore punds nyne shilling scots Item by the Lord Rollos troop of horss Threttie six punds five shilling Eight penies scots Item by the Earle of argyll his regiment of foott Twentie Eight punds sixtein shilling scots Item by the Lord Cardross his regiment of Dragoons six punds scots Item by the Lord Ross his troop of horss four punds scots Item by the Earle of Eglingtoune his troop of horss Thrie pund Eight penies Scots Item by the Laird of Pollocks troope of horss four pund two shilling ten penies scots Extending the saids haill soumes due by the forces forsaids upon scots pay to the saids tennents to the soume of Two hundreth fourty four punds nyntein shilling six penies scotts And the Committie Finds that the haill articles quherof this soume is made up are in the termes of the nynth act fourth sessione of this Current parliament and of the proclamation of Councill relative therto of the date the last day of Jully Jaj vjc nyntie four years And Therfore it is ther opinion that the said soume of Two hundreth fourtie four punds nyntein shilling six penies scots is to be payed to the saids tenents of Inchmicheall belonging to the Lord Kinaird out of the present polemoney and that the saids tenents are to be recommended to the Lords Commissioners of his majesties thesaury accordingly as the said report bears The Lords of his majesties privy Councill Approves of the said report and Recomends to the Lords Commissioners of his majesties thesaury to Cause payment be made Out of the present polemoney to the saids tenents of Inchmicheall of the above soume of Two hundreth fourty four pund nyntein shilling six penies scots.

Act and Recomendation anent The Toun of Kirkaldies accompts

The Lords of his Majesties privy Councill haveing Considered a report of a Committie of their oun number appointed for reviseing the accompts appointed by his Majesties forces to the Countrey Bearing that the said Committie having Considered the accompts given in to them as resting be his majesties forces to the toune and inhabitants of Kirkaldie with the instructiones and verificiationes therof They Find some of the articles of this accompt are not in the termes of the act of parliament anent the polemoney and proclamationes of Councill relateing therto and therof they have refused and rejected these articles And Finds it suficiently verified and proven be the oathes and depositiones of the saids Inhabitants taken before the Commissioners of Supply within the shyre of Fyfe Conforme to the Commissioners report signed by them produced to and Considered be the Committie That besides the articles refused and rejected as said is, Ther is yet resting be his Majesties forces upon Scots pay to the said toune and Inhabitants the soumes following viz be Collonell Cuninghame his regiment of foot the soume of Four hundreth and Fourscore punds six shilling scots Item by the deceast Earle of Marr his regiment of foot the soume of Twentie punds one Shilling six penies scots money Item by Sir William Hope his troop of horss the Soume of seventein punds five shilling scots Item By My Lord Rollo his troop of horss the soume of four pund ten shilling scots Extending altogither the saids soumes resting by the forces upon scots pay to the soume of Fyve hundreth twenty two punds two shilling six penies scots money, And the Committie Finds that the haill articles quherof the said soume is made up are all in the termes of the act of parliament Entituled act for pole money and of the proclamationes of Councill of the date the last day of Jully Jaj vjc nyntie four years relative therto, And Therfore It is the oppinion of the Committie That this soume of Fyve Hundreth Twentie two punds two shilling six pennies scots Is to be payed to the said toune and Inhabitants of Kirkaldy out of the said polemoney And that they are to be Recomended to the Lords Commissioners of his majesties thesaury for payment of the same accordingly And the Comittie Finds that ther is resting be the forces not upon scots pay furnished in maner forsaid the soumes following viz Be the Earle of Leven his regiment of foot the soume of Two hundreth thriescore on punds nyntein shilling Eight penies scots, Item by Collonell Beverage his regiment the soume of Seven punds thrie shilling scots By Collonell Ramsay’s Regiment six pund ten shilling Eight penies scots Item by the deceast Major Generall Mckay his regiments one pund four shilling scots, Item by Coll Lauders regiment fourtein punds seven shilling scots Item by the deceast Coll Balfour his regiment Threttie four punds sixtein shilling scots and ten penies Extending the haill soumes resting be the forces not upon scots pay to the Soume of thrie hundreth twentie six punds one shilling two penies scots And it is the Committies opinion that this soume is to be transmitted to the kinds majestie that he may order such courss to be taken therwith as in his Royall wisdome he shall think fitt as the said report it self more fully bears They heirby approve therof and Recommand to the Lords Commissioners of his majesties thesaury to cause payment be made out of the present polemoney to the towne and Inhabitants of Kirkaldie of the above soume of Five hundreth twentie two punds two shilling six penies scots resting by the scots forces and appoints the soume resting by the English forces to be transmitted to his majestie to the effect mentioned in the report.

The Lords of his Majesties privy Councill having Considered a report of a Committie of their oun number appointed for reviseing the accompts resting be his majesties forces to the Countrey Bearing that the said Comittie haveing Considered the accompt given in to them as resting be the Earle of Glencairne his regiment of foot to the inhabitants of the above toune of Paisley with the instructiones and verificationes therof They Find the haill articles of the said accompt sufficiently verified and proven both be recepts and be the parties oathes except the last article being for half a Croun which is be oath without recept And also be the report of the Commissioners of Supply within the Shyre of Ranfrew Bearing that the inhabitants Creditors in the accompt instructed the haill articles therof (except the Last) before them by wryt and verified the last be the parties oath before them, And that they deponed that the articles in the accompt was furnished be them to the officers and souldiers in the Earle of Glencairne his regiment as they are Stated in the accompt dureing the space therin mentioned as weell these for which ther is wryte produced as that article for which ther is no wryt, and that the same are all truely resting and no part therof payed which account wryt recepts and report were produced to and Considered be the said Committie And Finds that the haill articles of the said accompt are all preceiding the first day of February Jaj vjc and nyntie one years, and are all in the termes of the nynth act fourth sessione of this Current parliament Entituled act for pole money dated the twentie nynth day of May Jaj vjc nyntie thrie years and of the proclamation of Councill dated the Last of Jully Jaj vjc nyntie four years relative therto And Finds that by the said accompt verified and instructed as said is, Ther is resting be the said Earle of Glencairne his said regiment to the Inhabitants within the said toune of Paisley the said soume of five hundreth fiftie two punds Eleven shilling Eight penies scots And it is the opinion of the Comittie that the said soume is to be payed to the saids inhabitants out of the said polemoney And that the saids inhabitants are to be recomended to the Lords Commissioners of ther Majesties thesaury for payment of the same accordingly as the said report in itself more fully bears. Act John Gulespie merchant in Glasgow

Anent a petition given in to the Lords of their Majesties privy Councill be John Gullespie merchant in Glasgow Shewing That quher the petitioner being apprehended and incarcerat be the magistrats of Ranfrew in ther Tolbooth upon the nynteinth day of October Last by past for alledged killing of the deceast James Meinzies major to the Lord Lindsayes regiment and therupon the saids Lords haveing Recomended to the shiref of Ranfrew or his deputs to transport the petitioner prisoner from thence to the Tolbooth of Edinburgh to the intent that the petitioner might byde his tryall theranent The saids Lords were pleased to ordaine the petitioner to find suficient Cautione under the penalty of Twentie thousand merks that the petitioner should be a secure prisoner to the said shireff in his way to Edinburgh, and true it is that the petitioner did give the forsaid bond and Cautione in the termes of the forsaid act Which is now suficiently full filled haveing undergone his tryall anent the forsaid alledged Cryme being remitted to the knowledge of ane inquest and accordingly assoylzied by the Lords of Justiciary In respect of the petitioners Innocence, yet the Clerks of Councill refusses to give up the said bond without the saids Lords warrands In Respect of his having given recept therfore to the said shirreff who reported the same to him Conforme to the saids Lords act And Therfore Humbly suplimenting the saids Lords to the effect aftermentioned in The Lords of his majesties privy Councill haveing Considered this petition given in to them be the above John Gullespie They heirby Give order and warrand to their Clerks of privy Councill to delyver up the petitioner the above2 bond.
