Act The principalls and Regents of the university of St Andrews

Anent the petition given in to the Lords of his Majesties privy Councill be the principalls and professors of Philosophie and Humanity of the university of St Andrews Shewing That wher the principalls and professors of phillosophie of the said university Having lately applyed to the saids Lords for Dividing amongst them the product of the half moneths Cess Granted be act of parliament to the said university The Lords Did Remitt the Division thereof to a Committie of their oun number, Who Finding the Nett Rentall of the said half moneths Cess (after deduction of all publict burdens except the Cess) To extend to ane hundreth fourtie six punds six shilling Scots money and nyntein Chalders ten bolls and thrie firlots of victuall did divyde the Samen amongst the said two principalls and Eight Regents of philosophie as followes Viz to the two principalls The forsaid Sum of ane hundrith fourtie six pund six Shilling of money rent and Seventie four bolls and thrie firlots of victuall rent To be equally divyded betwixt them, And the rest of the victuall rent being two hundreth and Fourtie bolls To be equally divyded amongst the Eight professors of phillosophie being to each of them threttie bolls, And ordained the first payment of the said money and victuall rent to be betwixt Yuill and Candlmiss nixt Cropt and year Jaj vic Nyntie five years and Swa furth to Continue yearly in time comeing for each year. And this division being ready to be reported to the saids Lords, The Samen was Stopt upon a bill given in by the two regents of Humanity of the said university Craveing that they might have their Share and proportion of the said rent, And the principall and regents of phillosophie Considering the Justice and equity of the forsaid desire And for preventing the saids Lords Furder trouble in the said matter Have by ane muttuall agreement betwixt them and the two regents of humanity Condescended, and agreed, That each regents of humanity shall have one Chalder of victuall allowed for his share to be deduced from the severall shires of the two principalls and Eight Regents of phillosophie as they were assigned them in the forsaid division Viz from each principall four bolls and from each regent of philosophie Thrie bolls amounting in the haill to two Chalders of victuall Which the said two regents of Humanity are fully Content and satisfied with as ther proportionable shares of the rents of the Lands allready purchased by the forsaid half moneths Cess as the said agreement therwith produced would testifie And Therfore Humbly Supplicating the saids Lords to the effect aftermentioned as the said petition bears. The Lords of his Majesties privy Councill Having Considered this petition given in to them by the principalls and prophessors of Phillosophie and humanity of the university of St Androwes, With the report of a Comittie of their oun number and agreement betwixt the principalls and Regents of Phillosophie and humanity mentioned therin and produced therwith They Find that the nate rentall of the above half Moneths Cess (after deduction of all publict burdeins except the Cess) Extends to one hundreth and fourtie six punds six shilling Scots of money And nyntein Chalders Ten bolls thrie firlots of victuall and appoints the Same to be divyded amongst the principalls and regents of phillosophie and humanity in maner after following Viz To each of the saids principalls Seventie thrie punds Thrie Shilling of money And Threttie thrie bolls one Firlot Two pecks victuall And to each of the Eight Regents of Phillosophie Twentie Seven bolls victuall and to each of the two regents of Humanity Sixtein bolls amounting in all to the money and victuall Contained in the forsaid report, And Ordaines the first termes payment of the saids principalls and regents thrie Shorres of the said rent to be payed to them betwixt Yuill and Candlmiss nixt for this present instant Cropt Jaj vic Nyntie five and Swa furth yearly2 in time comeing And Ordaines letters of horning on fiftein dayes and others needfull to be direct heiron against the factor and tennents for payment therof.

Act Lord William Douglass for the Stipend of Maner

Anent a petition given in to the Lords of his majesties privy Councill be Lord William Douglass Shewing That wher the petitioner being undoubted patron of the Church and paroch of Maner, and which has been vaccant these severall years bygone; And the petitioner being resolved to apply the vaccand Stipend therof for building ane Bridg over the watter of Maner at the foot therof, Wher formerly ther was one built and is now fallen, and Which watter is oft times so great that it cannot be past, And Which is not only upon the Comon marcat road for a great part of that parish, And the greatest part of the Shire of Peebles, But likewayes the petent road to and from England for the greatest part of the western Shires of this kingdome, and the building wherof is a most necessar pious use, And it is also necessar That the saids Lords approve of the forsaid application So as the work may be presently gone about And Therfore humbly Supplicating the saids Lords to the effect aftermentioned As the petition bears The Lords of his majesties privy Councill haveing Considered the above petition given in to them be the above Lord William Douglass They hereby approve of the petitioners Resolution to apply the vaccand Stipend of the Kirk of Maner for building a bridge over the Watter of Maner at the place mentioned in the petition, And Nominats and Appoints Alexander Horssburgh younger of that ilk to whom the petitioner has given a factory To be factor for uplifting and Imploying of the vaccand Stipend of the said kirk for the years bygone And Decernes and Ordaines the heritors lifrenters titullars Tacksmen Tennants and others Lyable in payment of the said vaccant stipend To make payment of the same to the said factor for the years bygone He allwayes produceing a Decreet of Locallity And incaice ther be non ordaines the heritors and other forsaids Lyable in payment of the said Stipend To make payment of their respective proportiones therof According as they shall be Decerned by the Judge ordinary In Respect the said factor has Granted bond and found suficient Cautione acted in the books of privy Councill That he shall doe Dilligence for recovering of the said Stipend, And being recovered shall Imploy the same for building of the forsaid bridge at the place mentioned in the petition, And ordaines letters of horning on fiftein dayes to be direct at the said factors instance to the effect forsaid.

The Lords of Their Majesties privy Councill having Considered the accompt given in as resting by Livt Coll Winrahame for bread and alse furnished to the Garisone of the Castle by Katharin Wood and the deceast Sir Magnus Prince for which he stands personally ingadged to the furnishers and to which he Craves to be releived by the publict out of the pole money In Respect the same was all applyed to the use of the said Garisone and with the Livt Colls privat use Extending to the soume of ane Thousand one hundreth and Eleven punds sixtein shilling six penies scots with the oath and depositione of the said Livt Coll Bearing that the accompt and articles therof were furnished to the said Garisone in the moneth of February Jaj vjc Eightie nyne years and is yet resting and no part therof payed and that it wes all Converted to the use of the Garisone and no part therof to his oun privat use They heirby Recommend to the Lords Commissioners of their majesties thesaurie To Cause payment be made to the said Livt Coll Winrahame of the said soume of ane Thousand one hundreth and Eleven punds sixtein shilling six penies scots, out of such fonds as they shall find Just to the effect he Releive himself at the hands of the furnishers viz Catharine Wood and […] the sone of Sir Magnus Prince by paying to them their severall proportiones of the Same.

Recomendation The Lady Herbertshyre to the thesaurie

Anent a petition given in to the Lords of their Majesties privy Councill be Hellen Sinclar Lady Herbertshyre Shewing That the petitioner haveing by the saids Lords goodnes and Clemency been allowed a proportion of her oun Joynture for her aliement dureing her husbands being among the highlanders who were in armes against the government, With which aliement the petitioner did then most dutiefully accquisce But her husband haveing now by the saids Lords favor gotten allowance to receid with her and his oun small estate being all ready exhausted partly by himself and Cheifly by his sons educatione, and the puting of him in Condition to serve in the post in which he Lost his life Both in his majesties service and his veiw The petitioner hath no Competent subsistance and those who are Lyable in payment of the superplus of the petitioners small Joyntur and Scruple to pay it to the petitioner fearing they may be made Lyable for it to the publict and what she does injoy being very inconsiderable and not so much as can weell aliement both her husband and her, And the Loss of his sone Calling for a favorable Consideration from their majesties who have been far from severities to these who have not such favorable motives for their majesties bounty And Therfore Humbly Craveing the saids Lords would take the petitioners case to ther favorable Consideration and to order the small superplus of the petitioners Joyntur (which she enjoyes not by any ryt from her present husband) To be payed to the petitioner for her oun and her husbands aliement as the said petition bears The Lords of their Majesties privy Councill haveing heard and Considered the petition given in to them be the above Lady Herbertshyre They hereby Recommends to the Lords Commissioners of their majesties thesaury to Grant the desyre therof.

Act anent the shyre of Edinburghs accompts

The Lords of their Majesties privy Councill haveing Considered the accompts given in for the Inhabitants within the shire of Edinburgh as resting to them by their Majesties forces upon the scots pay, togither with the report of a Comittie of their oun number to whom it was remitted to Consider the accompts resting by their majesties forces to the Countrey who hade Considered the accompts given in by the Inhabitants within the said shyre of Edinburgh They Find that ther are some articles in these accompts which are not instructed And Therfore they have Caused delate the same, And Finds that ther are some articles stated at extraordinary rates, Which they have restricted to and Caused state at the ordinary rates, And Finds that ther are some articles stated which of their oun nature are not allowable and Therfore have Caused delite the same, And Finds that besides these articles above narratied Ther is still resting by their Majesties forces upon Scots pay to the inhabitants of the said shyre of Edinburgh (which they Find sufficiently verified and instructed partly by writ, partly by the oathes of the inhabitants, pairtly by witnesses, and pairtly by reports from the Commissioners of Supply within the said shyre and by ane attestatione subscryved by the Commissioners relateing to the saids accompts The particular soumes following Which are resting by the saids forces as they are stated in regiments and troopes to the saids inhabitants as they are ranked in parishes in maner after sett doune Viz be the Earle of Eglingtoune his troop to the inhabitants of the West Kirk parish the soume of ane Thousand and five punds five shilling and nyne penies scots, By the Laird of Gravit his Troop to the inhabitants of the said parish The soume of Fourty seven punds six shilling scots, By Coll Cuninghames regiment of foot to the inhabitants of the said parish the soume of Threttie one pund sixtein shilling scots Extending the haill soumes due to the said parish of the West Kirk To the soume of ane Thousand Eightie four punds seven shilling and nyne penies scots Item by the Laird of Gravits troop to the inhabitants of the parish of Libertoune the soume of The Lords of their Majesties privy Councill haveing Considered the accompts given in for the Inhabitants within the shire of Edinburgh as resting to them by their Majesties forces upon the scots pay, togither with the report of a Comittie of their oun number to whom it was remitted to Consider the accompts resting by their majesties forces to the Countrey who hade Considered the accompts given in by the Inhabitants within the said shyre of Edinburgh They Find that ther are some articles in these accompts which are not instructed And Therfore they have Caused delate the same, And Finds that ther are some articles stated at extraordinary rates, Which they have restricted to and Caused state at the ordinary rates, And Finds that ther are some articles stated which of their oun nature are not allowable and Therfore have Caused delite the same, And Finds that besides these articles above narratied Ther is still resting by their Majesties forces upon Scots pay to the inhabitants of the
