Orders to Deliver John Whyte to Captain Hay.

The Lords of their majesties privy Council Doe herby give order and warrand to the sherreff principall of the shyre of Haddingtoun or to the Baillies of the Toune of Haddingtoun to Deliver John Whyte presently prisoner in the Tolbooth therof to Captain Hay one of the Captaines of Collonell Douglas his Regement, to be a souldier The said Captain alwayes satisfying and paying the Jaylour fees and other dues resting by the prisoner since his Incarseration befor he come out of Prisone

Warrand for apprehending the provost and Baillies of Stirlin

The Lords of their Majesties privy Council being informed by Sir James Steuart their Majesties Advocat, That he hes precognosced severall wittnesses who Declare that John Dick present provost, Thomas Miller, James Keir and John Williamson present baillies and John Robertsone present Deacon of the fleshers in Stirlin, are guilty of drinking the late King James and the pretended Prince of Wales, their healths and other Crymes, Therfor they ordain the said provost, Baillies and Deacon to be seased upon and secured, And recomends to Sir Thomas Livingstone Comander in chieff of their Majesties forces within this kingdome to send a sufficent party of their Majesties forces horse foot or dragoons to seise upon and secure the forsaids persons and Convoy them to Edinburgh and Comitt them prisoners in the Tolbooth therof and appoints the Magistrats of Edinburgh and keeper of their Tolbooth to keep and detean the saids persons prisoners till farder order. And appoints Baillie Moir, The Dean of gild, Theauserer and remanent Councillers of the Toune of Stirlin to see to and secure the peace of the burgh of Stirlin and the administeratione of the Government ther.

The Lords of their Majesties Privy Council gives order and warrand to Sir James Stewart their Majesties Advocat, to raise and follow furth a process of high Treason befor the Lords Commissioners of Justiciary against Sir Æneas Mcphersone presently prisoner in the Tolbooth of Edinburgh and in the meantyme recomends to the Lords Commissioners of their Majesties Theausrie to Consider the condition of the said Sir Aneas and to allow him a Competent aliment if they shal find that he stands in need therof. Sic subscribitur Tweeddale cancel: Melvill P: S:, Annandale, Carmichaell, Drumlangrig, Leven, Ross, Yester, Robert Sinclair

The Lord Ross and Sir Thomas Livingston commander in Cheiff of their Majesties Forces within this Kingdome, Having verbally reported to the Lords of their Majesties privy Council, That they had spok with the provost of Stranrawer Anent the French Privateer Infesting these Coasts, and the Leivtenent and other six prisoners seized upon belonging to her, The saids Lords Recomends to the said Sir Thomas Livingstone immediatly to send a Troop of Dragoons ther to quarter for the security of the place against Privateers and other Enemies of the Government

Sir James Stewart their Majesties Advocat having acquainted the Lords of their Majesties privy Council That upon Information and by advice from the Secretary of State for this Kingdome he hes raised a process for high Treason befor the Lords Commissioners of Justiciary against […] Byres of Coats The saids Lords doe herby approve of the Lord Advocat his having raised the said process of Treason, And recomends to his Lordship to proceed and insist in the said process befor the saids Lords Commissioners Sic subscribitur Tweeddale can: Melvill P: S: Leven, Drumlangrig, Annandale, Carmichaells, Yester, Ross, Robert Sinclair.

Approbatione of the Lord Justice Clerk Imprisonment of John McDonald, And Act for his banishment

The Lord Justice Clerk having acquainted the Lords of Privy Council that one John McDonald having made a quarrell at a Chop in Edinburgh, And his Lordship being informed he had bein in the hills with the Rebells, and had not taken the benefite of the Indemnity, He gave order to seise and search him, and being seised and searched ther was found upon him a Commission granted be the Late King James to him, To be a Major dated in Januare Ja jvjc and Eighty nyn years, and likwise a pass granted to him by Collonell Hill Governor in Fort William, and that he hes therupon Committed him Prisoner to the Tolbooth of Edinburgh The Lords of their Majesties privy Councill doe herby approve of what the Lord Justice Clerk hes done in this matter And give order and warrand to the Magistrats of Edinburgh and keeper of their Tolbooth to sett the said John Mcdonald at Liberty furth therof. He first Inacting himself in the books of privy Council that he shal Imediatly upon his Liberation remove furth of this kingdome and not returne therto without his Majesties or the Councills uarrand for that Effect under the Penaltie of ane Thousand merks Scots money

Act Lord Justice Clerk To Deliver to the Lord Advocat some papers anent Sir Æneas Mcpherson

The Lord Justice Clerk haveing acquainted the Lords of their Majesties privy Council that he hes Receavd severall Papers anent Sir Æneas Mcphersone Prisoner sent from London now presently in the Tolbooth of Edinburgh, and that his Lordship hes granted receet for these papers to the Secretary of State, And that he is willing to deliver these papers Conform to the following Note or Inventar therof to any the saids Lords shall appoint wherof the Tennor followes. Imprimis Three Letters from M: Levermore, nynth and Tuenty February last, Tuo wherof Direct to him the said Sir Æneas under the name of Mr John Smith, and a Third under the name of same Levermore. Item a reply to the answer Doctor Wallwood hes made to King Jamses Declaratione, Item a Supplement to his Majesties most Gracious speech Item a Letter under his oun hand of the fiftin of Januare Last Direct to Sir E: M: uith the answer to it. Item a Letter under his oun hand of the Threttin of February Last. Item a Coppie of a Letter to the Laird of Grant under Sir Aneas hand of the fiftin of Januare Last. Which having bein done accordingly, The saids Lords Declares that ane Extract herof shall be a sufficient Exoneratione to the said Lord Justice Clerk of the saids papers and in place of a Discharge therof to him conforme to his receipt of the same to the Lord secretary.

The Council haveing called the Earle of Aboyne and his Governor and Tuo servants (who were taken coming from France and put under bale at Londone) befor them, And they haveing all appeared, The Council sent the Governor and Tuo servants to the Tolbooth of Edinburgh, and allowed the Earle to be at Libertie upon his oun Personall bond without Cautione, That he shall appear upon Thursday nixt, and in the meantyme live Peaceablie And recomended to the Earle of Anandale and Lord Justice Clerk to call for and Examine the Governor and servants, And Declares the bond granted at London to be null and Extinct by the Earle and his Governor and Servants their appearance befor the Council But ordained the same to remaine in the hands of the Clerks of Privy Council and discharges them to give it up.
