Warrand for processing Halyburtone and Frazer

Anent a petitione given In to the Lords of their Majesties privy Councell Be Sir William Lockhart Sollicitor Sir Patrick Hoome and Mr Hugh Dallrymple advocats Sheuing That albeit their Lordships by warrand the tenth of December last did appoynte the petitioners to raise a process Against Alexander Halyburton and William Frazer prisoners in the tolbooth of Edinburgh for the Crymes that may be laid to their charge yet after tryall in the matter they Find that the Greatest Cryme is treasone which by the Laues of this Kingdome must have a particular warrand aither from his Majestie or their Lordships And therfore Humblie Craving to the effect underwryten as the said petitione bears The saids Lords of their Majesties privie Councell Having Considered this petitione given In to them Be the said Sollicitor and his assistants They heirby give ordor and warrand to the said Sollicitor and his assistants Instantly to raise and uithout delay to follow furth a process upon the publict charges against Alexander Halyburtone and William Frazer prisoners in the tolbooth of Edinburgh before the Lords of Justiciarie for treasone or any other crymes that may be laid to their charges

Warrant for processing Halyburton and Fraser

Concerning a petition given in to the lords of their majesties’ privy council by Sir William Lockhart solicitor, and Sir Patrick Hume and Mr Hugh Dalrymple advocates, showing that albeit their lordships by warrant of 10 December last did appoint the petitioners to raise a process against Alexander Halyburton and William Fraser, prisoners in the tolbooth of Edinburgh, for the crimes that may be laid to their charge, yet after trial in the matter they find that the greatest crime is treason, which by the laws of this kingdom must have a particular warrant, either from his majesty or their lordships, and therefore humbly craving to the effect underwritten as the said petition bears. The said lords of their majesty’s privy council, having considered this petition given in to them by the said solicitor and his assistants, they hereby give order and warrant to the said solicitor and his assistants instantly to raise and without delay to follow forth a process upon the public charges against Alexander Halyburton and William Fraser, prisoners in the tolbooth of Edinburgh, before the lords of justiciary for treason or any other crimes that may be laid to their charges.
