Warrant
Warrant and recommendation to some councillors concerning the oath of allegiance and assurance
The lords of their majesties’ privy council, considering how much it may contribute to his majesty’s service that such as were nominated commissioners of supply should accept and qualify themselves to serve his majesty in that capacity by taking the oath of allegiance and assurance enjoined by law for that effect, and likewise by their ready obedience herein to evidence their good affection to their majesties and the government, and to be a good example to others to do the like when required thereto, therefore the said lords give warrant and recommend to the persons following, all of their own number, or any one of them for the divisions respective after mentioned viz [Sir Patrick Hume] the Lord Polwarth for the shire of Berwick; [Robert Kerr] the earl of Lothian for Roxburgh and Selkirk shires; [John Hay] the earl of Tweeddale, lord high chancellor, [John Hamilton] the Lord Belhaven, [and] Sir Robert Sinclair of Stevenston for the shire of Haddington; Sir John Lauder of Hatton and Sir John Lauder of Fountainhall for the shire of Edinburgh; [George Livingston] the earl of Linlithgow and [Henry Erskine] Lord Cardross for the shires of Linlithgow, Stirling, and Clackmannan; [George Melville] the earl of Melville, lord privy seal, [and] [Aelxander Melville] the Lord Raith, treasurer depute, for the shires of Fife and Kinross; [John Campbell] the earl of Breadalbane for Perthshire; The Earle of Strathmore for the shire of Forfar; [John Keith] the earl of Kintore for the shire of Kincairdine and Marischal’s part of Aberdeen; [Jon Hay] the earl of Erroll, [William] the master of Forbes, and Sir Thomas Burnet of Leys for the shire of Banff and the rest of Aberdeenshire; [George Mackenzie] the viscount of Tarbat, [John Gordon], Lord Strathnaver, and Sir George Monro for Ross, Sutherland, and Caithness; [Archibald Douglas] the earl of Argyll and [John Campbell] earl of Breadalbane for the shire of Argyll; [William Hamilton] the duke of Hamilton, [James Douglas] marquis of Douglas, and [John] Lord Carmichael for the shire of Lanark; Sir John Maxwell of Pollock for the shires of Dumbarton, Renfrew, and Bute; [John Kennedy] the earl of Cassills, [James Dalrymple] Lord Viscount Stair, and [Sir Hugh Campbell of Cessnock] lord justice clerk for the shires of Wigtown and Ayr, and stewartry of Kirkcudbright; [William Douglas] the duke of Queensberry and [James Douglas] the earl of Drumlanrig for the shire of Dumfries; the duke of Queensberry and [Sir Archibald Murray] laird of Blackbarony for the shire of Peebles, to call and convene at such day and place as they shall judge most convenient all those who are nominated commissioners of supply by the act of this current parliament for the shires respective abovementioned. And there to examine who of the said commissioners have already or will then qualify themselves to act as commissioners of supply and as justices of peace by taking the oath of allegiance and assurance, [so] that the places of those who do refuse may be filled up, and a judgement made of their affection to the government thereby. And that the clerk to the said commissioners of supply shall return an exact report and list to the clerks of the privy council before the second Thursday of November next of the names and designations of such as have not or shall not so qualify themselves, subscribed with his hand, certifying such as fail that it shall be reckoned a malversation in their office and infer deprivation and loss thereof. As likewise the said lords recommend to those of their own number respectively named for the shires particularly above set down to use their own endeavours with any other heritors in the several shires who are not commissioners to dispose them to evidence their duty and affection to their majesties and the government by taking the oath of allegiance and signing the assurance. And for that end to insinuate to them his majesty’s purpose and commands for pressing the said oath and assurance how far they shall find it may conduce to that end.
