Warrand to the Sollicitor to process Captain Wallace

Anent the petition given in to the Lords of there majesties privie Councill be Captain John Wallace prisoner in the tolbooth of Edinburgh Shewing That where the petitioner hes Continowed upwards of three years in a severe Imprisonement in the Bass and tolbooth of Edinburgh whereby his health is Impaired his bodie weakned and his small fortune Intirely ruined And that be frequent applicationes made be the petitioner himself to the saids Lords He wes severall tymes remitted to the Sollicitor and assessors and his Speedie tryall recomended to them at his oune earnest desyre yet hitherto there hes been no process intended againest him And sieing the petitioner hes alreadie suffered verie Considerably by a tedious Imprisonement equallie hurtfull to his persone and small fortune Notwithstanding whereof he is heartily willing for farder satisfactione to signe a voluntar banishment from all his majestyes Dominiones for ever And therefore humbly craveing that the saids Lords would be pleased to take the premises to there Consideratione And in respect of the petitioners Long Imprisonement and the great prejudice he hes sustained both in his persone and small fortune there through As also of the voluntar banishment the petitioner is willing to undertake from all his majestyes dominions under what penalty shall be thought fitt To allow the petitioner to be dismissed upon signeing the same And he shall never ceass to pray that God may bless the natione with ane Lasting peace off he shall never be a disturber As also that the saids Lords would be pleased to recomend the maister of the prisone to the Lords of theasurie for what Jayll fies shall bee due be the petitioner As the said petitione bears The Saids Lords of there Majestyes privie Councill Haveing considered this petition given in to them be the above captain John Wallace They hereby Give order and warrand to Sir William Lockhart there majestyes Sollicitor to raise a Lybell Againest the petitioner befor the Lords Comissioners of there Majestyes Justiciarie and to cause Cite the petitioner thereon betuixt and the Fourth day of Jully next

Warrant to the solicitor to process Captain Wallace

Concerning the petition given in to the lords of their majesties’ privy council by Captain John Wallace, prisoner in the tolbooth of Edinburgh, showing that where the petitioner has continued upwards of three years in a severe imprisonment in the Bass and tolbooth of Edinburgh whereby his health is impaired, his body weakened and his small fortune entirely ruined, and that by frequent applications made by the petitioner himself to the said lords, he was several times remitted to the solicitor and assessors and his speedy trial recommended to them at his own earnest desire, yet hitherto there has been no process intended against him; and seeing the petitioner has already suffered very considerably by a tedious imprisonment equally hurtful to his person and small fortune, notwithstanding whereof he is heartily willing for further satisfaction to sign a voluntary banishment from all his majesty’s dominions for ever, and therefore humbly craving that the said lords would be pleased to take the premises to their consideration and, in respect of the petitioner’s long imprisonement and the great prejudice he has sustained both in his person and small fortune therethrough, as also of the voluntary banishment the petitioner is willing to undertake from all his majesty’s dominions under what penalty shall be thought fit, to allow the petitioner to be dismissed upon signing the same and he shall never cease to pray that God may bless the nation with a lasting peace of [which] he shall never be a disturber, as also that the said lords would be pleased to recommend the master of the prison to the lords of treasury for what jail fees shall be due by the petitioner, as the said petition bears. The said lords of their majesties’ privy council, having considered this petition given in to them by the above captain John Wallace, they hereby give order and warrant to Sir William Lockhart their majesties’ solicitor to raise a libel against the petitioner before the lords commissioners of their majesties’ justiciary and to cause cite the petitioner thereon before the fourth of July next.
