Warrand to the Earl of Leven to transmit McNiccolls to Flanders

Anent a petitione given In to the Lords of their Majesties privy Councell Be David Earle of Leven Sheuing That wher ther are Incarcerat in the Cannongate tolbooth Tuo men of the name of Mcniccolls who formerly served in the Earle of Argyls Regiment and were lately apprehended and secured for thift or Rougerie And ther being none to oune or Insist against them for any Crymes they stand guiltie of And that it were a kyndness to their Countrie to disburden it of such Rogues And therfore Humblie Craving to the effect underwryten as the said petitione bears The Saids Lords of their Majesties privie Councell Having Considered the above petitione They heirby Give ordor and warrand to the Magistrats of Edinburgh Baillies of the Cannongate and Keeper of the tolbooth therof To delyver the above tuo men named Mcniccolls to the said Earle of Leven To be by his Lordship transported to Flanders for their Majesties service In respect Sir Thomas Livingstoune Commander in cheiff of their Majesties forces uithin this Kingdome hes declared that the officers of the Earle of Argyls regiment doe not requyre back the saids tuo Mcnicolls to their Regiment againe

Warrant

Warrant to [David Leslie] earl of Leven to transmit McNicolls to Flanders

Concerning a petition given in to the lords of their majesties’ privy council by David, earl of Leven showing that where there are incarcerated in the Canongate tolbooth two men of the name of McNicolls who formerly served in the earl of Argyll’s regiment and were lately apprehended and secured for theft or roguery, and there being none to own or insist against them for any crimes they stand guilty of, and that it were a kindness to their country to disburden it of such rogues, and therefore humbly craving to the effect underwritten as the said petition bears. The said lords of their majesties’ privy council having considered the above petition they hereby give order and warrant to the magistrates of Edinburgh, baillies of the Canongate and keeper of the tolbooth thereof, to deliver the above two men named McNicolls to the said earl of Leven to be by his lordship transported to Flanders for their majesties’ service in respect Sir Thomas Livingstone, commander in chief of their majesties’ forces within this kingdom has declared that the officers of the earl of Argyll’s regiment do not require back the said two McNicolls to their regiment again.
