Liberatione and warrand to the Earle of Leven to Carrie Dionisus Inglis to Flanders as a souldier

Anent a petitione Given In to the Lords of their Majesties privy Councell Be Dionisius Inglis son to the deceast Dionisius Inglis Chirurgeon Barber in Portsburgh Sheuing That quher the petitioner being Imprisoned in the tolbooth of Edinburgh and accused off and Indyted for his falsehood and forgerie of tuo notes or precepts By feignying of George Sandrie merchant in Edinburgh his hand to the samen direct to John Hay merchant ther The one dated the tenth the other the seventeenth of October last Desyring the said John Hay to delyver to him three ells of rid plush to be a paire of breeches with ane pair of silk stockings and ane hatt not exceeding tuelve shillings And the petitioner being now most sensible of his great fault In wryting and forging the saids notes Doe Humbly represent to their Lordships the true reasones and occasiones of his Committing the samen which is That the petitioner being but ane young boy not above seventeen years of age or therby and lately married to ane Gentlewoman and so redacted to ane strait and necessity And therafter falling in Company with some young men after drink was Induced to wryte the saids tuo notes which he does now heartily regrate and repent of And does throw himself upon their Majesties mercy and clemency Begging their Lordships Concurrence therin And ame heartily Content That if their Lordships would be pleased to Grant warrand to the Lords of the Justiciarie and their Majesties Sollicitor to desert the dyet against him In the proces of Forgerie pursued before them to take ane Act of banishment upon him and never to returne to Scotland under the paine of death uithout speciall Libertie from their Majesties or their Lordships And he being now in ane sadd and starving Conditione In the prisone by his long Imprisonment And having nothing wherupon to mantaine himself And the saids George Sandrie and John Hay having freely disclaimed and renunced any Intrest they have in the said process Against him as their disclamatione dated the sixteenth day of January produced with the said petitione Bears And therfore Humblie Craving their Lordships to take the premises to their serious Consideratione he being ane poor young boy To ordaine their Majesties Sollicitor and their Majesties Sollicitor to desert the dyett of the said process pursued against him before the Justice Courte And Grant warrand for his liberatione out of prisone upon his subscribing ane voluntar Act of banishment never to returne to this kingdoms uithout their Majesties or their Lordships speciall liberty as the said petitione bears The saids Lords of their Majesties privy Councell Having Considered this petitione given In to them Be the said Dionisius Inglis with the disclamatione mentioned therin and produced therwith They heirby Give ordor and warrand to the Magistrats of Edinburgh and Keeper of their tolbooth To delyver the petitioner to the Earle of Leven when his Lordship calls for him In respect the petitioner hath Inacted himself in the books of privy Counsell That he shall depart furth of their Majesties dominiones with the Earle of Levens Regiment to Flanders as a souldier in that regiment And that he shall never returne to their Majesties dominiones under the paine of death uithout their Majesties or the Councells warrand And Recommends to the Lords Commissioners of their Majesties Justiciary and their Majesties Sollicitor and their assistants to desert the dyet in the said process depending before the saids Lords of Justiciarie Against the petitioner

Liberation and warrant to [David Leslie] earl of Leven to carry Dionisus Inglis to Flanders as a soldier

Concerning a petition given in to the lords of their majesties’ privy council by Dionisius Inglis, son to the deceased Dionisius Inglis, surgeon barber in Portsburgh, showing that where the petitioner being imprisoned in the tolbooth of Edinburgh, and accused of and indicted for his falsehood and forgery of two notes or precepts by feigning of George Sandry, merchant in Edinburgh, his hand to the same directed to John Hay, merchant there the one dated the tenth the other the seventeenth of October last, desiring the said John Hay to deliver to him three ells of red plush to be a pair of breeches with a pair of silk stockings and a hat not exceeding twelve shillings, and the petitioner being now most sensible of his great fault in writing and forging the said notes, do humbly represent to their lordships the true reasons and occasions of his committing the same, which is that the petitioner being but a young boy not above seventeen years of age or thereby, and lately married to a gentlewoman and so reduced to a strait and necessity, and thereafter falling in company with some young men after drink was induced to write the said two notes, which he does now heartily regret and repent of and does throw himself upon their majesties’ mercy and clemency, begging their lordships concurrence therein, and am heartily content that if their Lordships would be pleased to grant warrant to the lords of the justiciary and their majesties’ solicitor to desert the diet against him in the process of forgery, pursued before them, to take an act of banishment upon him and never to return to Scotland under the pain of death without special liberty from their majesties or their lordships, and he being now in a sad and starving condition in the prison by his long imprisonment, and having nothing whereupon to maintain himself and the said George Sandry and John Hay having freely disclaimed and renounced any interest they have in the said process against him, as their disclamation dated 16 January produced with the said petition bears, and therefore humbly craving their lordships to take the premises to their serious consideration he being a poor young boy, to ordain their majesties’ solicitor to desert the diet of the said process pursued against him before the justice court and grant warrant for his liberation out of prison upon his subscribing a voluntary act of banishment, never to return to this kingdom without their majesties or their lordships special liberty as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the said Dionisus Inglis, with the disclamation mentioned therein and produced therewith, they hereby give order and warrant to the magistrates of Edinburgh and keeper of their tolbooth to deliver the petitioner to the earl of Leven when his lordship calls for him in respect the petitioner has enacted himself in the books of privy council that he shall depart furth of their majesties’ dominions with the earl of Leven’s regiment to Flanders as a soldier in that regiment, and that he shall never return to their majesties’ dominions under the pain of death without their majesties or the council’s warrant and recommend to the lord commissioners of their majesties’ justiciary and their majesties’ solicitor and their assistants to desert the diet in the said process depending before the said lords of justiciary against the petitioner.
