Warrand for Transporting John Gulespie

The Lords of their Majesties privy Councill Doe heirby Ordaine John Gullespie present prisoner in the Tolbooth of Ranfrew for alledged killing of Major James Meinzies To be transported to the Tolbooth of Edinburgh and for that effect ordaines the magistrats of Ranfrew to deliver the said John to the shireff principall of the shire of Ranfrew or his deputes betwixt and the twelth day of november nixt, The said John before he come furth of the said Tolbooth giving bond and finding Cautione to the magistrats of Ranfrew at the sight of Mr Francis Montgomry and Sir John Maxwell or aither of them that he shall be true prisoner to the said shireff principalls or their deputs and the guards that shall be Sett upon him be the severall shirreffs And that he shall enter himself prisoner in the Tolbooth of Edinburgh betwixt and the twelth day of november nixt to come under the penaltie of Twentie Thousand merks incaise he shall transgress in any part of the premisses And Ordaines the said shireff principall of Ranfrew or his depute to put the said John Gillespie under a suficient guaird and to Convey him to the nixt Shyre, and deliver him to the Shireff principall therof or his deputs And so appoints him to be Conveyed from sheriff to shireff untill he come to Edinburgh and ordaines the magistrats of Edinburgh and keeper of their Tolbooth to receive the said John Gillespie from the said Guaird, and to hold and detaine him prisoner in their Tolbooth And Ordaines the magistrats of Ranfrew to transmitt to the Clerks of privy Councill the bond that they shall receive from the said John Imediatly upon their recept therof.

Procedure

Approbatione of the Lord Advocat causeing ship Seatone and Darville in order to their Banishment.

Sir James Stueart their majesties Advocat Haveing represented to the Councill That He had Caused ship aboard the Golden lyone of Leith which is to saill with this fleet that is presently goeing to Holland whereof James Kendell is master The persones of Master James Seatone and Francis Darville reputed to be Preists and who were prisoners in the Tolbooth of Edinburgh and who by sentance of Councill of the eleventh of October instant are banished furth of this Kingdome and appoynted to give bond and Cautione That they shall depart with this fleet In respect the said two persones declaired they were not able to find Cautione and that his Lordship hes taken their oblidgement That they shall returne to the Clerks of Councill a Certificat of their arryvale at Holland under the Hands of the magistrats where they shall arryve which he hes delyvered to the said Clerks The Lords of their Majesties privy Councill doe Hereby approve of what the Lord Advocat hes done in this matter as above narrated.

The Lords of their Majesties privy Councill doe hereby allow Master Collin McKenzie Uncle to the Earle of Seaforth presently confyned to the house of Harbertshyre and two myles about the same To repaire to the burgh of Edinburgh and To remaine confyned thereat and two myles about the same untill the first day of December next to come for doeing of his necessarie affaires The said Master Colline first before His comeing from his former confynment giveing bond and finding sufficient cautione acted in the books of privy Councill That He shall remaine confyned within the said burgh of Edinburgh and two myles about the same and not goe without the bounds thereof untill the said first day of December next and that immediatly therafter he shall repaire to His said house of Harbertshyre and remaine confyned thereat and two myles about the same and not goe without the bounds thereof and that he shall appear before the said Lords of their Majesties privey Councill when called for and in the mean tyme That he shall live peaceablie under and with all submissione to the present Government of their majesties King William and Queen Marie and that He shall not act consult nor contryve any thing in prejudice thereof nor converse nor correspond with any Rebells under the penalty of fyve thousand merks scots in case He should transgress in any part of the premisses

The Lords of their majesties privy Councill Doe Hereby allow Charles Earle of Abboyne To remain within the tolbooth of Edinburgh for doeing of his necessarie affaires untill the fourteen day of November next to come inclusive. The said Earle first giving bond and finding sufficient Cautione acted in the books of privy Councill That He shall remaine in and not without the said toune of Edinburgh dureing the said space and immediatlie after his departure from the said City that he shall repare straight to one or other of the Earle of Strathmore his houses of Glames or Castle Lyon where the said Earle shall be residing for the tyme and remaine confyned thereat and sex myles about the same To which Houses he is confyned with consent and at desyre of the Earle of Strathmore conforme to the former interloquitor of Councill of the date the nynth day of October instant and that the said Earle of Abboyne shall appear before the said Lords of their majesties privy Councill when called for and in the mean tyme That He shall live peaceablie under and with all submissione to the present Goverment of their majesties King William and Queen Mary and that He shall not act, consult nor contryve any thing in prejudice thereof nor converse or correspond with any rebells under the penalty of ane thousand pounds starling money in case He shall transgress in any part of the premisses.

Protection Gairden of Ballamoir

Anent the petitione presented to the Lords of his Majesties privy Councill by William Gairden of Ballamoire Shewing2 that where the said petitioner was ceitted to compear before the said Lords upon the tuentie second day of November upon ane lybell raised at the instance of John and William Ewens sones to the deceast James Ewen Indweller in the Insh of Glenmuick and William Ewen their Uncle, and the said petitioner being under Captione could neither compear before the said Lords nor advyse with any of his Lauiers anent the raiseing of a reconventione or drawing his defences unless the said Lords grant him ane protectione and which the said Lords were alwayes in use to grant to persons in the saids petitioners Circumstances And seeing the Coppie of the lybell the petitioner hes received under the hand of William Dougal messinger does instantly verifie that there is a depending proces againes the said petitioner And therfore Humblie Craveing That the said Lords would take the premisses to their serious Consideratione and grant the petitioner ane protectione to continue till the first day of December They Lords of their Majesties privy Councill Haveing considered the abovewryten petitione given in to them by the said William Garden of Balamoir They Hereby Grant protectione to the said petitioner untill the threttieth day of November next to come exclusive and Discharged all macers messingers officers of burgh or Landward or other Executors of the Law To put any Letters of Captione acts of warding or other personall dilligence to executione against the said petitioners persone untill the said day Excepting alwayes their Majesties rents and publick dues sic subscribitur Tweeddale Cancel Ipd Sutherland Morton Leven Broadalban Tarbat James Stueart Adam Cockburne Archibald Murray

Proclamatione Adjourneing the parliament

The proclamatione afterinsert was approven and signed and appoynted to be recorded whereof the tenor followeth A proclamatione adjourneing the parliament to the 13th of December 1694 William and Mary by the Grace of God King and Queen of great Brittain France and Ireland defenders of the Faith To our Lyon King at armes and his brethren Heraulds macers of our privy Councill pursevants messingers at armes our shiriffs in that part conjunctlly and severally specially constitute greeting Forasmuch as we by our proclamatione of the date the tuenty fourth day of July Last with advyce of the Lords of our privy Councill Did adjourn the Currant parliament of this our ancient Kingdome untill the tuenty fyfth day of October instant and our affairs not requyring the meeting therof at that tyme, We have thought fitt That the adjournment thereof shall be till the thretteen day of December next to come Therfore We with advyce of the Lords of our privy Councille Doe hereby Adjourn our said currant parliament untill the said thretten day of December next ensueing the date hereof Requyreing all the members of our said parliament to attend that day in the usuall way and under the certificatione contained in the severall acts of parliament made theranent Our will is Herefore and we charge you strictly and Command That incontinent these our Letters seen ye pass to the marcat cross of Edinburgh and to the marcat Crosses of the remanent head burghs of the severall shyres of this our ancient Kingdome and there by open proclamatione make intimatione That our said parliament of this Kingdome is adjourned to the said thretteen day of December next to come and ordaine these presents to be printed Given under our Signet at Edinburgh the threttie day of October and of our Reigne the sexth year sic subscribitur Tweddale Cancell Drumlanrig Southerland Morton Strathmore Leven Broadalbine Tarbatt Carmichaell James Stueart Adam Cockburn.
