Act anent accompts resting to the burgh of Forres

The Lords of his majesties privie Councell haveing considered the report of a comittie of ther own number appointed for reviseing of the accompts resting be his majesties forces to the countrie Beareing That the Comittie haveing considered the accompts given in to them as resting be his majesties forces to the inhabitants of the burgh of Forres with the instructiones and verificationes therof They find that ther are Severall articles of the said accompt which are not in the termes of the act of parliament anent polemoney and proclamations of Councell relative therto And Therfore They have refwised and rejected these articles And finds ther are Severall articles of the said accompt resting be forces not upon Scotts pay as to which the pairties doe not insist In respect ther is nothing to be payed for them out of the polemoney And finds the haill articles of the saids accompts Sufficiently verified and proven be the oaths and depositiones of the inhabitants of the said burgh of Forres taken befor the Commissioners of Supply within the Shyre of Elgine Conforme to the Comissioners report Signed by them upon the end of the Said accompt And Some of them both by depositiones and also by recepts And finds Some of the articles of the said accompt are proven by recepts or obleisements besydes the oathes All which accompt report and recepts uere all produced to and considered be the Said Comittie And finds that conforme to the said accompt and instructiones ther is resting be his majesties forces upon Scotts pay (by and attour the articles refwised and rejected as said is And also by and attour the articles furnished to his Majesties forces which were not upon Scotts pay) to the inhabitants of the said burgh of Forres The Soumes following viz Item The Viscount of Kenmure his regiment of foot the Soume of Sixtein punds eightein Shilling Scotts Item be the deceast Lord Cardross regiment of Dragownes One hundereth and fiftie one punds Six pennies Item be Major Stewarts troupe fourtein punds two Shilling Scotts Item be Captaine Burnets trowpe Two punds eight Shilling Scotts Item be The Lord Yesters troupe five punds eleven Shilling Scotts Item by My Lord Roberts troupe Ane Hundered and twentie punds Sixtein Shilling two pennies Item by The Laird of Grants regiment Six Hundereth Seventie Six punds Seventyne Shilling ten pennies Scotts Item by Collonell Shilling two pennies Scotts And the comittie Finds that the haill articles wherof This Last Soume is made up were all furnished preceeding the first day of February Jaj vic nyntie one yeirs And that they are all in the termes of the nynth act fourth Sessione of this current parliament intituled act for polemoney and proclamationes of Counsell relative therto And that therfor it is the Comitties opinion that the Said Soume of Ane Thousand Six Hundereth and Seventie give punds Six Shilling two pennies Scotts is to be payed owt of the polemoney And that the inhabitants of the said burgh of Forres are to be appointed anent the polemoney for payment to them of the Samen accordingly And findes that besydes the articles foirsaids ther is resting be the deceast Lord Cardross his regiment of Dragownes to the Saids inhabitants of Forres for cornes eaten and destroyed The Soume of Twentie thrie punds Six Shilling eight pennies Item be the Maister of Forbes his troupe for pease and beans eaten and distroyed Twentie punds Scotts And the Comittie Leaves to The Lords of his majesties privie Councell to determine in what maner And out of what fond the Saids Soumes are to be payed And finds that besydes the articles forsaids ther is stated as resting be Collonell Cwnnighams regiment of Horse to the inhabitants forsaids the Soume of Six pund Sixtein Shilling Scotts And Seing it is notour that Collonell Cwningham was not a Collonell of horse but only of foot And that his foot regiment is alreadie stated thir accompts Therfore it is ther opinion that the this article should aither be refwsed or that the pairties should be allowed a day for proveing to whom the Same was furnished As the said report bears The Lords of his majesties privie Counsell haveing considered the above report They approve therof As to the said Soume of Ane Thousand Six Hundereth Seventie five punds Scotts And recomends to the Comissioners of parliament appointed anent the said pole money imposed in anno Jaj vic nyntie thrie yeirs To cause make payment of the said soumes to the above inhabitants of the burgh of Forres out of the said pole money And the saids Lords hereby refwses the The Lords of his majesties privie Counsell haveing considered the report of a comittie of ther own number appointed for reviseing of the accompts resting by his majesties forces to the countrie Bearing That the comittie haveing considered the accompts given in to them as resting be his majesties forces efternamed to William Mcintosh of Borlum and John Mcintosh of Loynbilg his brother and ther tenents in the Lands of Reatts and Loynbilg in the Shyre of Invernes and Lordshipe of Badenoch for cornes Straw meat and other provisiones advanced and furnished to the saids forces with the instructiones and verificationes the saids accompts They find it sufficiently verified and proven by the oathes and depositiones of the said William Mcintosh of Borlum and his saids tenents in the saids Lands of Reatts and Loynbilg taken before the Comissioners of Supply within the Shyre of Invernes that ther was furnished to the forces following Viz The Laird of Grant with Five Hundered foot of his men Leivetennent Collonell Lwmsden with Thrie Hundereth of Strathnavers regiment of foot Major Monro with Two hundereth of Kenmwires regiment Thrie Hundered foot out of Collonell Lawders regiment Major Generall Mckay his regiment and Ramsayes regiment comanded by Captaine Corbett Captain Graham and Cardross his regiment of Dragownes comanded by Leivetennent Collonell Jacksone The maister of Forbes his troupe Edinglassies troupe Elphingstownes troupe And Bellhavens troupe in forradge meat and other necessar provisiones haveing qwartered and lyen Locallie upon The Saids Lands the twentie eight twentie nynth and threttie dayes of September And first and third Dayes of October Jaj vic and nyntie yeirs The Soume of four Thousand Thrie hundereth and Eleven punds contained in ane particular accompt produced to the Comissioners which accompt and report both now Subscribed by thrie of the saids Comissioners (the accompt when it was first produced wanted Subscriptiones but by order of the comittie was given up to the pairtie and returned Subscribed) were produced to And considered be the comittie And the comittie finds that the totall Soume forsaid of the said accompt and which is also insert in the said report does exceed the prices allowed by the privie Councell to have bein furnished to the forces for the Space above Settdowne And findes that ther are two baggadae2 horses insert in the accompt And therfore the Comittie have rejected the baggadge horses and have restricted the accompt to the prices or rates allowed by the privie Counsell reckning the foot at four Shilling per diem And the horse and man togither at ten Shilling per diem reckning no more for the officers then for the Souldiers And finds that efter rejecting the baggadge horses and efter restricting the accompt to the Councells rates and recknings as said is ther will be resting by his majesties forces foirsaids which were upon Scotts pay to the Said William Mcintosh of Borlum and his tenents in the Saids Lands of Raits and Loynvilg the Soume of Two thousand Six hundred and fiftie punds Scotts money And it is the opinion of the comittie that this Soume being due by forces upon Scotts pay is to be allowed out of the polemoney And that the said William Mcintosh of Borlim and his saids tenents are to be recomended to The Lords comissioners of his majesties thesaurie for payment of the Same accordingly Item be his majesties forces forsaids which were not upon Scotts pay the Soume of Ane thousand and five hundereth punds Scotts money forsaid And the comittie are of opinion that this is to be transmitted to his majestie in the termes of the proclamations of Councill That he may give Such orders theranent as in his royall wisdome he Shall think fitt The Lords of his majesties privie Councell heirby approve of the above report And recomends the Comissioners of parliament appointed anent the pole money imposed in anno Jaj vic nyntie thrie to causem ake payment to the above William Mcintosh of Borlim and his tenents of the Said Soume of Two Thousand Six hundereth and fiftie punds Scotts resting be his majesties forces upon Scotts pay out of the Said polemoney imposed in anno Jaj vic and nyntie thrie And appoints the Said Soume of Ane Thousand five hundereth punds Scotts furnished to the forces which were not upon Scotts pay to be transmitted his majestie in the termes of the proclamationes of Counsell that his majestie may give Such orders theranent as in his royall wisdome Shall think fitt.

The Lords of his majesties privie Councell haveing considered the report of a comittie of ther own number appointed for reviseing of the accompts resting be his majesties forces to the Cowntrie Bearing that the comittie haveing considered Ane recept Subscrived be David Ross of Ballnagowne wherby he grants that for the mentaining of that Hundereth men of his two companies in his majesties Service Mr Alexander Ross Leivetennent to the said Hundereth men hes receaved from James Mckenzie in Meickletarrell fourtie and bolls oat meall Dated the nynth day of Aprile Jaj vic nyntie yeirs with a report Subscribed by the Comissioners of Supply of the Eastern divisione of Ross Shyre Beareing that the said Mr Alexander Ross Did take from the said James Mckenzie the number of fiftie bolls oatmeall at six punds per boll to the which report The Said Laird of Ballnagowne is one of the Subscriveing Comissioners Togither with a missive Letter be Ballnagowne to Sir Thomas Livingston relateing to the comissioners report And intreating Sir Thomas his assistance to gett the fiftie bolls meall allowed owt of the polemoney They give ther opinion That the price of the said Fiftie bolls meall extending at six punds per boll to the Soume of Thrie Hundereth punds Scotts money as to be payed to the said James Mckenzie out of the present pole money And that he is to be recommended to The Lords Comissioners of his majesties Thesaurie for payment of the same Accordingly As the said Report Beares. The Lords of his majesties privie Councell haveing Considered a representatione and qweries given in to them be Leivetennent Collonell Areskein preses to a court of the Comissioners of Justiciary for secureing the peace of the Highlands Holden at Ballawnder the Sixth day of September Jaj vic nyntie five yeirs Anent a proces Depending before the saids Comissioners against John Drum in Burnfoot of Boqwhane and William Cwngingham of Bwchan his maister anent a Stollen horse They herby Decern and ordain the said John Drum to restore and redeliver the horse Stollen frae Donald Cameron in Camoborain in Rennoch and bought frae Patrick Glass who Stealled the same back again to the said Donald Cameron frae whom the same was Stollen And that in respect that the said Patrick Glass is seased upon and comitted prisoner Since the said horse was Stollen and sold And haveing assoillied And heirby assoillies the said John Drum And the said William Cwningham of Bwqwhan his maister from the haill other pointes and articles of the said lybell raised befor the saids Comissioners of Justiciary And declaires them qwyte therof and frie therfrae in all tyme comeing And Discharges any proces intented or to be intented against them befor any other Judges anent the Stealling of the foirsaid horse or others Lybelled Reserveing allways actione Against the said Patrick Glass for the price of the said Stollen Horse

and verifications therof They Find the haill articles of the saids accompts so farr as concernes the forces upon scots pay sufficiently verified and proven partly by wryt under the hands of the Souldiers of their officers and partly by the oathes and depositiones of the saids inhabitants taken before the Commissioners of supply within the shyre of Elgine and Forress Conforme to the The Lords of his Majesties privy Councill having Considered the report of a Comittie of ther oun number to whom it wes appoynted for reviseing the accompts resting be his Majesties forces to the Countrey Bearing That the Committie haveing Considered Bearing That the Committie haveing Considered the accompts given in to them as resting be the deceast Lord Cardross his Dragoons, and the Gentlmen of the Lord Beilhaven his troope of horss which were both upon scots pay To the inhabitants within the burgh of Banff with the instructiones and verifications therof They Find the haill articles of the saids accompts suficiently verified and proven be the tickets recepts or subscryved accompts and be the Report of the Commissioners of supply within the shire of Banff Bearing that they have seen the principall tickets Contained in the accompt now given in to the Committie which instructs the same to be truely resting owing and that they have taken the oathes and depositiones of the saids inhabitants That the saids troops were quartered upon them the moneths weeks and dayes mentioned in the accompts and that the accompts and tickets were granted for true and Just Soumes and that the same were truely furnished be the saids inhabitants to the souldiers and as yet resting unpayed, Which accompt tickets recepts and report were produced to and Considered be the said Committie, And Finds that the haill articles of the saids accompts furnished to the said deceast Lord Cardross his regiment of Dragoons are all preceiding the first day of February Jaj vjc nyntie one years. The Lords of his Majesties privy Councill having Considered the report of a Committie of their oun number appointed for reviseing the accompts resting be his Maties forces to the Countrey Bearing That the Committie having Considered the accompts given in to them as resting be their majesties forces to the inhabitants within the burgh of Dundie with the instructiones and verificationes of these accompts, They Find that ther are some articles which are not suficiently instructed and therfore they have refused to allow the same and Finds that other articles in the said accompt which are not in the termes of the Councills proclamationes And Therfore they have refused these also And Finds that besides the articles refused as said is, Ther are still resting be the officers and souldiers of their majesties forces upon scots pay as they are stated in regiments and troops in maner after settdoune to the inhabitants of the said burgh of Dundie the soumes following viz by the Earle of Anandale his troop of Horss the Soume of ane thousand nyne hundreth and threttie two pounds thretein shilling ane penny scots money Item by my Lord Ross his troop of horss the soume of six hundreth thrie score sixtein punds five shilling two penies scots money forsaid Item by my Lord Beilhaven his troope of horss The soume of Eight hundreth threttie Eight punds four shilling seven pennies Scots money forsaid Item by the Earle of Eglingtoune his troop of horss the soume of four pund fiftein shilling scots money forsaid Item by the deceast Lord Cardross his regiment of Dragoons the soume of Two hundreth fiftie thrie punds nyntein shilling scots money forsaid Item by the Earle of Glencairne his regiment the soume of Fourtie five punds six shilling six penies scots money forsaid Item by the Earle of Marr now deceased his regiment of foot the soume of Four hundreth Fourtein punds one shilling six pennies scots money forsaid Item by Coll Richard Cuninghame his regiment Twentie Eight punds scots money forsaid Extending the haill soumes forsaids resting be their majesties forces upon scots pay to the inhabitants of the said burgh of Dundie altogither to the soume of Four Thousand ane hundreth nyntie thrie punds four shilling four penies Scots money forsaid, And the Committie Finds that the haill articles of the saids accompts quherof the said totall soumes is made up are suficiently verified and proven partly by recepts tickets or obleisments or subtotal accompts under the hands of the officers or souldiers themselves and partly by the oathes and depositiones of the saids inhabitants Conforme to Clear and distinct reports subscryved be the Commissioners of Supply of the shyre of […] bearing the haill inhabitants to have deponed before them that the saids articles were truely furnished be them and that the same are yet resting and partly both by writt of the officers or Souldiers, and be the oathes of the inhabitants And Finds that the haill articles forsaids were all furnished preceiding the first day of February Jaj vjc nyntie one years and that they are all in the termes of the nynth act fourth sessione of this Current parliament Intituled act for polemoney, and of the proclamationes of Councill relative therto dated the last day of Jully Jaj vjc nyntie four years And Therfore It is the Comitties opinion that the said totall Soume of Four Thousand ane Hundreth nyntie thrie punds four shilling four penies scots money forsaid is to be payed to the inhabitants of the said burgh of Dundie out of the said polemoney and that the saids inhabitants are to be Recomended to the Lords Commissioners of their Majesties thesaury for payment of the same accordingly as the said report in it self more fully proports They approve of the said report and Recommends to the Lords Commissioners of their majesties thesaury To Cause payment be made out of the present pole money to the saids Inhabitants of the above Soume of Four Thousand ane hundreth and nyntie punds four shilling four penies scots.
