Act Stewart and other wittnesses against Auchlossin

Anent the petitione given in to the Lords of his majesties privie Counsell be David Stewart John Mackbean and James Thomsone merchant in Invernes Shewing that Robert Ross of Auchlossin haveing raised a proces before ther Lordships with concourse of his majesties advocat against Alexander Lessly of Balchrome upon the twentie Eight day of Aprile Last bypast upon what accompt they know not yet they are charged as wittnesss to compeare at his instance befor ther Lordships at Edinburgh upon the twentie fifth day of this instant As the coppies therwith produced will testifie To which charge they gave obedience by appeareing here the said day Notwithstanding wherof the said Robert Ross did neither appeare himself nor report the foirsaids Letters to the clerks of Counsell By all which the petitioners who Live at Innvernes at Sixscore mylls distant and who had ther Summer mercats to attend Are at ane great Loss besydes ther expensses in comeing and goeing And they have Just grownd to alleadge the charges were Laid on them owt of malice and prejudice And therfor Humbly craveing ther Lordships not only to discharge them of this instance But also of all furder trouble from the said Robert Ross in the mater of the said Complaint And also to modifie Lairge expensses for ther comeing and goeing And for the dammadges they have Sustained by the Loss of her mercats occasioned by so malitiows a charge As the said petitione bears Which being this day red and considered be the saids Lords of privie Counsell They heirby Decerne and ordaine Alexander Ross of Awchlossin to make payment and Satisfactione to each of the saids thrie petitioners of the Soume of Sixtein Shilling Scotts money per diem frae the twentie fifth Day of Jwny Last bypast being the Day to which they were cited to have compeared to the day and date heirof And for the Space of Six dayes efter the Day and date heirof which the Saids Lords of privie Counsell allowed for the petitioner her travelling from Innvernes to this place and returneing back again2 twentie Dayes to each of the Saids thrie persones Extending the Soumes to be payed be Awchlossine to the Saids petitioners to the Soume of Sixtein pwnds Scotts money for each of the Saids petitioners And extending altogither to the Sowme of Fowrtie eight pwnds Scotts money foirsaid And ordains Letters of horning on fiftein dayes and other executorialls needfull wnder the Signet of privie Counsell to be direct hereon in forme as effeirs

Recomendatione anent accomptts In favors of The Shyre of Cromarty

The Lords of his Majesties privy Councill having Considered the report of their oun number appointed for revising the acomptts resting be his majesties forces to the Countrey Bearing That the Committie having Considered a Report of the Commissioners of supply within the Shyre of Cromartie proceding upon ane act and Commission granted be the Lords of his majesties privy Councill to them of the date the thretie day of December Jaj vjc nyntie years with ane acomptt Drawen off the said Report They Find that ther are severall articles in the said report and accompt Drawen of the same which2 by the act of parliament anent the polemoney and proclamationes of Councill relative therto are not to be allowed out of the said polemoney And Therfore they have refused and rejected these articles and Finding that some of the articles of the said report and accomptt drawen of the same were wrong in the Calcule, Therfore they have made a ryt Calcule of these articles and have stated them as they are no right Calculate And Finding that ther are severall articles stated as resting to the Viscount of Tarbat and his tenents they at the desyre of the Viscount himself did delite all these articles In Respect that the declared that he hade retained the Herth money payable out of his lands for payment of the sumes in these articles and protested if at any time heirafter the said Herthmoney shall be exacted then he shall have a liberty to state and Crave payment of these articles albeit the time for ingiving of accompts be then elapsed seing the same has been once timeously given in and Finds that Conforme to the said Report and accomptt drawen off the same and other accomptts and instructiones produced to and Considered by the Committie That ther is resting by his majesties forces upon Intituled act for polemoney and proclamationes of Councill relative therto, And Therfore Its the Committies oppinion that the said sum of One Thousand and nyntie nyne punds one shilling scots Is to be payed out of the said polemoney And that the saids heritors and other inhabitants are to be Recomended to the Lords Commissioners of his majesties thesaury for payment of the same accordingly And the Committie Finds by the said Report of the Commissioners of Cromarty that ther was furnished by the heritors tenants and other inhabitants forsaids to the magizin at Inverness preceiding the said first day of February Jaj vjc nyntie one years Corne and straw to the value of Thrie hundreth nyntie six punds seven shilling six penies scots And the Committie Leaves to the Lords of his majesties privy Councill to determine how this Last sum Is to be payed and out of what fond, as the said report bears The saids Lords Doe heirby approve of the said report and Recomends to the Commissioners of parliament appointed anent the polemoney To Cause make payment of the sum of one Thousand and Fourscore nyntein punds one shilling scots to the said inhabitants stated in the report as resting by his majesties forces upon scots pay to them and hat out of the said polemoney And for the sum of Thrie hundreth and nyntie six pund seven shilling six penies scots for Corn and straw given in to the magizin at Inverness Reserves action to the persons forsaids against the magizin keeper as accords in law.

have refused and rejected these articles And Finds that the haill articles of the saids accompts suficiently verified and proven be the oathes and depositions of the persones furnishers therof taken before the Commissioners of supply within the shyre of Kincardin Conforme to the reports of the saids Commissioners besides severall recepts all quhich accompts reports and recepts were produced to and Considered be the said Comittie And Finds that Conforme to the saids accomptts and instructions therof ther is yet resting by his majesties forces upon scots pay to the heritors tenants and hundreth Thriescore five punds scots Item be Captain Burnet his troop of horss two punds scots Item by the deceast Lord Cardross his regiment of Dragoons the sum of ane hundreth twentie Eight punds five shilling scots Extending the saids thrie sums to the sum of Two hundreth and Fourscore fiftein punds five shilling money forsaid And it is the Committies opinion that the sum Is to be payed to the said Androw Strachan out of the polemoney And that he is to be Recomended to the Lords Commissioners of his majesties thesaury for that effect In Respect that albeit the same be for corne and the said polemoney And Likewayes Recomends to them to Cause pay to Androw Strachan designed in the report the sum of Two hundred Fourscore fiftein pund five shilling scots stated in the report for Corne and straw furnished be him to the saids forces on scots pay and that out of the siad polemoney and as to the Threttie thrie pund Eleven penies Given in to the magizin for corne and straw Reserves action against the keeper of the magizin for the same as accords in Law.

The Lords of his Majesties privy Councill having Considered the report of a Committie of their oun number appointed for reviseing the accompts 2 resting be his majesties forces to the Countrey Bearing That the Comittie having Considered the accompts given in to them as resting by his majesties forces to the Inhabitants within the paroches of St Ninians, Kippon Gorgonockk Logie, Airth and places adjacent in the shyre of Stirling with the instructiones and verificationes therof They Find that ther are severall articles in the saids accompts stated above the rates allowed be the Lords of privy Councill And Therfore they have restricted these articles to the Councills rates, and Finds that ther are severall articles in these accompts which are wrong in the Calcul of the sums and therfore they have Caused amend these soumes and stated them according as they are now rightly Calculat and Finds that ther are severall articles stated in thir accompts as resting to […] Glass of Sauchie and his tenents Which articles being stated in a district accompt by themselves are allready revised by the Committie And Therfore they have omitted these articles out of this report, and Finds that ther The Inhabitants of Dunovan, Boards, Dennie Catscleugh Borland, Myredyke Steall Bankhead, Bromage tenents of Quarrell, Woodside, Kirkland and Kinaird Inhabitants of Lethem; Bothkener Westertoune parish of Airth Belsdyke Newtoune, Belsyde Pocknabe Pasculies Hygins Inch Lacker Rassull Ballmitchell Bunahill Whin Stonrig Hillhouse Burne and Sumerhouse with the instructiones and verifications of the the sum of Thrie Thousand one hundreth and Fiftie punds Eleven shilling six penies scots and the Committie Finds that the haill articles quherof this last sum is made up were all furnished preceiding the first day of February Jaj vjc nyntie one years and that they are all in the termes of the nynth at fourth sessione of this Curent parliament 4 Intitulled act for pole money and of the proclamations of Councill relative therto And Therfore Its the Committies opinion that the said sum of Thrie thousand ane hundreth and fiftie punds Eleven shilling six penies scots as to be payed out of the said pollmoney And that the persones forsaids Creditors in the saids accompts Inhabitants of the toune and above paroch of Falkirk and tenants and inhabitants of the baronies and bounds particularly abovenamed are to be recomended to the Lords Commissioners of his majesties thesaury for payment of the same accordingly And the Committie Finds that besides the articles forsaids extending as said is Ther is resting by the officers afternamed to the persones after mentioned the soumes following Viz be the Laird of Ardkindlass one of the Captains in the Earle of Argyll his Regiment of foot to Androw Buchanan armourer in Falkirk for two swords twelue punds scots Item be Livd Lamont in the same regiment to George Ranie of Catscleugh for two bridles with a new sadle and wholl furniture therof taken away by the said Livt from the said Androw the like soume of twelue punds scots Item by Captain Home in the deceast Lord Angus his regiment to John Knox merchant in Falkirk Eleven punds four shilling Item by Captain Kay in the same regiment to the said John Five punds twelue shilling And the Committie are of opinion that thir articles are not to be allowed out of the polemoney in generall but that it be recomended to the Lords Commissioners of his majesties thesaury to detaine as much of the pay resting to the saids officers (if any be) as will satisfie the saids articles and that they make payment of the same to the persones forsaids Creditors therin, as the said report bears The Lords of his majesties privy Councill Doe heirby approve therof And Recomends to the Commissioners of parliament appointed anent the polmoney to Cause pay to the persones forsaids The soum of Thrie thousand one hundred and Fiftie punds Eleven shilling six penies scots stated in the said report as resting be his majesties forces upon scots pay to them and that out of the polemoney And Recomends to the saids Commissioners to detaine as much of the pay resting to the officers named in the report (if any be) as will satisife the sumes in the articles in the said report resting be them to the persones therin named
