Recomendation anent accompts In favors of the Westerne Division of Ross shyre

The Lords of his Majesties privy Councill having Considered the report of a Committie of ther oun number appointed for reviseing the accompts resting be his majesties forces to the Countrey Bearing Considered the report of the Commissioners of supply within the shyre of Ross proceiding upon ane act and Commission granted be the Lords of his majesties privy Councill to them of the date the thretie of December Jaj vjc nyntie years with ane accompt drawen off the said report They Find that ther are severall articles in the said report and accompt drawen of the same which by the act of parliament anent the polemoney, And proclamations of Councill relative therto are not to be allowed out of the said polemoney And Therfore they have refused and rejected these articles And Finding that some of the articles of the said report and accompt drawen of the same were wrong in the Calcule Therfore they have made a right Calcule of these articles and have stated them as they are now right Calculate And Finding that ther were severall articles stated as resting to the Viscount of Tarbat and his tenants They at the Desyre of the Viscount himself did delite all these articles In Respect he Declared that he hade retained the Herth money payable out of his lands for payment of the soumes in these articles and protested that if at any time hereafter the said hearthmoney shall be exacted then he shall have liberty to state and Craved payment of these articles albeit the time for ingiveing the accompts should be then elapsed seing the same has been once timeously given in And Finds that Conforme to the reports and accompts drawen of the same Ther is resting by his majesties forces upon scots pay and be the Garisones afterspecified which Consisted all of forces upon scots pay to the heritors tenents and other inhabitants within the western division of the said shire of Ross besides the articles refused rejected or past frae as said is The Soumes following Viz by the Lord Strathnaver his regiment of foot the Sum of ane thousand seven hundreth and six punds fourtein shilling five penies scots Item by the Laird of Grant his regiment of foot the sum of Two hundreth and fourty two punds thretein shilling four penies Item by the deceast Lord Cardross his regiment of Dragoons the soume of twenty Eight punds five shilling ten penies scots Item by the Lord Yester and Major Stewarts troops the sum of Fiftie two punds Eight shilling scots Item by the Viscount Kenmuir his regiment of foot the sum of sixtie one punds two shilling thrie penies scots Item by Coll Richard Cuninghame his regiment of foot the sum of sixtie one punds two shilling thrie pennies scots Item by the Garison of Barhane the sum of Two hundreth and fourtie four punds twelue shilling Eight penies scots Item by the Garison of Castleod the sum of Two hundreth and sixtie five punds one shilling four penies scots Extending the haill sums forsaids resting by his majesties forces upon scots pay and be the Garison forsaids Which Consisted all of forces upon scots pay to the heritors tenents and other inhabitants within the western division of the said shyre of Ross are Contained in the report of the saids Commissioners to the sum of two thousand six hundred and sixtie two punds one shilling scots money and the Committie Finds it suficiently proven by the attested Copie of a precept under the hand of Captain Monro of Faiollis younger in the Lord Strathnavers regiment that besides the soumes forsaid in the report Extending as said is Ther is resting by the Lord Strathnaver his regiment of foot to the magistrats of Dingwall the Sum of Fourscore sixtein punds scots money forsaid And Finds that the articles forsaids allowed by the Committie and stated in the Commissioners report and also the articles to the magistrats of Dingwall were all furnished preceiding the first day of February Jaj vjc nyntie one years and that they are all in the termes of the nynth act Fourth session of this Current parliament intitulled act for polemoney and also of the proclamationes of Councill relative therto And Therfore it is the Commities opinion that the heritors and tenents within the western divisione of the said shyre of Ross are to be Recomended to the Lords Commissioners of his majesties thesaury for payment of the said soumes of Two thousand six hundreth and sixtie two punds one penie scots out of the present poll money And that the magistrats of Dingwall are to be recomended to the Lords Commissioners for payment to them of the said Fourscore sixtein punds scots out of the same polemoney And Finds that there is resting be Sir Thomas Livingstoune his regiment of Dragoons quhich wes not upon scots pay to the heritors tenents and inhabitants forsaids the sum of Threttie punds scots and it is ther opinion that this is to be transmitted to the kings majestie that he may order such Course to be taken theranent as in his Royall wisdome shall think fitt and the Committie Finds by the said report of the Commissioners of Ross shyre that ther weer furnished be the heritors tenents and other inhabitants within the westerne division of the said shyre to the magizan at Inverness preceiding the first of February Jaj vjc nyntie one years Corne and straw extending to the soume of nyne hundreth fiftie six punds 14S i0d scots and to the said magizin and the said deceast Lord Cardross his regiment of Dragoons Corne and straw preceiding the said day extending to the soume of six hundreth thretie nyne pund four shilling Eight penies scots And they leave to his majesties privy Councill to determine how thir Last two sums are to be payed and out of what Fond as the said report bears The saids Lords Doe heirby Recommend to the Commissioners of parliament appointed anent the polemoney to Cause make payment to the saids heritors tenents and inhabitants of the said Division of the above sum of Two Thousand six hundred sixtie two punds one shilling scots as resting be his majesties forces and Garisones upon scots pay and that out of the polemoney Deduceing from the said sum the sums following Viz Two hundreth fiftie four punds twelue shilling Eight penies scots furnished to the Garisone of Brahan and two hundred sixtie five pound one shilling four penies furnished to the Garison of Castleod Which two sums the Councill refuses to allow untill it be Condescended upon and proven what scots forces were in these Garisones and how much was furnished to each regiment or troop And Recomends to the saids Commissioners of parliament To Cause make payment to the magistrats of Dingwall of the above sum of Fourscore sixtein punds scots resting by the Lord Strathnavers regiment to them and that out of the said pole-money and appoints the above soume of Thretie punds resting be Sir Thomas Livingstons regiment quhich wes not upon such Course to be taken therwith as in his Royall pleasure he shall think fitt, And as to the sum of nyne hundreth The Lords of his Majesties privy Councill haveing Considered the report of a Comittie of ther oun number appointed for revising the accompts resting by his majesties forces to the Countrey Bearing that the Comittie having Considered the two recepts and oblidgments given in to them both granted be Captain Nathaneall Stafney Comander of the Dragoons in Killdrumy Castle in my Lord Cardross regiment the one therof to Arthur Forbes of Auchintoull for the soume of fyve hundreth fiftie Eight merks twelue shilling scots and that for meall malt and a horss bought by him from the said Arthur Forbes and Which he oblidges him to pay to the said Arthur betwixt and Lambes then nixt or how soon pay comes up to the troop under his Comand dated the thretein day of June Jaj vjc nyntie years and the other therof to Mr Patrick Andersone of Miltoune for the soume sixtie thrie merks six shilling Eight penies scots for most sold be the said Mr Patrick for the use of the forsaid Garison of the same date and quhich is assignd to the said Arthur Forbes of Auchintoull to be uplifted be him Extending both the saids soumes to the soume of six hundreth twentie two merks five shillings four penies scots The Committie Finds that the saids two formes extending as said is were furnished preceiding the first day of February Jaj vjc nyntie one years and that they are in the termes of the nynth act fourth session of this Curent parliament Intitulled act for polemoney and also in the termes of the proclamationes of Councill relative therto Therfore It is the Commities opinion that the said soume of six hundred twentie two merks five shilling four penies scots Is to be payed out of the said polemoney And that the said Arthur Forbes Is to be Recomended to the Lords Commissioners of his majesties thesaury for payment of the same accordingly as the said report bears The saids Lords of his majesties privy Councill Doe heirby approve therof except as to the pryce of the above horss for quhich they ordaine two Hundred merks to be deduced from the above totall soume and Recomends to the Commissioners of parliament2 appointed anent the polemoney to Cause payment be made to the above Arthur Forbes of the remander of the said totall soume Extending the said remainder to Four twentie two merks five shilling four penies scots and that out of the said polemoney.

Anent the petition given in to the Lords of his majesties privy Councill be Mr Archibald Rahame late Bishop of the Isles Shewing That quher severall of the inhabitants within the bounds of the said bishoprick of the Isles hath hitherto been deficient in payment to the petitioner and John Grahame of Dougallstoune as deryveing right from him of the revenue of the said Bishoprick and the petitioner having used the outmost dilligence that the Law Could allow and hes been at very great expences yet the in accessiblnes and distance of the said bounds hes rendered all ineffectuall these thretein or fourtein years bygon and the petitioner having presented ane act to his majesties high Commissioner and right honoraball estates of parliament Craveing and warrand to quarter for what of the said revenues is Justly resting to the petitioner upon such as are Lyable in payment therof the samen being first Constitute against them by legall sentances or otherwise that military asistance might be granted for useing of poynding and Captione therfor and to appoint the Comander in Cheif to order the said assistance and that is should be used on the Charger of the persones Lyable in payment, upon reading quherof It is majesties high Commissioner and estates of parliament Recomended to ther Lordships to fall upon such methods as might make the payment of the above rents effectuall upon the Charges of the persones Lyable in payment as the extract of the said recomendation of parliament therwith produced bears And Therfore humbly supplicating to the effect aftermentioned The Lords of his majesties privy Councill having Considered the above petition given in to them be the above Mr Archibald Grahame late Bishop of the Isles with the extract of the Recomendation of parliament mentioned therin and produced therwith They Recomend to and Requyre the Comander in Cheif of his Majesties forces within this kingdome or the Governor of Inverlochie for the time to Grant parties for assisting the petitioner and the above John Grahame of Dougallstoune or ther factors for ingathering of the above rests by poynding and Caption the sentance of a Judge allwayes preceiding the same and that upon the Charges and expenses of these Lyable in payment

Anent a Petition given in to the Lords of his majesties privy Councill be Patrick and James Feas elder and younger of Whithall Shewing That quher the said Patrick having a proces depending before ther Lordships against Robert Elphingstone of Lapnes for spulzieing and awaytaking his wholl goods and estate He to Imped the petitioners prosecutione in the said action and knowing that as a stranger he would be straitned in finding Cautione upon the place He most maliciously and without all Imaginable ground Caused Charge the said Patrick Fea and the said James Fea his sone with Councill Laborowes and therupon has taken out Caption against the petitioners wherby they were necessitate to absent themselves and cannot appear to attend the prosecutione of ther action befor ther Lordships which is Lapnes only designe in raiseing therof albeit in obedience therunto they did offer Patrick Trai ventner burges of Leith Cautioner for the petitioners a man nottorly respected and the only freind and acquantance the suplicants hade upon the place yet he is wrongeously refused to be accepted without ther Lordships order And Therfore humbly Craving the saids Lords to Ordaine the Clerks either to accept of the Caution offered or to prorogate the dyet to such a Competent time as the supplicants send to Orkney and have Cautionrie returned by some of their freinds in that place as the petition bears The Lords of his majesties privy Councill Having Considered this petition given in to them be the above Patrick and James Faes They heirby Give order and warrand to the Clerks of Councill to receive the above Patrick Traill as Cautioner for the petitioners in the suspensione of Laborrowes offered at the instances against the above Robert Elphingston of Lapnes and therupon to exped and give out the said suspensione.

The Lords of his Majesties privy Councill having Considered the report of a Comittie of ther oun number appointed for reviseing the accompts resting be his majesties forces to the Countrey Bearing That the Committie having Considered the accompts given in to them as resting by his majesties forces to the persones therin named within the lands and barony of Kilsyth and toune therof with the instructions and verificationes of the same They Find that ther are a great part of the saids accompts resting be the forces which are not upon scots pay as to quhich the ingivers doe not insist for payment at this time In Respect the same will not be allowed out of the polemoney And Therfore the Committie have not medled with any of these articles And Finds that ther is one of the articles of the saids accompts resting by the forces upon scots pay which is not in the termes of the act of parliament for polemoney and proclamationes of Councill relative therto, And Therfore they have refused and rejected the said article And Finds that the haill other articles of the saids accompts resting by the forces upon scots pay are suficiently verified and proven be the Oathes and depositiones of the persones furnishers therof taken before the Commissioners of supply within the shyre of Stirling Conforme to the Commissioners reports Which with the accompts was produced to and Considered be the said Comittie and Finds that Conforme to the saids accompts and instructiones therof Ther is resting by his majesties forces upon scots pay to the saids persones within the lands and barrony of Kilsyth and toune therof the soumes following Viz be the Earle of Argyll his regiment of foot the soume of ane hundreth thrie score thrie punds two shillings sots Item by the Lord Blantyre his regiment of foot the sum of fiftie two penies thrie shilling Eight penies scots Item by the Earle of Glencairne his regiment of foot the Soume of thrie score punds nyne shillings too penies scots Item by the Viscount of Kenmuir his regiment of foot ten punds Scots Item by the deceast Earle of Mar his regiment of foot thrie punds six shilling scots Item by the Eglingtone his troop of horss the soume of thretie one punds seventein shilling scots Item be the Lord Beilhaven his troop of horss thrie pund seventein shilling scots Item by the Lord Ross his troop of horss two punds Eight shilling scots Item by the deceast Lord Angus his regiment of foot the soume of six punds scots Extending the haill soumes forsaids to the soume of Thrie hundreth thretie one punds too shilling ten pences scots And Finds that the haill articles quherof this last soume is made up were all furnished preceiding the first day of February Jaj vjc nyntie one and that they are all in the termes the nynth act fourth session of this Current parliament Intitulled act for polemoney and of the proclamations of Councill relative therto And Therfore It is the Commitees opinion That the said soume of thrie hundreth thretien punds two shilling ten penies scots Is to be payed out of the said polemoney And that the persones forsaids named in the saids accompts within the lands and barony of Kilsyth and toune therof are to be recomended to the Lords Commissioners of his majesties thesaury for payment of the same accordingly as the said report bears The Lords of the majesties privy Councill Doe heirby approve therof the said report and Recomends to the Commissioners of parliament anent the polemoney To Cause pay to the saids persones the sum of Thrie hundred thretie one punds too shillings ten penies scots in the said report as resting be his majesties forces upon scots pay to them and that out of the said polemoney.
