Warrand for liberating James Drysdale

Sir James Steuart her Majesties Advocat haveing represented to the Board that one James Drysdale wnder the Sentence of banishment pronounced by the Lords Commissioners of her Majesties Justiciary for Incest, and that the saids Lords by the said Sentence had banished him furth of the kingdome, and appoynted him to give bond and find Caution wnder the penaltie of fyve hundreth merks for obtempering and fullfilling the said sentence and that the said James Drysdale could not find the said Caution being in ane Starving condition; His Grace her Majesties high Commissioner, and Lords of her Majesties privie Councell doe heirby alter and change the said sentence Insofarras may concerne his finding Caution allenerly, From finding Caution, To enact himselfe in the books of privie Councell that he Shall obtemper the said Sentence of the saids Lords Commissioners of Justiciary, and shall depairt furth of the Kingdome in the termes therof betwixt and the tenth day of July nixt to come; And upon his enactmyent forsaid Appoynts the keepers of the Tollbooth of Edinburgh, to sett him at liberty furth therof without payment of house dewes; And recommends the Keeper to the Lords Commissioners of her Majesties Theasaury for present and ready payment of the house dues dureing the tyme of the said Drysdaills imprisonment accordingly.

Warrant for liberating James Drysdale

Sir James Stewart, her majesty’s advocate, having represented to the board that one James Drysdale, under the sentence of banishment pronounced by the lord commissioners of her majesty’s justiciary for incest, and that the said lords by the said sentence had banished him forth of the kingdom, and appointed him to give bond and find caution under the penalty of 500 merks for obeying and fulfilling the said sentence, and that the said James Drysdale could not find the said caution, being in a starving condition. His grace [John Campbell, duke of Argyll] her majesty’s high commissioner and lords of her majesty’s privy council do hereby alter and change the said sentence insofar as may concern his finding caution only, from finding caution to enact himself in the books of privy council that he shall obey the said sentence of the said lord commissioners of justiciary, and shall depart forth of the kingdom in the terms thereof between [now] and 10 July next to come. And upon his enactment foresaid, appoints the keepers of the tolbooth of Edinburgh to set him at liberty forth thereof without payment of house dues. And recommend the keeper to the lord commissioners of her majesty’s treasury for present and ready payment of the house dues during the time of the said Drysdale’s imprisonment accordingly.
