Act Earle of Annandale for Stipend of Annan

Anent the petitione given in to The Lords of his majesties privy Counsell be William Earle of Annandale Shewing That wher the paroch kirk and parochin of Annan wherof the petitioner is patrone haveing been vaccand for soume years bygone till of Late that the Samen was planted by the present incumbent By which vaccancies the kirk and manse and office houses and kirkyeard Dykes are become altogither rwinows almost to the very grownd And the petitioner as patron of the said paroch being concerned to Sie the Samen repaired And for that end haveing granted a gift of the bygone vaccand Stipends of the said paroch To William Whyte Stewart clerk of Annandale one of the petitioners Chamberlands for intrometting with and uplifting the bygone vaccand stipends of the parochin of Annan to be disposed upon and imployed by him for repaireing of the said Kirk of Annan and manse and office houses and kirkyeard Dykes belonging therto and other piows wses at the petitioners sight And therfore humbly craveing to the effect eftermentioned As the said petitione bears The saids Lords of his majesties privie Counsell haveing considered the above petitione They heirby interpone ther awthoritie to the gift granted by the bark to the above William Whyte as factor for uplifting of the above vaccand Stipends of the above paroch of Annan to be disposed of and imployed by him for repaireing the kirk of Annan and the manse office houses and kirk yeard dykes belonging therto And the other piows wses mentioned in the gift or petitione at Sight of the said Earle of Annandale And decernes and ordaines the heretors fewers wodsetters liferenters titullars tacksmen of teinds tennents possessors and others lyable in payment of the saids vaccant Stipends to make payment to the said William Whyte as factor of the saids vaccant Stipends for rebwilding and repaireing the said kirk manse and kirk yeard dykes at the sight and order of the said Earle of Annandale And for such other piows uses within the said paroch As the said Earle shall appoint And ordaines Letters of horneing on fiftein dayes wnder the signet of Counsell to be direct heiron at the said William Whyte his instance against the heretors fewers wodsetters possessors and others lyable in payment of the saids vaccand stipends upon prodwctione of a decreit of Localitie And in caise ther be non ordaines the heretors and others foirsaids to make payment of ther respective proportiones of the saids vaccand stipends according As they Shall be decerned by the Jwdge ordinary
