Act anent deficients of the Levy 1695
The Act underwryten being read was votted approven and signed The same was printed and the Sollicitor appointed to transmitt Coppies to the severall shires wherof the tenor folloues
The Lords of his Majesties privie Councill Considering that severall of the shires within this Kingdome have not furnished their proportions of the Levy appointed by the Act of parliament Jaj vic nyntie five have therfore appointed And doe heirby Give order and appoint the Shirreffs of the Shire deficient as said is and as they shall be advertised by Sir Patrick Home his Majesties sollicitor by transmitting to them ane extract of this Act uith the particular Number of their deficient men theirto Subjoyned Conveen the Commissioners of Supplie uith the same And signifie to them that it is their Lordships peremptory Command that they take ane effectuall course For furnishing and putting out their respective numbers of men wanting uith all dilligence And that tho it may happen that in some of these Shires different methods have been taken from these prescribed by the said Act of parliament yet they must still make good their Number And if in the method of the said Act Lotts have been drawen for persones out of the Kingdome which ought not to have been done These Lyable in the respective Shires wher the same was done might Supplie them if not returned And the saids Commissioners are to delyver their deficient men to the officers appointed to receave them at the head burgh of their Shire upon the respective dayes following (Viz) For the Shires on this Syde of Tay the Tuenty fifth of January instant And for the Shires be north Tay the tenth day of February therafter And farder the said shirreff and Commissioners are to Certifie such as are lyable to putt out the said deficient men within their bounds That if they failze to doe the Same The Lords of Councill will decerne them to pay the somme of tuo hundredth merks for each man deficient to the saids officers that should have receaved them And that letters upon a simple charge of six dayes att the instance of his Majesties shall be direct against them for that effect And the shirreff and Commissioners of Supplie In all shires are hereby appointed to Inquire dilligently anent all defectives and whither any of their Men putt furth by them be returned and resett within their bounds And for Encouragement of such as shall apprehend these deserters to be brought up uith the saids deficients att the forsaid day and place The Shirreffs are to Give advertisement that the officers will be Carefull to pay them Liberally As Lykewise they are to Certifie on the other hand that all guilty of resett shall be prosecute for the paying of the hundred pounds and other paines Contained in the proclamation of Councill against resetters of the date the fourth of Apryle Jaj vic nyntie four years uith all rigour And the Lords of his Majesties privie Councill doe heirby require and Command the forsaids Shirreffs to Give ane particular and exact account of their dilligence in the premisses to the Clerks of Councill betuixt and the tuenty fifth day of February nixt to Come That further Course may be taken therin as their Lordships shall Judge needfull for his Majesties service Certifying the saids shirreffs that if they failzie in the premisses aither as to due returns or exact dilligence They shall be Called and Conveened befor the privie Councill to be punished according to their demerit And ordaines these presents to be printed And to be transmitted be the sollicitor to the severall shires sic subscribitur.
