Anent the petitione Given in to the Lords of his Majesties privie Councill By Robert Richardsone Sheuing That wher their Lordships Emitted a proclamation of the date the fifteenth of Agust Jaj vic nyntie six For seising and apprehending Certaine persons therinnamed as Complices uith one Hendry Every alleadged to have Carryed auay ane English ship from Corounna And theruith to have Committed piracy and robbery in the Indian and Persian seas In which proclamation the petitioner Finds his name Insert And Does acknouledge to their Lordships that he was in the ship and Company of the said Every But it is as true that the same hapned by noe forthought or designe of his But purely in this manner viz that the petitioner being then serving In ane English ship Called Saint James Captain Street master and Lying at Carounna with the other ship that was seised by Every and his Crue when the petitioner heard the noise of the tumult that Every had raised He with others were sent off from the St James in their Long boat to Know what the matter meaned But so soon as they Came near and were under the Guns of the vessell seased by Every they were Commanded to Come aboard under the paine of Sinking And being brought aboard The petitioner uith the rest was Immediatly Carryed auay so that therafter he had noe pouer of himself nor Can be Justly charged uith any thing that therafter hapned And seing that this was the pure misfortune of the petitioner a Scotch man among strangers And that it is hard that a proclamation for summar seizure should stand against him being Innocent as said is And that the said matter of fact and his Innocency is attested by Doctor Falconer who was also Carryed auay Innocently by the said Every as their Lordships have found And therfore Humblie Craving to the effect underwryten as the said petition bears The Saids Lords of his Majesties privie Councill Having Considered this petitione given in to them by the said Robert Richardsone with Doctor Falconers testificat mentioned therin and produced therwith They heirby Discharge the said proclamatione Emitted in this Kingdome against Captain Every and his Crue In so farr as the same extends or may be extended against the said petitioner And Declares that he shall not be Lyable to any summar seasure uithin this Kingdome But prejudice of his being Lyable if accused in England or any wher else.
