Anent the petition given into the Lords of his Majesties privy Councill By William Drummond son to Sir John Drummond of Logiealmond Sheuing That wher he uas misfortunatly present at the rankcounter that hapned betwixt Mr William Trent wryter in Edinburgh and Mathew McKaill Son to Mr Matthew McKaill advocat in the park of Holyrud house wherein it hapned both of them to be killed And that it is Certaine that neither John Veatch Son to John Veatch of Dawick nor the petitioner had the Least hand in or occasion to their quarrell more then to be unhappilly present raither as witnesses then any thing else when they killed one another And seing that it was only the petitioners unhappie Simplicity he being not yet much above Eighteen years of age that Led him to be ther present And that their Lordships have thought fitt to appoint a precognition as to the case of the said John Veatch which was exactly the same with the petitioners in the forsaid affair And that he is most willing that the whole truth of his deportment therin may be searched and examined And doe not aither Crave or expect pardon furder then his Innocency shall plead for him And therfore Humblie Craving their Lordships to ordaine a precognition as to the petitioners accession to the forsaid slaughter as they have done in the case of John Veatch To the effect that the petitioner who was only throw misfortune Ingadged as said is but had noe Concerns with the quarrell and is yet under age May have his case represented to his Majestie In order to his Gracious pardon as he shall see cause Which Petition Being upon the tuenty sixth day of Jannuary last by past read in presence of the saids Lords They by their delyverance allowed a precognition to be taken of the matter of Fact in the petition In order to Grace and mercy And appointed a Committie of their oune Number to precognosie the same Which Committie having mett and examined severall famous witnesses And the saids Lords Having this day Considered the examination of the witnesses They Find that the said William Drummond was not present in the Company when the said quarrell fell out But was gone out of the Company before And that tho he mett with the saids persons and others the Sabboth therafter yet ther did nothing pass while he uas present about the said quarrell nor is ther any thing farder Informed in this matter save that by publick fame The said William is reported to have been present when the slaughter fell out And the saids Lords alloues these presents to be transmitted to the Kings Majestie.
